1. DECISION ON APPEAL OF THE HEARINGS OFFICER'S DENIAL OF
FILE CU -98-120, AN APPLICATION FOR A NON-FARM DWELLING
FOR LEO EDWARDS
Before the Board was a decision on appeal of the Hearings Officer's denial of
file CU -98-120, an application for a non-farm dwelling for Leo Edwards.
Barbara Rich reported there had been only two commissioners present for the
original hearing and there had been a split vote.
Commissioner Swearingen reported she had listened to the tapes, did a site
visit and reviewed the record. She stated she had visited the property and
found that the record reflected what the property looked like. She found that
the property was not suitable for farming. She did not believe that by allowing
a non-farm dwelling that it would adversely effect the land use pattern in the
area.
SWEARINGEN: Based on the information I have and the site visit, I move
we overturn the Hearings Officer in the Leo Edward
decision.
