The higher rate for the unincorporated area of Deschutes County without police departments reflect the additional costs of providing Sheriff patrols and investigative services to those areas, as more fully set out in Exhibit "A," and WHEREAS, the Board finds that there is a need for a law enforcement district in Deschutes County, Oregon, and that it is in the public interest to initiate the formation of the law enforcement district; and WHEREAS, the Cities of Bend, Redmond and Sisters, by proper resolution, certified copies of which are marked Exhibits `B," "C" and `D," attached hereto and by this reference incorporated herein, approved the order initiating the formation of the Deschutes County Law Enforcement District pursuant to ORS 198.835(3); now, therefore, THE BOARD OF COUNTY CONMUSSIONERS OF DESCHUTES COUNTY, OREGON, ORDERS as follows: Section 1. The Board of County Commissioners of Deschutes County, Oregon, hereby declares its intention to form the Deschutes County Law Enforcement District pursuant to ORS 451.010. Section 2. The law enforcement district shall be named the Deschutes County Law Enforcement District. Section 3. The boundary of the Deschutes County Law Enforcement District is the boundary of Deschutes County as set forth in ORS 201.090 and depicted on the map of Deschutes County respectively marked Exhibits "E" and "F," attached hereto and by this reference incorporated herein. Section 4. The proposed Deschutes County Law Enforcement District, if formed, will have a permanent split rate limit for opera* taxes of $0.78 urban and $1.12 rural per $1,000 assessed value which will raise an estimated $7,750,000 in operating funds for the District in the 2001-02 fiscal year. The rural rate area is the unincorporated areas of Deschutes County excepting the Black Butte Service District and Sunriver area described in DCC 4.32.015 and .030. The urban rate area includes the incorporated areas of Bend, Redmond, Sisters and the Black Butte Service District, described as the area encompassed by Black Butte Ranch Service District, a municipal corporation formed under the laws of the state of Oregon and Sunriver, PAGE 1- ORDER NO. 2000-060 described as that portion of unincorporated Deschutes County, Oregon identified in the Deschutes County Comprehensive Land Use Plan as Sunriver Urban Unincorporated Community and zoned Sunnver Urban Unincorporated Community lying northerly and westerly of South Century Drive. For the purposes of the Deschutes County Law Enforcement District, Sunnver does not include that portion of the Sunriver UUC designated Business Park District, commonly known as the Sunriver Business Park as of the formation of the Deschutes County Law Enforcement District. Section 5. That a hearing on the order of the Board of County Commissioners initiating the formulation shall be at 10 a.m. on July 5, 2000, in Commissioner's Hearing Room, Administration Building, 1130 NW Harriman, Bend, Oregon. Section 6. Notice of Hearing shall be given in substantially the form set forth in Exhibit "G", attached hereto and by this reference incorporated herein. The recording secretary shall cause the notice to be published in ?Zee Bulletin on June 21 and 28, 2000, and posted on June 21, 2000, in three public locations within the county as follows: one notice shall be posted on or near the doors of the meeting room of the Board of County Commissioners; one notice upon any official bulletin board customarily used for the purpose of posting public notices within the county; and one notice shall be posted upon any official public bulletin board customarily used for the purpose of posting public notices within the proposed district. Notices posted shall be for not less than five (5) consecutive days. Section 7. The Director of the Deschutes County Community Development Department shall cause to be filed with this Board prior to July 5, 2000, a land use compatibility statement regarding this proposed special district formation as contemplated in ORS 197.175 and 199.462, and any other applicable statutory authority. ,14 DATED this day of 2000. Deschutes County sheriff patrol services are not provided within incorporated cities, Black Butte Ranch Service District and Sunriver because these areas are patrolled by local agency patrols utilizing non -county sworn police officers paid by the local agency. The level and types of services provided outside these areas is significantly different because the remainder of Deschutes County is served with peace officer patrol services provided by the Deschutes County sheriff. The overall cost of providing sheriff services within incorporated cities, Black Butte Ranch Service District and Sunriver is substantially less than the cost of providing services in the remainder of unincorporated Deschutes County, Oregon. The areas where there is a difference are easily identified because the areas receiving patrol services from non -county peace officers are within the limits of Bend, Redmond and Sisters, the boundary of the Black Butte Ranch Service District and Sunriver as defined in Chapter 4.32, Deschutes County Code. Only in the remainder of the county are sheriff patrols routinely provided. If sheriff patrol officers respond within incorporated cities, Black Butte Ranch Service District or Sunriver, the response is in accordance to a request for service, and in the role as back up, as mutual aid, or when specialized expertise is required. The sheriff patrol response within incorporate cities, Black Butte Ranch Service District and Sunriver is similar to the mutual response arrangements for fire and ambulance services from separate districts. The difference in cost of providing services within the incorporated cities, Black Butte Ranch Service District and Sunriver and the remaining areas of the county is the cost of uniformed patrols for the unincorporated areas. Seventy-eight cents per $1,000 assessed value of the split - rate levy is used for countywide mandated sheriff services that include operation of the adult jails, search and rescue, emergency services, court security and civil operations. An additional thirty-four cents per $1,000 assessed value is paid by the unincorporated areas, excluding Black Butte Ranch Service District and Sunriver who fund their own law enforcement patrols. The Board of County Commissioners, of Deschutes County, Oregon, has entered an order declaring its intention to initiate this formation. The boundaries of the proposed district are the boundaries of Deschutes County as described in ORS 201.090. The proposed Deschutes County Law Enforcement District will include all of the territory within Deschutes County including the incorporated areas of the Cities of Bend, Redmond, Sisters, Sunriver and Black Butte Service District. The proposed district shall be referred to as the "Deschutes County Law Enforcement District." The proposed district has a proposed permanent split rate tax limit for operating taxes of $0.78 urban, 1.12 rural per thousand dollars assessed value which will raise an estimated $7,750,000 in operating funds for the district in the 2001-02 fiscal year. The purpose of the proposed formation is to provide law enforcement services for the population inhabitants within Deschutes County in accordance with ORS.
