Nipper, and Linda L. Swearingen. Also present was Mike Maier, County Administrator; CONVENE AS THE GOVERNING BODY OF 4-H/EXTENSION COUNTY SERVICE DISTRICT 1. APPROVAL OF WEEKLY ACCOUNTS PAYABLE VOUCHERS FOR 4-H/EXTENSION COUNTY SERVICE DISTRICT Before the Governing was approval of the weekly accounts payable vouchers for the 4-H/Extension County Service District in the amount of $$1,062.10. SWEARINGEN: So moved. NIPPER: Second. VOTE: SCHLANGEN: YES NIPPER: YES SWEARINGEN: YES CONVENE AS THE GOVERNING BODY OF 9-1-1 COUNTY SERVICE DISTRICT 2. VOTE: SCHLANGEN: YES NIPPER: YES SWEARINGEN: YES CONVENE AS THE GOVERNING BODY OF BEND LIBRARY COUNTY SERVICE DISTRICT APPROVAL OF WEEKLY ACCOUNTS PAYABLE VOUCHERS FOR BEND LIBRARY COUNTY SERVICE DISTRICT Before the Governing Body was approval of the weekly accounts payable vouchers for the Bend Library County Service District in the amount of $2,035.81. VOTE: SCHLANGEN: YES NIPPER: YES SWEARINGEN: YES RECONVENE AS THE DESCHUTES COUNTY BOARD OF COMMISSIONERS SIGNATURE OF RESOLUTION NO 98-141 IMPLEMENTING STATUTORILY REQUIRED CHANGES TO COUNTY'S DEFERRED COMPENSATION PLAN Before the Board was signature of Resolution No. 98-141, implementing statutorily required changes to the County's deferred compensation plan. Mark Amberg reported there were changes that were required prior to January 1, 1999, to transfer plan assets and income from actual ownership by the local government to either a trust, annuity contract or a custodial account to preserve the tax deferred status of the plan. If this is not done, the plan may be subject to taxation by the Internal Revenue Service. SWEARINGEN: NIPPER: MINUTES 2 I move signature of Resolution No. 98-141. Second. DECISION ON THE BOARDS REVIEW OF THE CONDITIONAL USE PERMIT AND PARTITION OF 40 -ACRE PARCELS INTO TWO 20 ACRE PARCELS FOR AMBER CRAIG AND STEVE SCOTT Before the Board was discussion of the decision on the Boards review of the Conditional Use Permit and Partition of 40 -acre parcels into two 20 -acre parcels for Amber Craig and Steve Scott. Bruce White reported the decision will be ready for Board signature on December 30, 1998. Bruce White stated he would contact the DLCD staff and sending them the final list of what had been added into the record. He stated the record had been closed. Commissioner Nipper asked if DLCD would follow through and send the tapes. Bruce White felt that they were operating in good faith and would do so. Bruce White stated the Board could reopen the record to allow those to come in and to allow DLCD any time it may need to respond to what was put in the record. Commissioner Swearingen felt DLCD had at least 25 opportunities to come in and say that they did not like what we were doing, and they did not do it. She felt that when the Dorvinen case showed up, they used that as an excuse to say that this was a violation. She stated they never believed this was a violation. Commissioner Nipper felt we should take Dorvinen on. NIPPER: I move that we reopen the record on the Amber Craig and Steve Scott 40 -acre parcel to two 20 -acre parcels to allow for submission of the tapes that the Board discussed and any response that DLCD would want to make. MINUTES 3 DECEMBER 21, 1998 M VOTE: SCHLANGEN: YES NIPPER: YES SWEARINGEN: YES Bruce White stated the first chance they would have to take County's arguments on was at the Land Use Board of Appeals (LUBA) . George Read reported there was a slide show of non-farm dwellings presented by the County at the Riverhouse. Commissioner Schlangen stated LCDC had come over to look at what we were doing, which means that they acknowledged what we were doing, and they praised it. Bruce White stated he would ask that the tapes from the Riverhouse be added into the record. He stated he would make these three notebooks in the record would be made available to Brent Lake to look at. Bruce White stated he would show the court that Deschutes County has taken a more restrictive road than others. The County did not allow unlimited parcelization. He felt it was important for the court to see that Deschutes County was not a renegade rogue agency. APPROVAL OF WEEKLY ACCOUNTS PAYABLE VOUCHERS Before the Board of County Commissioners was approval of the weekly accounts payable vouchers in the amount of $599,159.75. APPROVAL OF MEMORANDUM OF AGREEMENT BETWEEN DESCHUTES COUNTY AND CITY OF REDMOND Before the Board was approval of Memorandum of Agreement between Deschutes County and the City of Redmond regarding tennis courts. SWEARINGEN: I move approval of this Memorandum Agreement. NIPPER: And I'll second it.
