ORDER NO. 99-160
WHEREAS, after holding a public hearing on September 28, 1999, the Board of County
Commissioners (Board) approved seven petitions requesting that certain properties within the
Deschutes County Special Road District No. l be withdrawn from the :District; and
WHEREAS, after notice provided in accordance with law, a final hearing regarding the
withdrawal of said territory from Special Road District No. 1 was held on November 1.0, 1999, to
determine whether sufficient written requests were filed to require that an election be held on the issue
of withdrawal; and
WHEREAS, the Board received _ written requests for an election before the close of the
hearing on November 1.0, 1.999, and after consultation with the County Clerk, the Board has determined
that the number of said requests are sufficient to refer the seven petitions for withdrawal to a vote by
the District electors; now,'therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON,
ORDERS as follows:
Section 1. That elections be held as to each of the seven petitions for District electors to vote
on whether the territory described in each of the petitions should be allowed to withdraw from the
District. The seven petitions and the territories proposed to be withdrawn are as follows:
• McKenny Petition (Petition 1) as to Deschutes River Recreation Homesites Unit 9, Part 2,
a plat recorded in the deed records of :Deschutes County in Plat Cabinet A, Page 119,
(referred to hereinafter as DRRH Unit 9, Part 2) Lots 48, 49, 50, 51 and 52, Block 41.
• Turney Petition (Petition 2) as to DRRH Unit 9, Part 2, Lot 40, Block 41.
• Schilstra Petition (Petition 3) as to DRRH Unit 9, Part 2 Lots 34 and 35, Block 41.
• Breitenstein Petition (Petition 4) as to DRRH Unit 9, Part 2, Lots 100 and 101, Block 53.
• Herrick Petition (Petition 5) as to DRRH Unit 9, Part 2, Lots 103, 104, 105, Block 53.
• GarnerNan Wagner Petition (Petition 6) as to DRRH Unit 9, Part 2, Lots 1,2,3,4,5,6 and 7,
Block 61.

Jaworski Petition (Petition 7) Deschutes River :Recreation Homesites Unit 9, :Part 1, a
subdivision plat recorded in the deed records of Deschutes County in Plat Cabinet A at Page
121, Lot 2, Block 53.
The boundaries of the territory described in each petitions are as set forth in Exhibits 1 — 7 , attached
hereto and by this reference incorporated herein. The vote on each of the seven petitions shall appear
on the ballot as a separate question. The County Clerk shall include with the ballot on each of the
withdrawal questions a map or other description of the boundaries of the territories proposed to be
withdrawn in accordance with ORS 198.815(3).
Section 2. That the Board shall cause a notice of measure election to be filed with the County
Clerk as to each of the subject withdrawal petitions in time for the next election at which the filing
deadlines can be met.
Section 3. That a notice of election on the withdrawal questions be published as provided in
ORS 255.085 and by an additional notice as provided in ORS 198.815.
