BEFORE THE BOARD WAS A DECISION OF WHETHER TO HEAR APPEAL A- 98-14 AN APPEAL OF THE HEARINGS OFFICER'S DENIAL OF A 39 -LOT RESIDENTIAL PLANNED UNIT DEVELOPMENT ON BOYD ACRES ROAD FOR THE OREGON LAND DEVELOPMENT COMPANY Bruce White reported the reason the emergency meeting was necessary was because the appeal came in on Wednesday and we were at day 107 of the 120 -day time clock. We could not wait until Monday for the regular Work Session to decide whether to pull it up because we would not be able to meet the 120 -day time clock. Commissioner Swearingen stated she had read the Hearings Officer's decision. She wondered what made the rock outcroppings so special. Damian Syrnyk reported there was a tentative plat submitted by the applicant showing the proposed development and the elevations showing where the rock outcroppings were located. There was a general discussion regarding the maps showing the proposed development. Damian Syrnyk reported the applicant had attempted to preserve about 23% or 2.3 -acres of the site for common areas. The applicant had also included a common area which included a good portion of the ridge. Bruce White stated there were two decisions to be made. They Board needed to decide whether to hear this appeal. They would also need to decide whether to hear it on the record or de novo. The applicant had requested it be heard de novo.
