An Order Declaring an Intent
and Authorizing the Sale of
Real Property by Private Sale
ORDER NO. 99-155
WHEREAS, Section 10, Chapter 791, Oregon Laws 1989, authorizes Deschutes County
to sell real property in a commercially reasonable manner when the real property is acquired
through judicial forfeiture; and
WHEREAS, Deschutes County acquired an ownership interest through Summary
Judgment of Forfeiture in certain real property described in Exhibit "A,"; and
WHEREAS, Deschutes County does not need the real property described in Exhibit "A,"
and has offered said property for sale in a commercially reasonable manner; and
WHEREAS, Santos Diaz has offered to purchase from Deschutes County the real property
described in Exhibit "A" for $74,700; and
WHEREAS, the offer of Santos Diaz is the best offer received by Deschutes County; now,
therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY,
OREGON, AUTHORIZES AND ORDERS as follows:
Section 1. That the real property described in Exhibit "A" be sold under Section 10,
Chapter 791, Oregon Laws 1989, to Santos Diaz for $74,700.
Section . That forfeiture counsel be directed to prepare documents and take those actions
reasonably calculated to close the sale of the real property described in Exhibit "A."
Section 3. That Captain Peter Wanless, aka Pete Wanless, Asset Forfeiture Officer of the
Deschutes County Sheriff's Office, is authorized and is directed to sign the necessary documents required
to close the sale of the real property described in Exhibit "A."

Section 4. That pursuant to Section 10, Chapter 791, Oregon Laws 1989, Asset Forfeiture
Officer shall deposit the proceeds to the Asset Forfeiture account of Deschutes County for public safety,
law enforcement related purposes or criminal justice services, less costs.
