Luke and Tom DeWolf: Also in attendance were Rick Isham and Bruce White, Legal Counsel; Michael Maier, County Administrator; Ron Meckler, 9- l -1 County Service District; Kelley Jacobs, Juvenile Community Justice; Ethel Stratton, Commission on Children and Families; and Jim Bonmrens, Property Management. Others present were Dan Peddycord, Health Department; Steve Miller and Kevin Harrison, Community Development Department; Roger Graham, Tom Blust and George Kolb, Road Department; and Jim Court, La Pine Rural Fire Protection District. PUBLIC HEARING on the Annexation of Territory (Crown Pacific Annexation) into the La Pine Rural Fire Protection District; and APPROVAL AND SIGNATURE of Order No. 2000-044, Approving the Annexation of Territory into the La Pine Rural Fire Protection District. MINUTES OF BOARD MEETING Page 1 of 9 Pages Wednesday, March 29, 2000 Qualitit Services Perfor»>ed 714111 Pride Bruce White stated that Ted Young, who unfortunately passed away ten days ago, had initiated this annexation. The concern was the consolidation of Crow Pacific land so that it wouldn't be split into too many taxing districts. They proposed an annexation in various sections west of La Pine to make their boundaries consistent with another taxing district. It primarily concerns annexations of pieces of property that lie to the west of an existing logging road. (He referred to a map at this time.) He further explained that there are only two property owners involved - Crown Pacific and a private property owner; and both of them have consented to the annexation. Both private landowners believe they will benefit from this consolidation. The annexation must be finalized this week as boundary changes such as this need to be done by the end of March and submitted to the Department of Revenue, so changes can be reflected in next year's tax roll. Commissioner Luke then opened the public hearing. Jim Court, Fire Chief of the La Pine Fire District, then spoke. He indicated the support of this consolidation by the Board of Directors for the Fire District. Being no further testimony offered, Commissioner Luke closed the public hearing. DEWOLF: Move approval. READING OF A PROCLAMATION, Declaring the Week of April 3 through 9 to be Public Health Week Dan Peddycord, Director of the Health Department, explained that next week is National Public Health Week, and he feels Deschutes County should issue a similar Proclamation. ANNOUNCEMENT of Deschutes County's Receipt of the 1999 Asphalt Pavement Association of Oregon's First Place Quality Award for the Overlay Project on Alfalfa Market Road George Kolb explained the criteria and how the award is given. He further stated that this is the first time Deschutes County has received this award, which was presented jointly for the work done by Roy 1-louck Co. and Deschutes County. 5. APPROVAL of Awarding a Bid for a Replacement 6x4 Truck Tractor to the Qualified Low Bidder, Northside Truck & Equipment of Portland, Oregon Roger Graham of the Road Department advised that this is a replacement tractor for the one that had been totaled. CONSIDERATION, APPROVAL and SIGNATURE of Order No. 2000-053, Surrendering Certain County Roads Over to the City of Bend Bruce White indicated that this Agenda Item needs to be postponed until a later date. CONSIDERATION, APPROVAL and SIGNATURE of a Juvenile Crime Prevention Strategy Intergovernmental Agreement between the State of Oregon, the Oregon Youth Authority, the Criminal Justice Commission, and Deschutes County Kelley Jacobs, Juvenile Community Justice, and Ethel Stratton, Commission on Children and Families, explained that changes were made to the contract. Rick Isham, County Counsel, advised that he needed to make sure that the requested changes have been incorporated in the final agreement. He stated that some items could not be negotiated, such as how default is declared, but that the contract is very workable. DEWOLF: Move approval, subject to Legal and Board review. LUKE: Second. CONSIDERATION, APPROVAL and SIGNATURE of a Grant Agreement between Deschutes County and the Northwest Area Foundation - "Heart of Central Oregon Corps" Kelley Jacobs indicated this is a grant agreement for $61,500, covering April 1, 2000 through March 31, 2001 to coordinate with the Northwest Area Foundation's fiscal year. Commissioner DeWolf asked if this agreement has any impact on the general fund. Ms. Jacobs replied that the dollars are coming from other sources except for a $4,000 amount contributed by her Department, as an in-kind match. She further stated that this is a regional partnership between Crook County, Jefferson County, Deschutes County and the Warm Springs Reservation. She further explained that this is a pilot project involving the construction of bunk beds that are given to families in need. Ms. Jacobs went on to say that this project addresses both poverty and environmental issues. The pilot program utilizes the help of incarcerated youth, but will eventually involve other at -risk young people. CONSIDERATION OF A REQUEST TO HEAR AN APPEAL OF HEARINGS OFFICER'S DECISION on File #Cu-99-117/MA-99-8, Which Approved a "Personal Use" Landing Strip on Private Property Kevin Harrison and Steve Miller of Community Development explained that the 150 -day timeline might have been inaccurately computed; today is day 105, with 45 days remaining. Bruce White, County Counsel, added that there might be an additional 30 days, not including the extension. So you may be looking at 75 days instead. Commissioner Luke asked if the applicants agree with the timeline. Kevin Harrison answered that. this is determined by the calendar. Commissioner Luke asked for clarification on this matter, as at best there would be a split vote on this; so there won't be a decision on this matter today. He requested that this be brought before the Board again next week. Commissioner DeWolf asked that all parties be contacted immediately so there are no misunderstandings about their options. 10. CONSIDERATION, APPROVAL and SIGNATURE of a Deed of Dedication for a Right -of -Way Located on Smith Rock Way for a Road Improvement Project Jim Bonnarens, Property Manager, explained that this involves two dedications; one from the McIntosh family to Deschutes County, and one from Deschutes County dedicating real property as a public right-of-way. CONSIDERATION, APPROVAL and SIGNATURE of a Contract Between the 9-1-1 County Service District and Communications Technology Systems Integrators (CTSI) to Provide and Install a 9-1-1 Voice Logging Recorder Rick Isham, Legal Counsel, indicated that when he reviewed this item, he noticed that the notice of intent to award the contract had not gone out yet. He stated that the action today is to indicate the Board's intent to award the contract, as there is a 14 -day period during which a protest can be made. He explained that this was not an advertised procurement; that it was sent to eight vendors that were known to the District to be in the business of providing this equipment, which is an allowable way of soliciting equipment. There are mandatory and optional specifications. Three of the eight met the specifications, and the selection was based on the one that provided one of the optional features that was requested. Therefore, it is not a "low bid" procurement, and when you make a selection on that basis you must give an intent to award letter to the other vendors in the event they want to file a protest based on the selection. CONSIDERATION, APPROVAL and SIGNATURE of a Bid for the Sale of Timber in the La Pine Industrial Park Commissioner DeWolf said that the County received the highest bid from Crown Pacific, along with the required earnest money. Gary Cramer of Crown Pacific explained that the timber is all lodgepole pine, and it will be cleared to make the land available for building. Commissioner Luke then responded that the funds would go toward La Pine Industrial Park. DEWOLF: So move. LUKE: Second. Luke Policy Statement Regarding Transportation Funding Measure 82 (Gas Tax Increase) Deschutes County is responsible for maintaining and improving over 800 miles of roads, including 68 bridges. Deschutes County is the fastest growing County in the State; since 1995, Deschutes County's population has increased by 21 %. During this same time period, the vehicle miles traveled on County Roads has increased at an even faster rate than the population. Deschutes County's road fund revenue has remained virtually constant since 1995. Adjusted for inflation, road fund dollars today are 14% below the- 1995 level. Since 1997, the County Road Department has reduced the number of permanent employees by 21 % in an effort to make the best use of dwindling resources. Current road fund resources are only adequate enough to provide basic maintenance of the County Road system. In 1998 the Board of County Commissioners adopted the Transportation System Plan (TSP) as a part of Deschutes County's Comprehensive Plan Resource Element. The TSP identifies $56 million of priority projects needed over the next 20 years to preserve the existing road system and to meet projected growth in Deschutes County. This identified road funding need represents a $2.8 million per year funding shortfall. The 1999 Oregon Legislative Assembly, in recognition of these critical needs on Oregon roads, passed a Transportation Funding Package, House Bill 2082, to help reduce Oregon's road fund shortfall. House Bill 2082 has been referred to the voters at the May 2000 Primary election and will be Measure 82 on the ballot. Passage of Measure 82 would provide an average increase in road funding of $1.2 million per year for Deschutes County over the next six years. Quality Services Performed with Pride If voters in the May 2000 election approve Measure 82, the Deschutes County Board of Commissioners will adopt the following policy regarding expenditure of the revenue increase: • New funds will be allocated first to maintain the integrity of the County's existing road system, and, second to fund safety related upgrades and preservation projects identified in the County's adopted TSP. • Passage of Measure 82 will provide for earlier completion of priority projects listed in the TSP. • The majority of TSP projects, done with funds generated by Measure 82, will be contracted out to the private sector. • Road Department staff levels will not be increased. The Board. of.County Commissioners supports passage of Measure 82 in the May 2000 primary election as an important step in helping to meet Deschutes County's transportation needs. The transportation improvements identified in the County's Transportation System Plan are vital to public safety and to the economic well being and quality of life we enjoy in Central Oregon. RESOLUTION NO. 2000-024 WHEREAS, the development of family wage jobs in Central Oregon requires that educational opportunities be available for new and existing employees; and WHEREAS, there is a proven and unfulfilled need in Central Oregon for increased upper division higher educational opportunities; and WHEREAS, increased upper division higher education opportunities have a positive economic impact on Central Oregon; now, therefore, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, as follows: Section 1. That the Board of County Commissioners of Deschutes County, Oregon supports the establishment and enhancement of upper division higher education opportunities in Central Oregon. Section 2.
