Chair Linda Swearingen called the Board of County Commissioners meeting to order
at 9:00 A.M. County Commissioners present were Linda L. Swearingen, Dennis R.
Luke and Tom DeWolf. Also present was Bruce White, Assistant County Counsel;
Paul Blikstad, Planner; Dan Peddycord, Health Department Director; and George
Read, Community Development Director.
1. DECISIONON OREGON DEPARTMENT OF TRANSPORTATIONWEIGH
STATION
Before the Board was a decision on the location of the Oregon Department of
Transportation weigh station.
Commissioner Luke stated his main concern was safety. He felt Oregon
Department of Transportation's application was incomplete in several respects
and, therefore, they failed to meet their burden of proof. He expressed concern
about the neighboring uses being effected by noise, glare, odor and other
adverse impacts. He stated Oregon Department of Transportation had not
shown that the design of the proposed weigh station would allow for safe
access for trucks entering Highway 97.
Commissioner DeWolf stated that the site, design and operating characteristics
would not be compatible with the surrounding area. He felt the site would
collect trash and human waste, and trash pick up once a month was not enough.
He felt that Oregon Department of Transportation had not met their burden of
proof in a number of areas. He felt that this was not the kind of structure that
would create a good first impression for people entering Bend. He felt that
Oregon Department of Transportation should choose a site more compatible
with surrounding areas.
LUKE: I would move to reverse the Hearings Officer's decision.
DEWOLF: Second.
