Chair Linda L. Swearingen called the Board of County Commissioners
meeting to order at 10:02 a.m. County Commissioners present were
Linda L Swearingen, Tom DeWolf, and Dennis R. Luke. Also present
was Damian Syrnyk, Planner; Mike Maier, County Administrator; and
Jim Bonnarens, Property Management.
1. CITIZENS COMMENTS - NONE
2. LAND EXCHANGE WITH BEND METRO PARK & RECREATION
Before the Board was a land exchange with Bend Metro Park &
Recreation.
Carrie Whitaker reviewed the land exchange with the Board.
She stated it was an exchange proposal between Mr. Smith and
the Park & Recreation District. It included three parcels
that the Park & Recreation District owned in exchange for the
23 -acre log deck parcel in the old mill. She stated there
would be a public comment period before the agreement was
finalized. She stated the three park district properties had
been given to them by the County. When the County gifted them
there was a reversionary clause on them that calls for them to
be used for public purposes. In the past the County had the
reversionary clauses removed from the existing parcels to the
new parcels that have been acquired. She reported the Tumalo
Reservoir parcel was and 80 -acre parcel just west of the
Tumalo Reservoir. The Gosney & Highway 20 property was over
200 acres. She stated the Westgate parcel on Century Drive
was 129 -acres. These properties would be in exchange for a
23 -acre log deck parcel owned by Bill Smith.
Carrier Whitaker asked about the removal of reversionary
clauses on the properties involved and assign it on log deck
property when Bend Metro acquired it.
Carrie Whitaker stated there was a difference in values. She
stated the property owned by Bill Smith had the higher value.

She stated, based on the appraised values, there was
$1,033,500 difference in values.
Rick Isham stated the procedure was to publish notice for 4
consecutive weeks so there would be about a 6 -week time frame
for the County.
The Board felt they needed to go forward with this by adopting
a resolution of intent.

Bill Smith stated the values set were done by Dana Bratton.
He reported donations would be made by Les Schwab and there
would be a park named Les Schwab Park. He felt the wild card
in the equation was the Forest Service.
3. ADOPTI.ON_ OF ORDINANCE NO. 99-007, AMENDING THE BEND AREA
GENERAL PLAN MAP TO CHANGE THE PLAN DESIGNATION AND ORDINANCE
NO. 99-008, AMENDING THE BEND URBAN AREA ZONING MAP, OF THE
DESCHUTES COUNTY CODE FOR DAN KIESOW FOR PROPERTY LOCATED AT
20275 HARDY ROAD, BEND
Before the Board was adoption of Ordinance No. 99-007,
amending the Bend Area General Plan Map to change the plan
designation and Ordinance No. 99-008, amending the Bend Urban
Area Zoning Map of the Deschutes County Code for Dan Kiesow
for property located at 20275 Hardy Road in Bend.

GOVERNING BODY THE LIBRARY BOARD, AND REPEALING CHAPTER 2.33
IN ITS ENTIRETY AT 11:59 P.M. ON JUNE 30 1999

Before the Board was adoption of Ordinance No. 99-006,
amending Deschutes County Code Chapter 2.33, to make Deschutes
Public Library District Governing Body the Library Board and
repealing Chapter 2.33 in its entirety at 11:59 P.M. on June
30, 1999.

Consent agenda items before the Board of County Commissioners
were: 1) award of Contract to Richard Turi for architectural
design service for a new public library building in La Pine;
2) appointment of Dave Leslie as County Representative to the
Deschutes Province Advisory Committee; 3) signature of GIS
Software License Agreement; 4) signature of Deed to Donald and
Jenny Veenker authorized under Order No. 98-204; 5) signature
of Sisters Avenue Intergovernmental Agreement; 6) signature of
closing documents and Environmental Indemnity Agreement to
purchase Redmond tennis courts from City of Redmond and
Redmond School District for Becky Johnson Community Campus; 7)
approval of placeholder legislative concept to address
Deschutes Basin groundwater issue; 8) signature of Order No.
99-010, transferring cash among various funds within the 1998-
99 Deschutes County Budget; 9) signature of Orders No. 99-024
and 99-025, authorizing the refund of taxes; 10) signature of
Liquor License for Bend Golf & Country Club; 11) signature of
Memorandum of Communication Site Lease Agreement for Awbrey
Butte; 12) signature of Order No. 99-035, accepting a petition
for annexation to the Cloverdale Rural Fire Protection
District and setting a hearing date; and 13) signature of
Order No. 99-034, accepting a resolution of the La Pine
Special Sewer District declaring its intent to annex territory
and setting a hearing date.
