Swearingen, Dennis R. Luke and Tom DeWolf. Also in attendance were Bruce White, Legal Counsel; George Read, Dave Leslie, Kevin Harrison and Paul Blikstad, Community Development Department; and Michael Maier, County Administrator. Also present were Jim Bonnarens, Property Management; Adriel McIntosh and 'Ted Schassberger, Commissioners' Office; Dana Bratton, Appraiser; Bob Lovelien, Attorney; Jim Smith and Jason Faherty, representing the Redmond Skate Park; Jason Carr, a reporter from Z-21 TV; and several citizens. -- Beginning of Excerpt -- Before the Board was a Discussion Regarding Resolution No. 2000-021, Indicating Deschutes County's Intent to Purchase Bureau of Land Management Property in South Deschutes County for Regional Problem Solving Purposes. Dave Leslie of Community Development discussed a draft report, giving an overview of the Resolution. He explained that the Oregon Public Land and Protection Act of 1998 provides that the Secretary of the Interior can sell to the County land commonly known as Tract 38, at fair market value. EXCERPT FROM MINUTES of Board of Commissioners' Work Session Meeting Monday, April 10, 2000 Quality Services Performed with Pride Pagel of 4 A general discussion ensued, including mention of private property owned by the Baldwin -Herndon Oregon Trust. It was noted that this property would become surrounded on three sides by the property to be purchased, with Huntington Road on the west side. Dave Leslie stated that their plans are to partner with the County and develop the new neighborhood; that he has met with Bob Lovlien, who represents B. K. Herndon, and a memorandum of understanding is being developed. He further explained that it's not the County's intent to acquire that property; the intent is to work together on developing the new neighborhood. The Commissioners, Dave Leslie and George Read then discussed the possible and best uses of the various portions of the properties by the County, other agencies and residential, emphasizing consistency and compatibility with the area and the needs of the community. Commissioner Luke stated that if La Pine incorporates this year, zoning could change. Dave Leslie agreed, but explained that the City may decide to contract with the County to do the work. He further explained that higher density residential development might be a problem for some people, although there seems to be majority support. Commissioner DeWolf said that the County would continue to work with the community, whether it is incorporated or not. He further stated that if St. Charles Hospital and Central Oregon District Hospital merge, a clinic in La Pine might become more feasible, especially if the County is able to provide the necessary land. George Read, Director of Community Development, said that there are two issues to be considered. One issue is that the County has a responsibility to get rid of transfer development rights in the neighborhood. The Senior Center does not use transfer development rights. However, the County is buying the Herndon land at market rate because it intends to use it for profit to solve the problem. He further explained that there is other land across the street that may be better, and could possibly be obtained under the Public Purposes Act, too. EXCERPT FROM MINUTES of Board of Commissioners' Work Session Meeting Page 2 of 4 Monday, April 10, 2000 Dave Leslie said that there is a two-day workshop in La Pine, sponsored by the Northwest Area Foundation and organized by the Rocky Mountain Institute out of Snowmass, Colorado. They have been in touch with Community Development and are pulling resource materials together. The Bureau of Land Management has received from the community a list of amenities that the community would like the BLM to consider. One of the things staff envisions after the Resolution is adopted is participating in the workshop and letting the BLM know that there will be future inquiries. Dana Bratton, Appraiser, explained he did Letters of Counsel regarding the value of the property, which are in effect limited appraisals; Christine Hartley was hired by the BLM to do full appraisals, and she set a value of $648,000, which seems reasonable. He further stated that the County is in a position where it can add a lot of value through value-added engineering, zone changes, and land use planning. He said that the purchase of the land makes sense, but he questioned whether it would make sense for the County to act as a developer beyond that point. He further stated that there is a need for housing in La Pine. He said that studies of supply and demand factors in the area indicate that there have been no new subdivisions developed for about twenty years, there is very little for sale and not much turnover, and the studies show there will be a limited amount of housing available in the future. He explained that W.H. Pacific's quoted costs seem high to him, since there is no rock to deal with and the land is fairly level. It said that the biggest issues are the development of a sewer system and a domestic water system, which require large up -front costs. Commissioner Luke stated that many of the larger developers have indicated they are not very interested; and that this project may be of more interest to smaller developers, who might be able to keep the cost down. Dave Leslie said that signature of this Resolution would enable the BLM to complete its amendment process of the Brothers -La Pine Resource Management Plan, and give formal notice through a record of decision. At that time, around June 1, the clock starts. He further stated that would give the County to roughly December 1 to make the final purchase of the patent. He also said that this Resolution represents intent, and is not binding if funding issues or other problems arise.
