Chair Linda Swearingen opened the meeting at 10:03 a.m. Commissioners present
were Linda Swearingen, Dennis Luke and Tom DeWolf. Present were Damian
Syrnyk and Geralyn Haas, Community Development; Ethel Stratton, Commission
on Children & Families; Dan Peddycord, Health Department; Sheriff Greg Brown
and Kelly Jacobs, Sheriffs Office. Also present were Mike Maier, County
Administrator, representatives of the media, and several citizens.
1. Citizen Input.
There was none offered.
2. Before the Board was the Reading of a Proclamation Declaring the Week
of July 23 through July 29 as Parole and Probation Week.
Sheriff Greg Brown gave an overview of the Proclamation, which follows the
lead of Governor Kitzhaber. Sheriff Brown explained that the parole and
probation staff does an exceptional job, and that Deschutes County is one of the
lowest counties in the state for recidivism. This is accomplished with no state
funding, and using the existing staff.
Chair Linda Swearingen stated that she is very impressed with the staff of our
county facility; and has been told by many inmates feel they are treated well by
the system here, and that the staff seems to care what happens to them.

Commissioner DeWolf said that he hopes the community becomes more aware
of the "Your Choice" program. He further explained that it is a good
experience to have a judge to stand before the offenders and congratulate them
on the positive change in their life.
Sheriff Brown then read the Proclamation (copy attached, Exhibit A).
LUKE: I move that we support the Governor's proclamation and declare
the week of July 23 through July 29 as Parole and Probation
Week in Deschutes County.

3. Before the Board was Consideration of Signature of a Contract with the
KIDS Center for the Deschutes County Relief Nursery Project.
Ethel Stratton of the Commission on Children & Families gave an overview of
the contract, which provides $200,000 toward the relief nursery project. This
grant was one of only three awarded in the state.

4. Before the Board was a Discussion of Written Testimony and
Consideration of the First Reading of Ordinance No. 2000-018 on PL -20,
the Deschutes County Comprehensive Plan, to Add a New Plan Policy to
the Forest Lands Chapter of the Plan.
Damian Syrnyk, Community Development, explained that he did a site visit to
the subject properties with Commissioner DeWolf. He also provided a copy of
a letter already in the record from the Oregon Department of Fish and Wildlife
that was requested at the last Board meeting.

Mr. Syrnyk further explained that there has been no further contact from the
Oregon Department of Fish and Wildlife, except for a phone call looking to
reaffirm that this Ordinance would not change any wildlife area combining
zone.
A general discussion then took place about an article in The Source newspaper
regarding the Commissioners' "unfriendliness" to deer. All of the Board
members stated that this article is in error, and that they do not feel this action
will negatively impact deer in the area.
Commissioner DeWolf stated that he made a site visit to the subject property,
and while on site also looked across the street at the two homes located there.
He gave a lot of consideration toward any potential negative impact of this
Ordinance. He noted there are 70 plus properties disbursed throughout the area
that have the potential to fit into this change. He further stated that he has a
problem with people having bought their land and then having the right to build
a home taken away from them.
He also noted, however, that the 70 -plus properties are scattered between Bend
and Sisters to the west, with no concentration of properties in any one location.
In the subject area, the only parcels affected by the Ordinance are the three
owned by Mr. Watts. He further stated that he doesn't see that there is a
negative impact to the area or the neighbors. In fact, he indicated the neighbors
who already live there would have to go through the same process if they hadn't
already built on their property since their property has a similar zoning. He
explained that he couldn't justify not moving forward with approving this
Ordinance.

Before the Board Were Aeenda Items 5, 6 and 7:
Legal Counsel Bruce White explained that the Orders are slightly different as
they send the issue to the November election, approve the final boundaries, and
require that Legal Counsel submit a Legal Notice of Measure Election for the
Incorporation of the City of La Pine and for La Pine City Council Elections.
He further stated that the County had no legal descriptions in front of us when
properties were excluded; and found no way of conveniently fixing the
boundaries where properties are zoned EFU, and other incidental lands. He
said that it is hard to draw a line on the map with RR -10 and EFU. Some minor
parcels of RR -10 will also be excluded. A general discussion took place
regarding the exclusions, the boundaries, and the area map.
5. Before the Board was Consideration of Signature of Order No. 2000-085,
Approving the Boundary for the Proposed City of La Pine, and Referring
the Incorporation of the City of La Pine to an Election.

Contract with the Oregon Health Sciences University for the CaCoon
Program for Disabled Children.

Dan Peddycord, Director of the Health Department, explained that every year
this contract is renewed; this year there has been a slight increase in the
funding. These funds assist disabled children who have special kinds of health
needs.

b) Before the Board was a Discussion Regarding Scheduling a Hearing to
Take Public Testimony on Proposed Changes to County
Telecommunications Facilities Zoning.
A general discussion ensued about scheduling this hearing. Commissioner
Luke stated that he feels the County has a very good Ordinance in place, which
was put together by citizens about three years ago; and all that is needed is
some minor changes to cover potential weaknesses. He further said that
Sunriver has asked for a moratorium, but that the Board believes the existing
Ordinance will cover what is needed.
Commissioner DeWolf explained that this will better define what is already in
the ordinance, and will clarify what is allowed, which will make the Ordinance
more restrictive. He further said that the hearing should restrict testimony to a
clarification of the ordinance
Commissioner Luke asked George Read or other Community Development
staff do a short presentation at the hearing of why the clarification is needed.
He further stated that the Board cannot address specific sites because those will
probably come to the Board eventually via the application process.
A general discussion ensued regarding scheduling; and a date of August 9, 2000
at 5:00 p.m. was selected as a time for the hearing to take place.
c) Before the Board was Resolution No. 2000-056, Authorizing Commissioner
Luke to Represent the Board of Commissioners on Specific Documents and
for a Limited Period of Time:
