Chair Linda L. Swearingen called the Board of County Commissioners meeting to
order at 10:00 a.m. County Commissioners present were Linda Swearingen and
Dennis R. Luke. Also present was Mike Maier, County Administrator; Bruce White,
Assistant County Counsel; George Kolb, Engineering Services Manager; Tom Blust,
Road Department Director; Gary Judd, Road Department; Tom Anderson,
Management Analyst; and George Read, Community Development Director.

2. PUBLIC HEARING ON ORDER NO 99-129 ANNEXATION OF
TERRITORY KNOWN AS KACHINA ROAD INTO RURAL FIRE
PROTECTION DISTRICT NO. 1
Before the Board was a public hearing on Order No.99-129, annexation of a
territory known as Kachina Road into Rural Fire Protection District No. 1.
Bruce White reported this hearing was to see if there were any objections to
this annexation.
Chair Swearingen opened the public hearing.
Bob Keller, petitioner, testified in support of the annexation.
There being no further testimony, the public hearing was closed.

3. PUBLIC HEARING ON THE LIMESTONE LOCAL IMPROVEMENT
DISTRICT PROPOSED FINAL ASSESSMENTS
Before the Board was a public hearing on the Limestone Local Improvement
District proposed final assessments.
Tom Blust reported this hearing was to hear objections to the Limestone Local
Improvement District. This local improvement district consisted of improving
approximately five miles of road in the Whispering Pines subdivision. The
total project cost was $984,161.52. The cost per lot was $6,308.73 with 156
lots included. This cost was less than the estimated cost per lot. The lot
owners could finance the assessment through the County Finance Department
over a 10 year period with the first payment due April 1, 2000. The payments
of $443.80 were due twice a year.
Bruce White reported .the interest rate would be 7%.
Chair Linda Swearingen opened the Public Hearing
Russell testified regarding the driveway being lower than the road. Gary Judd
responded by stating that the maintenance crew would be delivering the gravel
within one week.
There being no further testimony, the public hearing was closed.

4. SIGNATURE OF RESOLUTION NO. 99-070, DETERMINING AND
CERTIFYING FINAL ASSESSMENTS, SETTING TERMS OF PAYMENT
AND REQUIRING NOTICES FOR PROPERTY OWNERS IN LIMESTONE
LOCAL IMPROVEMENT DISTRICT
Before the Board was signature of Resolution No. 99-070, determining and
certifying final assessments, setting terms of payment and requiring notices for
property owners in Limestone Local Improvement District.
LUKE: I would move signature of Resolution No. 99-070, as
amended by Legal Counsel.

5. ADOPTION OF ORDINANCE NO. 99-022, AMENDING TITLE 15,
BUILDINGS AND CONSTRUCTION. ONE YEAR EXTENSION OF
LIGHTING ORDINANCE COMPLIANCE DATE
Before the Board was adoption of Ordinance No. 99-022, amending Title 15,
Buildings and Construction, one year extension of the lighting ordinance
compliance date.
George Read stated this was a request for an extension of the mandatory
compliance deadline for the lighting ordinance which was adopted five years
ago. He felt they had done a reasonably good job in getting the lights changed
out but not as good as they could have done.
Commissioner Luke asked what the penalty was for not installing the proper
light. George stated a letter of non-compliance would be sent out to those in
violation, and they would have 30 days to comply.

Bruce White stated there was another alternative which allows a neighbor to
file a citation against the neighbor in violation.
Barry Slaughter stated he was very disappointed that this may be delayed. He
felt the ordinance needed to be implemented.
Andy Andrews discussed his concerns about this issue.
There was further discussion regarding the lighting ordinance and how the
complaints regarding this issue would be handled.

99-022, amending Title 15, by title only.

signature of Resolution No. 99-071, establishing the intent to seek Federal
Funds for highway enhancement of Highway 97 in Terrebonne and pledge

local matching funds for the project; 2) approval of funding recommendations
for Level 7 Funding and Title V wrap-around system; 3) signature of
acceptance of Bargain & Sale Deed from La Pine Water Company; 4) signature
of acceptance of Warranty Deed reconveying real property in Redmond Town
Center from Fred Meyer Inc. to Deschutes County; 5) signature of amendment
No. 2 to License between Deschutes County and Purkeys; 6) signature of Order
No. 99-075, transferring cash among various funds within the 1999-2000
Deschutes County Budget; 7) signature of Orders No. 99-110 and 99-111,
authorizing the refund of taxes; 8) appointment of Ken Wilhelm to the Alcohol
and Drug Planning Committee; 9) appointment of Michael Hinton to the
Central Oregon Regional Housing Authority; 10) appointment of Mike Myers
and Charles Brown to the Upper Deschutes Watershed Council; 11) signature
of Liquor Licenses for Sunriver Lodge and Resort, Homestead Tavern, Crane
Prairie Resort, Aspen Lakes Golf Course, The Brand Restaurant, Tom's
Market, Sunriver Chowder House, Cafe Sintra, Marcello's, Crossroad Station,
Moose Lodge #2093 in La Pine, R. J. B.'s Restaurant & Sports Lounge,
Erickson's Sentry Market, Vic's Bar & Grill; and 12) approval of weekly
accounts payable vouchers subject to review in the amount of $439,656.45.
