Transfer of Real Property to the Bend * MARY SUE PENHOLLOW
Metropolitan Park and Recreation * COUNTY CLERK
District to be Used Exclusively for Public
Purposes and Rescinding Order 98-074
ORDER NO. 99-098
WHEREAS, ORS 271.330 provides that Deschutes County may transfer real property not
needed by the County to another governmental body after a hearing; and
WHEREAS, a hearing was held on June 3, 1998, pursuant to Resolution 98-045, and
continued on June 10, 1998; and
WHEREAS, the Board of County Commissioners find that Deschutes County does not
need certain real property for public purposes; and
WHEREAS, the Board of County Commissioners find that the Bend Metropolitan Park
and Recreation District is a district organized under the laws of the State of Oregon and will use
certain real property for recreation and related public purposes; and
WHEREAS, the Board of County Commissioners finds that the proposed transfer is in the
public interest; now, therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY,
OREGON, AUTHORIZES AND ORDERS as follows:
Section 1. That Deschutes County shall transfer to Bend Metropolitan Park and
Recreation District the real property, the true consideration for which shall be the perpetual use
of said real property for recreation and related public purposes, pursuant to ORS 271.330,
described herein as follows:
Parcel 1
A Tract of land being the North one-half (N1/2) of the Northwest one-quarter
(NWl/4) and the Southeast one-quarter (SE1/4) of the Northwest one-quarter
(NW1/4) of Section 17, Township 18 South, Range 13 East, of the Willamette
Meridian, Deschutes County, Oregon;
SUBJECT TO: All roads, easements and encumbrances of record, and those
common and apparent on the land.

Parcel 2
A Tract of land being the North one-half (NI/2) of the Northeast one-quarter
(NEI/4), the Southwest one-quarter (SWI/4) of the Northeast one-quarter (NE1/4),
the Northwest one-quarter (NW1/4) of the Southeast one-quarter (SE1/4), and the
Northeast one-quarter (NEI/4) of the Southwest one-quarter (SWI/4) of Section
18, Township 18 South, Range 13 East, of the Willamette Meridian, Deschutes
County, Oregon;
EXCEPTING THEREFROM: A strip of land for road right-of-way and utility
purposes being 80.00 feet in width as described in Deschutes County
Commissioners order No. 81-210, dated April 1, 1981, recorded in volume 37,
page 645, Deschutes County Deed Records, Deschutes County, Oregon;
SUBJECT TO: all roads, easements and encumbrances of record, and those
common and apparent on the land.
Section 2. That upon review and approval of County Counsel, a bargain and sale deed
be executed and recorded transferring said property to Bend Metropolitan Park and Recreation
District, subject to a reversionary interest of Deschutes County should said property cease to be
used for recreational and related public purposes.
Section 3. That the Deschutes County Counsel shall be authorized to take those actions
reasonably calculated to complete the aforementioned assignment of lease and transfer of real
property.
Section 4. Order 98-074 is hereby rescinded.
