located in Hillman Subdivision (Terrebonne),
located in Deschutes County, Oregon.
ORDER NO. 2000 - 038
WHEREAS, the Board of County Commissioners, of Deschutes County, Ore on, initiated the
vacation of a portion of Central Avenue, located in Hillman Subdivision (Terrebonnej by Resolution
Number 2000-012 dated February 23, 2000; and
WHEREAS, the Board of County Commissioners requested the County Road Official to
prepare a report relating to the vacation; and
WHEREAS, the Board of County Commissioners accepted and approved the County Road
Official's report and as required by ORS 368.346 set a public hearing on April 5, 2000 at 10:00 a.m.
by Order Number 2000-027 dated February 23, 2000; and
WHEREAS, notice of hearing was given in accordance with ORS 368.346(3) and 368.401 to
368.426; and
WHEREAS, the Board of County Commissioners held said hearing to consider matters
presented under ORS 368.346; and
WHEREAS, the Board of County Commissioners finds that it is in the public interest to vacate
the public property; now, therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON,
ORDERS as follows:
Section 1. That the property, described in Exhibit "A", attached hereto and by this reference
incorporated herein, is hereby vacated.
Section .2. That the property, vacated in Section 1, shall vest in the owner of the land
abutting the vacated property pursuant to ORS 368.366 (1)(d).
Section 3. That a utility easement shall be reserved upon the vacated parcel for existing
utility facilities. This easement is described in said Exhibit "A"

Section 4. That the Deschutes County Surveyor is directed to mark the plat, if any, as
provided in ORS 271.230.
Section 5. That this Order shall be recorded with the Deschutes County Clerk, and copies
shall be filed with the Deschutes County Surveyor and County Assessor.

EXHIBIT "A"
Vacation of Two Portions of Central Avenue in Hillman (Terrebonne)
Two portions of Central Avenue lying in the NW% SW% of Section 16, Township 14 South,
Range 13 East, Willamette Meridian, as shown on the official plat of Hillman recorded and filed
in Cabinet A, Page 77 of the plat records in the office of the County Clerk, Deschutes County,
Oregon, being more particularly described as follows:
Parcel 1 -That portion of Central Avenue lying between the east right of way line of 2nd Street
and the west right of way line of 3`d Street as shown on said plat of Hillman.
SUBJECT TO the reservation of a utilities easement in and upon the northerly 20 feet of the
property; for the purposes of continuing, constructing, installing, maintaining, repairing,
reconstructing, replacing, enlarging and altering; wires, poles, pipes, lines, structures, casings
supports, equipment, facilities and appurtenances; at the present and in the future; necessary or
convenient; to Deschutes County, a political subdivision of the State of Oregon, its agents,
licensees and permittees; forever.
Parcel 2 -That portion of Central Avenue lying between the east right of way line of 3`d Street
and the west right of way line of 4th Street as shown on said plat of Hillman.
SUBJECT TO the reservation of the following three utility easements:
1. A utilities easement in and upon the northerly 20 feet of the property; for the purposes of
continuing, constructing, installing, maintaining, repairing, reconstructing, replacing,
enlarging and altering; wires, poles, pipes, lines, structures, casings supports, equipment,
facilities and appurtenances; at the present and in the future; necessary or convenient; to
Deschutes County, a political subdivision of the State of Oregon, its agents, licensees and
permittees; forever.
2. A 20 foot wide water line easement; for the purposes of continuing, constructing, installing,
maintaining, repairing, reconstructing, replacing, enlarging and altering; pipes, lines,
structures, casings supports, equipment, facilities and appurtenances; at the present and in
the future; necessary or convenient; to Deschutes County, a political subdivision of the State
of Oregon, its agents, licensees and permittees; forever. The center of said 20 foot wide
easement is described as follows: Commencing at the %" pipe monumenting the southwest
corner of Block 32; thence easterly along the north right of way line of Central Avenue 20
feet to the Point of Beginning; thence South 300 East 81 feet more or less to the south right
of way line of Central Avenue.
3. A 10 foot wide overhead utility easement; for the purposes of continuing, constructing,
installing, maintaining, repairing, reconstructing, replacing, enlarging and altering; wires,
lines, structures, casings supports, equipment, facilities and appurtenances; at the present
and in the future; necessary or convenient; to Deschutes County, a political subdivision of
the State of Oregon, its agents, licensees and permittees; forever. The center of said 20 foot
wide easement is described as follows: Commencing at the W pipe monumenting the
southwest corner of Block 32; thence easterly along the north right of way line of Central
Avenue 80 feet to the Point of Beginning; thence South 700 East 128 feet more or less to
the west right of way line of 4th Street.
