Removal of this certificate may invalidate this certificate and affect the admissibility of the original instrument into evidence in any legal proceeding) I hereby certify that the attached instrument was received and duly recorded in Deschutes County records: DATE AND TIME: DOCUMENT TYPE: Jun. 24, 1999; 3:02 p.m. Order (CJ) NUMBER OF PAGES: 3 MARY SUE PENHOLLOW DESCHUTES COUNTY CLERK ---- /oqq• jq REVIE.'ED BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON An Order Authorizing and Directing the * 99 JUN 24 PH 3: 02 Transfer of Real Property to the * M Q i2 Y S U't it N i l O L L 0 W' Terrebonne Domestic Water District * COUNTY CLERK District to be Used Exclusively for Public Purposes and Rescinding Order 98-073 ORDER NO. 99-101 WHEREAS, ORS 271.330 provides that Deschutes County may transfer real property not needed by the County to another governmental body after a hearing; and WHEREAS, a hearing was held on June 3, 1998, pursuant to Resolution 98-046, and continued on June 10, 1998; and WHEREAS, the Board of County Commissioners find that Deschutes County does not need certain real property for public purposes; and WHEREAS, the Board of County Commissioners find that the Terrebonne Domestic Water District is a district organized under the laws of the State of Oregon and will use certain real property for public purposes; and WHEREAS, the Board of County Commissioners finds that the proposed transfer is in the public interest; now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, AUTHORIZES AND ORDERS as follows: Section 1. That Deschutes County shall transfer to Terrebonne Domestic Water District the real property, the true consideration for which shall be the perpetual use of said real property for public purposes, pursuant to ORS 271.330, described herein as follows: Blocks Seven (7) through Twelve (12), and Blocks Twenty-five (25) through Thirty (30), Hillman (Terrebonne), Deschutes County, Oregon; TOGETHER WITH the vacated streets therein; EXCEPTING however that tract of land heretofore platted as John O. Forester's and M. Pauline Forester's replat of a portion of Blocks Seven (7), Eight (8), Eleven (11), Twelve (12), Twenty-five (25), Twenty-six (26), Twenty-nine (29) and Thirty (30), of the original plat of PAGE 1 OF 2 - ORDER NO. 99-101 (6/21/99) HILLMAN; and FURTHER EXCEPTING therefrom and reserving unto Grantors a parcel of land measuring one hundred feet (100') East and West and three hundred feet (300') North and South in the exact Northwest corner of the above described tract. Section 2. That upon review and approval of County Counsel, a bargain and sale deed be executed and recorded transferring said property to Terrebonne Domestic Water District, subject to a reversionary interest of Deschutes County should said property cease to be used for public purposes. Section 3. That the Deschutes County Counsel shall be authorized to take those actions reasonably calculated to complete the aforementioned assignment of lease and transfer of real property.
