August 11, 1999
Commissioner Linda L. Swearingen called the Board of County Commissioners
meeting to order at 10:00 a.m. County Commissioners present were Linda L.
Swearingen, Dennis R. Luke, and Tom DeWolf. Also present was Mike Maier,
County Administrator; Dennis Maloney, Community Justice Director; Bruce White,
Assistant County Counsel; Mark Amberg, Assistant County Counsel; Kelly Jacobs,
Adminitrative Analyst; and Mike Gerdau, Support Services Manager.

2. SIGNATURE OF RESOLUTION NO. 99-067 A RESOLUTION IN
SUPPORT OF THE SOUTH CENTRAL DOMESTIC VIOLENCE
COALITION AND CONSTRUCTION OF A CENTER IN LA PINE
Before the Board was signature of Resolution No. 99-067, a resolution in
support of the South Central Domestic Violence Coalition and construction of
a center in La Pine.
Dennis Maloney reported there was a proposal to put up a safe house. The
unique approach to this project was that the community was going to do it in
a "barn raising" fashion with the assistance of the work crews. He felt the
offenders should also help pay for some of the construction.
Commissioner DeWolf stated he was real excited about the project. He felt it
was great to have the community involved with the county to bring this project
to fruition.

Commissioner Swearingen felt like it was a "grass roots" effort which the
community had created. She felt it was exciting for the community to bring
this project forward.

3. SIGNATURE OF PURCHASE AND SALES AGEEMENT WITH LA PINE
WATER COMPANY
Before the Board was signature of a Purchase and Sales Agreement with La
Pine Water Company.
Bruce White reported this agreement needed to be approved subject to review.
LUKE: I would move the purchase and sale agreement for this well
site subject to review by Legal Counsel.

Bruce White reported there were additional documents that went along with
which would need signing. He stated there was an Assignment of Water
Rights which did not need to be signed. He reported there was a Bill of Sale
for the Land Use Permit which would be signed by Patrick Gisler and Dean
Rogers.

4. SIGNATURE OF CANCELLATION OF LICENSE WITH LA PINE WATER
COMPANY. ASSIGNMENT OF BLM PERMIT, AND ACCEPTANCE OF
BARGAIN & SALE AGREEMENT
Before the Board was signature of cancellation of License with La Pine Water
Company, assignment of Bureau of Land Management Permit, and acceptance
of Bargain and Sale Agreement.
LUKE: I would move the Board Chair have the authority to sign all
the agreements that will conclude the sale of the well site
subject to review.

5. ADOPTION OF ORDINANCE NO. 99-018 AMENDING DESCHUTES
COUNTY CODE TITLE 3. PERSONNEL TO CLARIFY AT -WILL
EMPLOYMENT STATUS OF DEPUTY DISTRICT ATTORNEYS
Before the Board was adoption of Ordinance No. 99-018, amending Deschutes
County Code Title 3, Personnel, to clarify at -will employment status of Deputy
District Attorneys.
LUKE: I would move first and second reading of Ordinance No.
99-018, by title only.

6. CONSENT AGENDA:
Consent agenda items before the Board of County Commissioner were: 1)
signature of Order No. 99-131, accepting the Road Improvement, the
Engineer's Assessment Report and setting a hearing on the final assessment for
the improvements of Piute Local Improvement District; 2) signature of Order
No. 99-133, accepting the road improvements, the Engineer's Assessment
Report and setting a hearing on the final assessment for the improvements of
Hereford Local Improvement District; 3) signature of Resolution No. 99-068,
appointing Linda Swearingen as signature on Human Services Grant; 4)
signature of Resolution No. 99-069, declaring the intent of Deschutes County
to exchange property with Central Oregon Irrigation District for Deschutes
Market Road right-of-way and construction project; 5) appointment of Ron
Gall to the Forest Acres Special Road District; and 6) signature of Liquor
Licenses for Mt. Bachelor Sunrise Lodge, West Village Lodge, Pine Marten
Lodge, Pine Marten Lodge, Nordic Lodge, Mt. Bachelor Minilodge, La Pine
Hiway Center Marketplace, and Baja Norte.
