ORDER NO. 99-121
WHEREAS, Order No. 98-161 authorized the sale of certain property to acquire a project
described as the Health and Human Services Building in Bend, Oregon, the Becky Johnson
Community Campus in Redmond, Oregon, and 1031 N.E. Penn Avenue, Bend, Oregon (Project);
WHEREAS, the Board has considered the sale of the property described in Exhibit A attached
hereto and by this reference incorporated herein, by listing the real property for sale with the County's
Real Estate Broker of Record;
WHEREAS, based on the facts presented the Board of County Commissioners at its regular
meeting, that the transfer be exempt from bid and be sold on the open market for not less than its fair
market value.; and
WHEREAS, the Board of County Commissioners finds that the fair market value of the real
property is not less than $400,000.00, now, therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON,
HEREBY ORDERS as follows:
Section 1. That the real property described in Exhibit "A," attached hereto and by this
reference incorporated herein, be sold on the open market and transferred pursuant to Order 98-161 for
the acquisition of the Project described above.
Section 2. The Chair is authorized to sign listing documents offering the real property for
sale. Approval of any sale, unless unconditional and for the listing amount of $450,000.00, shall be by
not less than two Board members.

A parcel of land located in the NE '/4 NE '/4 of Section 32, Township 17 South, Range 12
East, Willamette Meridian, Deschutes County, Oregon, and being a portion of Tract 11,
Lytle Acres, an unrecorded subdivision in the City of Bend, being more particularly
described as follows:
Commencing at the #4 rebar monumenting the northwest corner of
said Tract 11 as shown on the 1996 survey titled "Right of Way Map,
Olney Avenue Through Tract 11 Lytle Acres" and filed in the
Deschutes County Surveyor's Office as CS12523, the Point of
Beginning; thence S00°31'52"E 178.07 feet to a #5 rebar with a
Deschutes County Public Works aluminum cap stamped "LS2390
Prop.Cor."; thence S00°31'52"E 12.00 feet to the north line of the 10
foot wide strip of land conveyed to the City of Bend for additional
right of way for Olney Avenue in that 1957 deed recorded in Volume
115, Page 423, of the Deschutes County Deed Records, thence along
said north line S89°57'23"E 192.51 feet to the west line of that portion
of said Tract 11 conveyed to Cascade and Heating Specialties in that
1989 Warranty Deed recorded in Volume 181, Page 1618 of the
Deschutes County Official Records; thence leaving said north line and
along said west line N00°25' 10"W 30.13 feet to a #5 rebar with a
Deschutes County Public Works aluminum cap stamped "LS2390
Prop.Cor."; thence N00°25' 10"W 159.89 feet to the north line of said
Tract 11; thence leaving said west line of deed Vol. 181 Pg. 1618
N89056137"W 192.88 feet to the Point of Beginning.
SUBJECT TO the dedication for additional right of way for Olney
Avenue in that 1996 deed recorded in Volume 402, Page 971, of the
Deschutes County Official Records.
Containing 36,620 square feet (0.84 acres) gross and 33,795 square
feet (0.78 acres) net lying outside the portion dedicated in said Vol.402
