Swearingen called the Board of County Commissioners meeting to order at 10:00 A.M. County Commissioners present were Linda L. Swearingen and Tom DeWolf. Also present was Mike Maier, County Administrator; Bruce White, Assistant County Counsel; Gary Judd, Road Department; George Kolb, Engineering Manager; Tom Blust, Road Department Director; Steve Jorgensen, Planner; Ron Meckler, 9-1-1 Director; Roger Olson, Road Department; and George Read, Community Development Director. 1. CITIZENS INPUT - NONE 2. PUBLIC HEARING ON ORDINANCE NO. 99-016, AMENDING PL -20 DESCHUTES COUNTY YEAR 2000 COMPREHENSIVE PLAN TO ADD NEW TRANSPORTATION TEXT AND POLICIES, ORDINANCE NO 99- 017, AMENDING TITLE 18, DESCHUTES COUNTY ZONING ORDINANCE, AND ORDINANCE NO. 99-025, AMENDING THE DESCHUTES COUNTY TRANSPORTATION PLAN MAP, AS PART OF THE LOCAL STREET, BICYCLE AND PEDESTRIAN PLANFORLA PINE AND WICKIUP JUNCTION Before the Board was a public hearing on Ordinance No. 99-016, amending PL -20 Deschutes County Year 2000 Comprehensive Plan to add new transportation text and policies, Ordinance No. 99-017, amending Title 18, Deschutes County Zoning Ordinance, and Ordinance No. 99-025, amending the Deschutes County Transportation Plan Map, as part of the local street, Bicycle and Pedestrian Plan for La Pine and Wickiup Junction. Steve Jorgensen provided the most recent comments he had received on this project. He stated there were three ordinances for this project. He recommended the Board hold the public hearing and adoption of the ordinances would take place at a later date. The proposed ordinances would be adopted at a later date. 3. PUBLIC HEARING ON THE FINAL ASSESSMENT FOR THE MUTE LOCAL IMPROVEMENT DISTRICT AND SIGNATURE OF RESOLUTION NO. 99-075, DETERMINING AND CERTIFYING FINAL ASSESSMENT, SETTING TERMS FOR PAYMENT AND REQUIRING NOTICES FOR PROPERTY OWNERS IN THE LOCAL IMPROVEMENT DISTRICT Before the Board was a public hearing on the final assessment for the Piute Local Improvement District and signature of Resolution No. 99-075, determining and certifying final assessment, setting terms for payment, and requiring notices for property owners in the Local Improvement District. Gary Judd reported the final assessment would be $3,422.85 per lot. He stated he had no comments from the property owners on this issue. Chair Linda Swearingen opened the public hearing. There being no testimony, the public hearing was closed. Bruce White reported there were a couple of things he was working out with the County Clerk. The resolutions would be brought back for signature by the Board on September 22, 1999. 4. PUBLIC HEARING ON THE FINAL ASSESSMENT FOR THE HEREFORD LOCAL IMPROVEMENTDISTRICTAND SIGNATURE OF RESOLUTION NO. 99-076, DETERMINING AND CERTIFYING FINAL ASSESSMENT, SETTING TERMS FOR PAYMENT AND REQUIRING NOTICES FOR PROPERTY OWNERS IN THE LOCAL IMPROVEMENT DISTRICT Before the Board was a public hearing on the final assessment for the Hereford Local Improvement District and signature of Resolution No. 99-076, determining and certifying assessment, setting terms for repayment and requiring notices for property owners in the Local Improvement District. MINUTES Page 2 of 9 September 8, 1999 Chair Linda Swearingen opened the public hearing. Paul Smith testified in support of the Hereford Local Improvement District. He stated the road was raised much higher than his driveway, the County brought gravel out to fill this in but it hasn't really helped. He requested some financial assistance from the County to help solve the problem with his driveway. Gary Judd responded that 93rd Street was on the side of a hill. When the road was widened it effected some of the properties. Gary reported that Mr. Smith's property was on a corner. Commissioner DeWolf felt that this property was a special situation which made Mr. Smith's problem unique. Tom Blust stated that when it was a problem it should have been fixed during the project. Tom stated that if it was the Board's desire to participate in the cost they could pay it out of the Local Improvement District fund. Commissioner Swearingen felt we should participate in this expense. Commissioner Swearingen felt the County should pay at least $500 of the $700 he spent on the driveway. Commissioner DeWolf felt $700 should be refunded if that was the amount of the expense. Commissioner Swearingen agreed that was fair. Tom Blust stated they would take care of that. There being no further testimony, the public hearing was closed. 5. APPOINTMENT OF TIM CLASEN DAVID CULVER BOB WINDINX RICK LEEPER, BOB HAGARTY, KATIE GRENIER, KEITH CYRUS, PAUL STELL, MIKE CRUMRINE, ALAN AMES AS MEMBERS OF THE NOXIOUS WEED ADVISORY BOARD Before the Board was appointment of Tim Clasen, David Culver, Bob Windinx, Rick Leeper, Bob Hagarty, Katie Grenier, Keith Cyrus, Paul Stell, MINUTES Page 3 of 9 September 8, 1999 Mike Crumrine, and Alan Ames, as members of the Noxious Weed Advisory Board. Commissioner Tom DeWolf asked if there shouldn't be representation from the City of Bend and City of Sisters and all municipalities in Deschutes County. Patricia Gainsforth stated the City was interested in participating. Commissioner Swearingen felt that Sunriver should be included in this committee as well. She felt the Sunriver homeowners would be willing to provide money. Jeff Rola stated the Sunriver Homeowners had their own weed abatement program. He felt they would not be willing to spend money off of their property. Darwin Thurston from La Pine stated the Forest Service had an aggressive noxious weed program. DEWOLF: I would move appointment of the 10 folks that are listed to the Noxious Weed Advisory Board with terms added and five other positions to be appointed later. SWEARINGEN: Second. SIGNATURE OF ACCEPTANCE OF DECLARATION OF DEDICATION FOR RIGHT-OF-WAY DEDICATION TO ALLOW A TURN LANE INSTALLATION ON JOHNSON MARKET ROAD Before the Board was signature of acceptance of a Declaration of Dedication for right-of-way dedication to allow a turn lane installation on Johnson Market Road. MINUTES Page 4 of 9 September 8, 1999 George Kolb reported that Cascade Pumice was required to widen Johnson Market Road for the installation of a center turn lane, deceleration and acceleration lane as a result of a land use action. This additional right-of-way will allow enough room for these lanes to be added. SWEARINGEN: I would move signature of acceptance of declaration of dedication for right-of-way to allow a turn lane installation on Johnson Market Road. DEWOLF: I'll second that.
