MEETING OF THE BOARD OF COUNTY COMMISSIONERS
WEDNESDAY, SEPTEMBER 20, 2000
HELD AT SISTERS HIGH SCHOOL, SISTERS, OREGON
Present were Board of County Commissioners Dennis Luke and Tom DeWolf;
Commissioner Linda Swearingen was unable to attend. Also present were Mike
Maier, County Administrator; Susie Penhollow, County Clerk; Michael Dugan,
District Attorney; Tom Blust and George Kolb, County Road Department; Gary
Smith, Mental Health Department; and Kevin Harrison, Chris Schmoyer, Damian
Syrnyk and Catharine Tilton, Community Development Department. Also in
attendance were Greg Brown, Sheriff and incumbent candidate for Sheriff; Les
Stiles, candidate for Sheriff; Larry Kimmel, Mike Daly and Randy Gordon,
candidates for Board of County Commissioners Position #2; Neal Thompson and
Barbara Warren, City of Sisters; various school administrators and teachers;
approximately 75 students of Sisters High School; and several other interested
citizens.
Acting Chair Dennis Luke called the meeting to order at 10:25 a.m.
1. Before the Board was Citizen Input.
MIKE DALY (Citizen, and Candidate for Board of County Commissioner Position
#2):
This is the time that we get to tell our public officials what we think. I am going to
spank these two guys a little bit because I think they have lost sight of some issues
that need to be addressed.

(To audience.) How many of you have been reading in the newspaper about the
Deschutes County Fair Association? Okay. How many of you know what the
Deschutes County Fair Association is? How many of you know who these people
are? The people are firemen, policemen, ranchers, and farmers that make up the
Board of Directors that put on the Deschutes County Fair. They are the 4-H, the
FFA representatives. They are the ones that make it happen for all of you that are
in 4-H and FFA.
In yesterday's newspaper Linda Swearingen made a statement that these folks
ought to be held personally liable for the shortfall that the Fair is going through
now. These Commissioners have been trying this thing in the press. They've
never even had a chance to answer themselves. They've got an audit going on right
now. We don't know what the final outcome is. But yet these Association people,
the 4-H and the FFA representatives, are being crucified in the press. I don't think
it's fair. I think these two guys (indicating the two Commissioners present) need to
back off, and Linda Swearingen should resign.
There's no excuse for a public official saying that the Fair Association members
should be responsible for all that money. The Association has been active for 80
years. Do you think this is the first time that the Fair has lost money? I don't think
so. And I'll bet you the last time they lost money, the Commissioners got together
and said, "Hey, let's get together and let's fix it". And it happened. That's all we
need to do. Let's ... I just want to tell these guys, let's get together, make it work,
and let's fix it. Because without it, we don't have a Fair next year.
STUDENT:
I don't understand; if we're having problems such as growth and we need new
schools - and our Sisters schools are so overcrowded - how come we even needed a
new, expensive Fairgrounds?
DENNIS LUKE (Deschutes County Commissioner):
The voters did approve it, and it went out there to the voters, and I was there,
backing the Fair Association and the Fair Board in their request. That's how the
system works. The people voted to tax themselves, and the fact that they are
taxing themselves for those bonds to build it have no effect on school bonds. It's a
separate issue. Schools have a $5.00 per thousand that they get no matter what.
We weren't going to go into this today, but I'm not going to stand here and take
that. Let me explain.

LUKE (continued):
The Deschutes County Commissioners appoint a Fair Board, and the Fair Board is
established by Statute in Oregon law. They can be appointed, but we haven't seen
anything that says they can be removed; which is good, as they aren't there subject
to political pressures. So you have five citizens - we just got done appointing three
new ones - rather, two new ones and reappointing an existing one - plus the two
that we appointed a year ago.
The Fair Board, not the Fair Association, is responsible, by Statute, for operating
the Fairgrounds. There used to be a Fair Association in almost every county in the
state; the last we heard from the Fair Association that they are the last one in the
State of Oregon. They are a private, non-profit agency. They are not a
government entity. They have received every single dime that has gone through
the turnstiles of that Fairgrounds, for every event, for the Fair, everything. They
do not pay any rent, they do not pay any property taxes, and they don't put any
money into a reserve fund. They are responsible for the insurance and utilities of
the Fairgrounds, and they get all the money.
We have not tried all this in the press. When Elton Gregory came into our office last
week and said they had written $145,000 worth of bad checks and the checks were
in the mail, with no money in the bank to cover them, he asked us to cover those
checks, along with $30,000 in payroll that they couldn't make on Friday. This
means that place would have shut down on Friday. They were able to put the
payroll money together, but those are their bills.
They signed the contracts. The County Commissioners have not signed any
contracts of anything at the Fair. The money quoted in the paper is a minor part of
what has been going on. All of the deposits have been spent for all of the events
booked for the next four years. This number could approach $500,000 or more.
This is serious business. This isn't time to "pat somebody on the back". Somebody
has to step in, somebody has got to take charge, and it's the Fair Board, and the
Commissioners are going to back them up.
The things that have been in the paper - and to the reporters who are here - we
were called and asked to go meet with the editorial board of the Bulletin. They are
quite concerned. They want to know what is going on. The accountant who is at
the Fairgrounds doing the books says their books have not been done since
December 31, 1999. No checks have been posted since then. We have tried to
keep a lot of things out of the paper and have tried to keep our cool when we can,
but this is serious stuff. This is not a little game anymore; this is a lot of money.

LUKE (continued):
We, as elected officials, have a responsibility, along with the appointed members
of the Fair Board, to correct this situation, and we are going to correct it. In the
long run we will continue to have a great facility that will services the needs of the
community. I am sure that in some ways along the way the Fair Association will
be a part of it. But it appears they've been a part of it too long.
I reject Mr. Daly's comment that the 4-H and the FFA are run by the Fair
Association. That's not true; they are run by 4-H and FFA leaders. These are the
people who lead them. The Association members have been very active. They've
helped with the auctions, they help with setting up of the Fair equipment, and a
couple of them are good friends of mine who helped to build the Young Life booth
for the Fair. There are a lot of people who contribute towards the Fair. We are not
slapping the faces of the Fair Association, but there are serious management
practices that have been going on there that cannot be tolerated any more.
I was at a meeting last night where a lot of people suggested that some people
should be in jail, and I did not agree with that. We need to work through this
together, and we will work through this together and have a stronger, healthier
Fairgrounds when this is all done.
DEWOLF (Deschutes County Commissioner):
I have a couple of things also that I think you need to understand. One is that we
do not write newspaper articles. When we met with the editorial board of the
Bulletin, one of the things that we did spend a lot of time discussing is that these
are good people. These are people who have been volunteering their time for
many, many years. I believe you have about seventeen people that are on the
actual board of the Fair Association, and they have been volunteering an incredible
amount of time. There are hundreds of people who volunteer their time, not just
4-H and FFA, but in a whole host of ways. We've done our best and they've done
their best to see a way through this.
Since I got into office I have been asking for a complete budget document from the
Fair Association. What we have been given is indecipherable, according to our
County Treasurer, who is a paid, professional accountant who knows what he is
doing with budgets. He can't comprehend what is trying to be accomplished in the
three different budget documents that were turned in over the last year and a half.
There were columns that didn't match up with rows. They just haven't had
adequate accounting procedures in place.

And like Dennis said, if you don't balance your checkbook since December of last
year, you're going to run into problems. We're trying to work this out the best that
we can. We are held accountable for the work that we do, and other people need to
be held accountable for the work that they do. There will be a Fair next year.
The Bend Chamber of Commerce announced yesterday that they are canceling a
show that's coming up in October. I talked with the Director, Gary Peters, and told
him that the lights will be on and the doors will be unlocked. We will make this
happen even if Dennis and I have to go down there and help set up booths. He said
the only news about the Fair right now has been negative, and he felt he couldn't do
that to the members of the Chamber; and it was a hard decision to cancel the event.
He said that he hopes they can hold it at a later date, sixty or ninety days down the
road.
There are a lot of small businesses in this community that have not been paid what
they were promised. We don't know how all of that is going to be worked out yet.
The auditor who is there right now is actually the Fair Association's auditor. He
has done their auditing work in previous years, so he is someone that they are
familiar with. We hope that he is able to come up with what that real number is by
next week. We don't know what that number is yet.
I respectfully disagree with Mike's contention about this. We are doing our best,
but I can't protect people who have done things that are unethical. And writing
$145,000 worth of checks without money to cover those checks is an unethical act.
As a business person who expects that when I deliver a service or product that I
will get paid for it, I can't accept this, and I can't cover up for it. That is something
that those people who have written those checks need to answer for.
I don't mean to pick on Elton Gregory, who is the president of the Association and
who takes most of the heat, just like in this County there are 800 plus employees,
but Dennis, Linda and I take most of the heat. If this were just Dennis, Linda and I
making these statements, I would have a lot of questions if I were in your seats.
But we have a County Administrator, County Attorneys and a County Treasurer
that have been working hand in hand with us throughout this, and we haven't been
able to make heads or tails of it.

In the past we were told to stay out of it, and contractually we were not allowed to
go in. We've never seen any of their contracts; we've never seen the books,
because contractually we are not allowed to do so. That's why last October we
gave notice that we were planning to cancel the current contract with the Fair
Association, which is a three-way contract between the Fair Board, the Fair
Association and the County.
DEWOLF (continued):
Unfortunately, things have gotten so bad recently that they put us in the boat that
we're now in. There have been a lot of harsh things said, but there are a lot of
harsh realities out there. This is a tough one, and all I can tell you, speaking for
myself, is that I am going to continue to do my best to work with the folks in the
Fair Association and the Fair Board to get through this. In addition, there are a lot
of other folks who are working really hard on this.
Again, I would urge you to read between the lines, and if you have any questions
feel free to give any of us a call. Saying nice things about people doesn't sell
newspapers. The fact that there have been $145,000 worth of bad checks written,
that is what sells newspapers. I could talk all day long about the wonderful job that
the Fair Association has done for the last 75 years in putting on Fairs in Deschutes
County. I expect that the Fair Association will be putting on the Fair for the next
75 years as well, but that doesn't sell newspapers. We're in this quandary, but this
is the real world, and that's what we're stuck with.
MIKE DUGAN (Deschutes County District Attorney):
I would like to defend these two individuals (indicating the two Commissioners)
and Commissioner Linda Swearingen. As elected public officials, they take an
oath of office, which says they swear to uphold the Constitution of the United
States, the Constitution of the State of Oregon, and the laws thereunder. They have
a responsibility to make sure these laws are followed.
When I read in the paper that the Fair Association knowingly wrote $145,000
worth of checks and they knew that they didn't have the money to pay them, that is
called "negotiating bad checks". The District Attorney's Office prosecutes people
for negotiating bad checks.
I think the Board had every obligation under their oath of office and the
responsibilities they have taken on as County Commissioners to step and see that
those violations of law do not reoccur. So I commend them for doing that, and,
Mr. Daly, I think you are wrong to call for a resignation.

2. Before the Board Was a De Novo Public Hearing Regarding a Zone Change
and Plan Amendment to Allow for the Siting of the Sewage Treatment Plant
for the City of Sisters.
Chris Schmoyer of Community Development gave an overview of this issue,
utilizing a map to explain where the subject property is located in relation to the
surrounding area.
He explained that this property must be made contiguous to the City for the City to
annex it. He further said that no opposition to this change was presented, and that
the Hearings Officer approved the documents subject to Board of Commissioners'
approval. He stated that this property was conveyed from the U.S. Forest Service,
and was made possible through an agreement between the Forest Service, the
County and the City of Sisters.
Neal Thompson, Planning Director of the City of Sisters, explained that "de novo"
means that the Board must hear this as if it was a new case.
Commissioner Luke further stated that "de novo" allows new evidence to be
entered into the record. He further said that cities normally couldn't put sewage
facilities in a forest zone, so therefore the zoning must change. He also explained t
hat a lot of planning went into this, and that standards are based on the Urban
Growth Boundary, the City's comprehensive plan, State of Oregon goals and the
plans of the City. He further stated that this is the culmination of a very complex,
history -making process that involved an Act of Congress.
Commissioner Luke then opened the public hearing.
Several students in attendance asked questions regarding the siting of the sewer
treatment plant, and voiced concerns as to whether odors or ground water pollution
could be potential problems. Neal Thompson answered that extensive testing and
research were done by all of the entities involved in the process, and assured the
students that these concerns have been addressed. He elaborated that the
prevailing winds were taken into consideration, as well as the distance of the
treatment plant away from dwellings; and that the property would remain treed.
He also explained that the treatment ponds wold be heavily lined and monitored for
any potential future problems. At this point he submitted into the record the
USDA Forest Service Bill for Collection dated August 10, 2000 (Exhibit A), and
the Special Election Results dated September 19, 2000 (Exhibit B).

In response to a question about the time frame to build, Mr. Thompson replied that
work has begun and they were hoping for a completion of the project within 18
months. When asked about the total cost of the project, Mr. Thompson said it
would eventually total around $13,000,000.

Tom Blust of the Road Department explained that notice was required to be given
today, and this item should be continued and renoticed.
Commissioner Luke opened the public hearing.
Being no testimony offered, he continued the public hearing until Wednesday,
October 25, 2000.
4. Before the Board was Consideration of Signature of an Interagency
Agreement with the Oregon Department of Human Services Regarding the
Receipt of Child Support Funds.
Mike Dugan, District Attorney, gave a brief overview of this agreement. He
indicated that funds cannot be received without this agreement in place.

A-00-11, Hearings Officer's Denial of the Siting of a Children's Facility as
Part of a Wilderness and Assessment Program.
Catharine Tilton, Associate Planner with the Community Development
Department, gave a brief overview of the file. She explained that the facility is
already in place, but is in place illegally, without benefit of proper zoning or
permits.
Mike Dugan, District Attorney, stated that he does not believe this appeal should
be heard; and that these facilities don't have properly established rules and
regulations, which sometimes results in crime, creating a burden on existing police
and District Attorney staff. He indicated that local agencies are not able to inspect
the facilities or review the facilities' books and operating rules and guidelines at
this point.
