MONDAY, APRIL 3, 2000
Chair Linda Swearingen opened the .:meeting at 10:05 a.m. Commissioners present
were Linda L. Swearingen, Tom DeWolf and Dennis R. Luke. Also present were
Kevin Harrison and Steve Miller, Community Development; and Dick Johnson and'
Tom Blust, Road Department; Dave Anderson, Commissioners' Office; Jim
Bonnarens, Property Management.; C. J. Anderson, Human Services; Rick Isham,.
Mark Amberg and Bruce White, Legal Counsel; and several citizens.
DISCUSSIOIoI AND DECISION Regarding Whether to Hear an Appeal of
Hearings' Officer's Decision on :File #CU-99-117iMA-99-8 (Personal Use of
Landing Strip on Private Property) - Steve Miller and Kevin Harrison,
Community Development
Before the Board was consideration of and a decision on whether to hear an appeal
of a Hearings Officer's decision on a rile involving the personal use of a landing
strip. Steve Miller explained that the persons requesting the hearing are residents
of an adjoining property,
DEWOLF:
When was the last time the landing strip was used?
MILLER.:
It was activated in 1976, and last used in 1993. Staff denied its reactivation, but
the Hearings Officer approved it.

Quality Services Performed with Pride
LUKE:
It's my understanding that this landing strip is not paved; that it is a dirt and grass
strip. If it had been active in 1994, it would have been grandfathered in. A
personal airstrip is generally defined as being available to the owners of the
property and invited guest. For the record, I've known the owner of the property
since 1974, but my decision on this matter is not affected by this fact.
SWEARINGEN:
I am not interested in hearing this appeal.
DEWOLF:
The neighbor has approached me, and I would be interested in hearing it.
LUKE:
I don't want to hear this. They can appeal to LUBA if they'd like to pursue it
further.
MILLER:
We will be refunding seventy-five percent of the fee we charged.
SWEARINGEN:
Why not 100%?
HARRISON:
There was staff work and other expenses involved.
LUKE:
If you're going to appeal, you should be vested. Otherwise, anyone could appeal
for any reason and expect a full refund. You don't want to set precedence.
DEWOLF:
I make a motion to hear this appeal.
No second was voiced.
SWEARINGEN: I move to not hear this appeal.
LUKE: I second.
