Swearingen, Dennis R. Luke, and Tom DeWolf. Also in attendance was Mike Maier, County Administrator; Marty Wynne, Treasurer/Finance Director; Rick Isham, County Counsel; Mark Amberg, Assistant County Counsel; Tom Blust, Road Department Director; and George Kolb, County Engineer. 1. PUBLIC NOTICE REOPENING THE HEARING ON THE LAND EXCHANGE WITH BEND METRO PARK & RECREATIONDISTRICT ON JUNE 9, 1999 AT 10 A.M. Before the Board was approval of a public notice to reopen the hearing on the land exchange with Bend Metro Park & Recreation District on June 9, 1999 at 10 a.m. DEWOLF: I move approval of this public notice. SWEARINGEN: Second. VOTE: SWEARINGEN: YES DEWOLF: YES LUKE: YES 2. SIGNATUREO F TERMINATION OF CONTRACT WITH OCON. INC. Before the Board was signature of the Termination of a contract with OCON, Inc. Tom Blust reported the contract had been awarded to OCON, Inc. for supplying crushed rock for. the chip seal program. The contract was for MINUTES Page 1 of 2 JUNE 1, 1999 $154,000 and they were to deliver 16,200 tons of crushed rock. The contract was to be completed by May 27, 1999. As of that date OCON had delivered zero rock for the Road Department. LUKE: I move that we find that OCON is in default of their contract, the contract is null and void, we authorize the termination of the contract and the Road Department to go out for rebid as soon as possible. Luke, Commissioner MEMORANDUM TO: BOARD OF COUNTY COMMISSIONERS FROM: TOM BLUST, DEPARTMENT DIRECTOR SUBJECT: TERMINATION OF CONTRACT FOR SUPPLYING AND HAULING OF CRUSHED ROCK DATE: 05/28/99 CC: RICK ISHAM, LEGAL COUNSEL Before the Board for consideration of signature is a letter terminating the contract with O.C.ON. Inc. for the Supplying and Hauling of Crushed Rock. Discussion: On March 10, 1999, the Board of County Commissioners awarded the contract for Supplying and Hauling of Crushed Rock to O.C.O.N Inc. for $154,230.00. This contract had a completion date of May 27, 1999. As of the May 27 date, no chip rock has been delivered to the sites specified in the contract. With the approach of chip seal season, we need to re -bid the contract as soon as possible to have the necessary rock on hand. Recommendation: The Road Department recommends signature of the letter terminating the contract. Quality Services Performed with Pride
