Luke DESCHUTES COUNTY BOARD OF COMMISSIONERS' MEETING WEDNESDAY, MAY 39 2000 AT REDMOND HIGH SCHOOL Commissioners present were Linda L. Swearingen, Dennis R. Luke and 'Tom DeWolf Also in attendance were Rick Isham and Bruce White, Legal Counsel; George Read and Steve Jorgensen, Community Development Department;. Timm Schimkes Solid Waste Department; Dan Peddycord, Health Department; Susie Penhollow;- County Clerk; and Michael Maier, County Administrators. , Also present were Kelley Jacobs and Jim Smith, Juvenile Community Justice; Ads- eI McIntosh, Commissioners' Office; Jim Bonnarens, Property Management;. Mike Viegas, Risk Management; Ron Meckler, 9-1-1 County Service District; Tom:: Blust and George Kolb, Road Department; Greg Brown, Sheriff; Jason Carr, a reporter from Z-21 TV; and approximately fifty students and other citizens. Prior to convening the Board Meeting, introductions of various County personnel were given, and a. "question and answer" session took place between students and County personnel. Questions were asked and answered regarding the following topics: ■ Road widening in the Redmond area ■ Road maintenance in the County ■ How much tax money goes to which department or project BOARD OF COMMISSIONERS' MEETING Page 1 of 10 Wednesday, May 3, 2000 Redmond High School Quality Services Performed with Pride ■ The tax rate in Redmond ■ The Home Rule Charter ■ Political party affiliations ■ Search and rescue ■ Sisters School District tax problem ■ School district boundaries ■ Process of developing property ■ Traffic issues ■ Crime victims' measures ■ Police actions ■ Waste and recycling programs ■ Shelters for homeless people ■ Increase in population, crime, overall growth . ■ Humane Society funding ■ The parking situation at the Fairgrounds, and the funding and operation of the Fairgrounds facility Chair Linda Swearingen opened the Board meeting at 10:00 a.m. 1. CITIZEN INPUT There was none. 2. PUBLIC HEARING on Ordinances No. 2000-006 and 2000-007, Amending Deschutes County Code Title 17 and Title 12, Transferring the Process of Applying for a Driveway Access Permit from the Road Department to the Community Development Department. Steve Jorgensen of Community Development explained the Ordinances, and stated that the switch of this process from the Road Department to Community Development would simplify the process for the public. BOARD OF COMMISSIONERS' MEETING Page 2 of 10 Wednesday, May 3, 2000 Redmond High School Chair Swearingen opened the public hearing. Bruce White, Legal Counsel, explained his concerns regarding the possibility existing lots would have to get access permits. He would like to see the Board put this issue on hold until he has had a chance for further legal review. Chair Swearingen then closed the public hearing, and will reopen it after further legal review has occurred. 3. PRESENTATION and a Request for Board of County Commissioners Support of a Multi -Use Canal trail to Connect Bend with Redmond, Extending to Smith Rock State Park, as It Pertains to the Deschutes County Transportation Systems Plan. Dick Johnson of the Road Department, and Shirley Evans, Deschutes County Bicycle/Pedestrian Advisory Committee, presented maps and plans for a trail system connection as suggested by Bob Quitmeier of the City of Redmond. This trail system would utilize existing canal trails. Chair Swearingen asked how this could be done if its sole purpose is for canal access. Shirley Evans stated they are trying to use areas on public lands and those personal individuals who are willing to 'work with them. Dick Johnson explained that where it is not public land, the trail would connect with roads. There would be no motorized vehicles, just pedestrians, bicycles and perhaps horses. (General discussion ensued, using oversized maps.) Shirley Evans said that the North Unit Canal prefers non -motorized access; however, it is hard for them to control at this time as there are too many access points. She said they would like to close access points. Chair Swearingen stated that the BLM does not like to close off their properties to the public. Ms. Evans responded that they are working with the Bureau of Reclamation as well, and hope to come to some type of agreement. Dick Johnson explained that there will be a very high demand for this type of trail in the future, and they want to educate the Board and the public on their proposed plans as the project develops. BOARD OF COMMISSIONERS' MEETING Page 3 of 10 Wednesday, May 3, 2000 Redmond High School Commissioner DeWolf asked where the funding comes from. Mr. Johnson answered that they get I% of bicycle money, which is primarily used for literature; most of the funding and work is from volunteer or in-house. Commissioner DeWolf stressed that input is needed from all who might be impacted and involved in this. Mr. Johnson said that everyone would have an opportunity to get involved. Chair Swearingen stated that hearings would be necessary from the beginning. She said this is particularly sensitive since those citizens who want to drive along with canals must be taken into consideration. Mr. Johnson said that they are here today to give an overview and information, and are early in the process. 4. CONSIDERATION OF SIGNATURE of a Contract with Central Oregon Community College to Provide Public Health Nursery Services in the Ready -Set -Go Program Dan Peddycord, Health Department, gave an overview of public health services. He further explained the nature of this contract, which has to do with visits to first- time mothers' homes, especially those who have had some criminal background. LUKE: I move approval. CONSIDERATION OF SIGNATURE of an Operating Agreement between Deschutes Children's Foundation and the Deschutes County Health Department for the Use of the Becky Johnson Community Center Dan Peddycord explained that this facility would be housing County Health and Mental Health services for families, and other public and private agencies. CONSIDERATION OF SIGNATURE of the Fiscal Year 2000-2001 Annual Public Health Plan and Oregon Health Division Grant Application Dan Peddycord explained that the Public Health Plan tells the State and Federal governments what the County is doing, as the County must abide by State and Federal laws. CONSIDERATION OF SIGNATURE of Ordinance No. 2000-008 and Ordinance No. 2000-010, Amending Maps that Designate and Zone Certain Lands in Deschutes County for the Siting of Destination Resorts This item was pulled from the Agenda, as a Public Hearing must first be held (scheduled for May 31). 8. CONSIDERATION OF SIGNATURE of a Document Revising Motor Vehicle Policy Limits, per ORS Financial Responsibility Requirements Mike Viegas explained that the County is self-insured, and he acts somewhat as the County's insurance agent. He said this document would conform to State regulations, as the County has opted not to cover PIP (personal injury protection), establishing minimum limits to eliminate a potential open checkbook. SIGNATURE of a Bargain and Sale Deed, Authorizing the Sale of Real Property (Several Lots Located in Oregon Water Wonderland, Unit 2) to Bruce Bjornstad, Jeff Harper and Thomas Burton Jim Bonnarens explained that these properties now belong to the County after years of non-payment of taxes by the previous owners. After a County foreclosure auction, the County has received offers individuals wishing to purchase these lots. The interested buyers already own adjacent properties. These particular properties are restricted from being developed until a public sewer system is in place. Commissioner Luke stated that he is concerned about the downed trees and fire hazard on the lots, and feels the buyers should be required to clean them up as a part of the sale process. Jim Bonnarens responded that the buyers intend to clean them up themselves, since they are adjacent property owners. Chair Swearingen stated that the Homeowners' Association could also require cleanup. DEWOLF: I move approval. SWEARINGEN: Second. VOTE: LUKE: I vote no. DEWOLF: Yes. SWEARINGEN: Chair votes aye. 10. CONSIDERATION OF ACCEPTANCE of a City of Redmond Offer to Purchase the 4-H/Extension County Service District Building Jim Bonnarens and Tom Wykes explained that the offer from the City of Redmond was at full price at the $310,000 appraised value. The City of Redmond has indicated they will sell the property to a private party. Part of the property will be used as access for a road extension. It was explained that the 4-H/Extension people can stay in the property for six months, and the City of Redmond will try to help them get into a new facility, which they hope will be within the Fairgrounds property. Chair Swearingen said that this presents a dilemma, as there is a $300,000 shortfall of funds to put the 4-H/Extension group into the Fairgrounds. There is no money set aside for a new location for them. She indicated she is not ready to vote on this. (A general discussion ensued, and this item was tabled.)
