An Ordinance Amending PL -20, the Deschutes
County Comprehensive Plan Map, to Amend the
Area Designating Certain Lands for Destination
Resort Siting, and Declaring an Emergency.
ORDINANCE NO. 2000-008
WHEREAS, Deschutes County has proceeded to implement LCDC Statewide Planning
Goal 8 regarding destination resort siting; and
WHEREAS, under Ordinances 92-002 and 92-003, the Board of County Commissioners
adopted a series of comprehensive plan maps and zoning maps designating and zoning locations
in Deschutes County where destination resorts might be sited, including a county -wide map and a
series of eight large-scale maps showing areas certain areas in more detail; and
WHEREAS, Ordinances 93-030 and 93-031 removed all lands within three miles of the
County border from destination resort designation and zoning, as depicted on a countywide map
labeled "Deschutes County Destination Resort Map Amendment — 3 -mile Border Area Map,"
along with a series of eight maps showing the same 3 -mile border area to be excluded in greater
detail; and
WHEREAS, W&H Pacific, the consulting firm who prepared the destination resort maps
adopted by Ordinances 93-030 and 93-031, has brought to the County's attention that a technical
error occurred in two locations on these maps where offsets in the perimeter of the County
boundary occur; now, therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY,
OREGON, ORDAINS as follows:
Section 1. AMENDMENT OF DESTINATION RESORT MAP. The maps entitled
"Deschutes County Comprehensive Plan Destination Resort Map and Destination Resort
Combining Zone Map," as amended, including the county -wide map, the large scale map
showing the Redmond Area in greater detail and the large scale map showing the Northeast Bend
Area in greater detail, all adopted by Ordinance 92-002 as a component of PL -20, the Deschutes
County Comprehensive Plan, are further amended to add the two areas shown in Exhibit "A,"

attached hereto and incorporated herein by this reference, as lands designated on the plan map for
destination resort siting.
Section 2. FINDINGS. The Board of County Commissioners adopts as its findings
in support of the amendment set forth in Section 1 of this Ordinance the findings set forth in
Ordinance 92-002 and Ordinance 93-030, incorporated herein by this reference, and the letter
dated April 18, 2000 from W&H Pacific, attached as Exhibit `B" and incorporated herein by this
reference.
Section 3. EMERGENCY. This Ordinance being necessary for the immediate
preservation of the public peace, health and safety, an emergency is declared to exist, and this
Ordinance takes effect on its passage.

My staff and I have reviewed the original destination resort combining zone maps for Deschutes County. Our review
was completed after two mapping errors were brought to our attention.
One error occurred in Section 16, Township 16 South, Range 13 East. The property is located easterly of Highway 97
between Bend and Redmond. A second error occurred in Sections 22 and 23, Township 14 South, Range 12 East.
Sections 22 and 23 are westerly of Terrebonne.
W&H Pacific completed destination resort overlay mapping throughout Deschutes County, under very complex criteria.
Our criteria and even our mapping received significant scrutiny. However, at the very end of the process a 3 -mile wide
buffer was created around the perimeter of Deschutes County. The 3 -mile buffer or offset was created with the use of a
standard drafting software program. Due to an odd configuration in the northerly and easterly boundaries of the County,
mapping errors occurred.
The attached exhibit maps demonstrate an offset in the section line boundaries between Township 15 South and
Township 16 South on the east boundary of the County, and between Ranges 12 and 13 east on the north boundary.
Although some offset at Township and Range boundaries is common, the degree of the offset in these two locations is
extensive.
Our drafting software program was intended to create a uniform 3 -mile offset around the perimeter of the County, based
upon a polyline offset from the exterior County boundary. The attached map demonstrates the intent of the 3 -mile
offset, but it also demonstrates the boundary reflected on the destination resort combining zone maps. The polyline
command in the drafting software created an odd or unintended offset at the two Township and Range boundaries.
Our assessment of the Section 16 and the Section 22/23 mapping problems is consistent with that completed by your GIS
staff.
In summary, a clerical error did occur due to an inadvertent mistake in the software, or the application of the drafting
software. This error occurred when W&H Pacific completed the original destination resort mapping.
We should strive to correct the errors as quickly and efficiently as possible. Your review and assistance will be
appreciated.
