Luke Toni DeWol( EXCERPT - MINUTES OF WORK SESSION DESCHUTES COUNTY BOARD OF COMMISSIONERS' MEETING MONDAY, JULY 249 2000 1130 NW Harriman Street, Bend, Oregon Administration Building Commissioners present were Linda L. Swearingen, Dennis R. Luke and Toni DeWolf. Also in attendance were Timm Schimke, Solid Waste; Scott Johnson, Commission on Children and Families; Kim Worrell, County Assessor; Susie Penhollow, County Clerk; Greg Brown, Sheriff; Mike Maier, County Administrator; Geralyn Haas, Damian Syrnyk, Christy Morgan, Chris Schmoyer and Kevin Harrison, Community Development; George Kolb and Tom Blust, Road Department; and Marty Wynne, Finance. Also present were members of the media and approximately ten citizens. Chair Linda Swearingen opened the Board meeting at 10:00 a.m. ADDITION TO AGENDA Steve Scott, the County's real estate broker of record, gave an update on the status of the County's property located at 9`h and Antler, Redmond. SCOTT: The environmental work has been done to back up the geotech report. 'There were no hazardous substances found in the four different pits that were tested - no PCBs or diesel oil, just wood chips. Excerpt of Minutes Page I of 4 Pages Board of Commissioners' Work Session Monday, July 24, 2000 Quality Services Performed with Pride The proposed buyer ordered his report from Century West Engineering regarding the bark; and we ordered our own report. We have dug about thirty pits total over time on this forty -acre site; now the issue comes down to value. The buyer has resubmitted his fourth offer at $417,000, and has agreed to make the bark his issue. His intent is to go into a mini -processing operation, will probably have to get a temporary mining permit to do so. About half of the property has bark on it, and the other half has rock. I suggest that the County accept this offer, subject to Dana Bratton coming back with an acceptable appraisal. The cost of the eliminating the material can be a big problem — that is, removing the material and/or covering up the hole left behind. DEWOLF: Are we going to be assured that no one will come back on the County? ISHAM: There is a condition based on the nature of the use that if there is an environmental incident, the cost of dealing with it, up to the first $100,000, is a share/share alike liability. We have that liability anyway. The buyer will share dollar for dollar with the County if something hazardous is uncovered. We would need to have an agreement at closing that details the County's share of the responsibility in the event of an environmental incident, but this would not deal with the bark. LUKE: What if it costs more than that? ISHAM: The buyer would be responsible for anything over that amount. We would have to split the first $100,000 of the cost. MAIER: We recently met with the Humane Society of Redmond. One issue raised by COIC and the City of Redmond is that the property we have identified for the Humane Society's use does not have services to it. We discussed the possibility of using part of this site. We have committed to the Humane Society to give them a site; can a part of this be segregated off for that? LUKE: If we keep this site, we can't afford to clean it up. Excerpt of Minutes Page 2 of 4 Pages Board of Commissioners' Work Session Monday, July 24, 2000 MAIER: I would like to recommend we try to solve the Redmond Humane Society's problem; they need utilities to and through their property. S WEARINGEN: We have promised them five acres; the City of Redmond originally said they would partner to bring in utilities, but this would cost a million dollars. What Mike is saying is that we need to make sure we have a parcel for them. LUKE: Let's discuss this at our Administrative Liaison. SCOTT: We have an appraisal of $690M, with one-third encumbered with bark. After adjusting the cost of this, it brings it down to $460,000. This man wants to offer $417,000, without mitigation. That's the good part about this offer. At $417,000, that's 90% of the $460,000; I recommend you accept this offer subject to Dana Bratton's opinion, given this information about the bark. Jim is fine with all conditions but the price difference. The geotech company says it could cost up to $600,000 to mitigate the bark situation. DEWOLF: When does offer expire? SCOTT: Tomorrow, but perhaps the buyer would continue discussions. I suggest we put our condition in until next Wednesday. DEWOLF: I think the five acres we are discussing is in a different area. S WEARINGEN: Part of the property is clear, without bark on it. SCOTT: The material is a variety pack that needs to be screened and separated, and eventually eliminated.
