Luke MINUTES Tom DeWolf MEETING OF THE BOARD OF COUNTY COMMISSIONERS WEDNESDAY, OCTOBER 4, 2000 HELD AT BEND HIGH SCHOOL, BEND, OREGON Present were Board of County Commissioners Dennis Luke and Tom DeWolf; Commissioner Linda Swearingen was excused. County employees present were Mike Maier, County Administrator; Susie Penhollow, County Clerk; Renee Warner, Building Management; Mike Dugan, District Attorney; Kelley Jacobs, Juvenile Corrections; and Jim Bonnarens and Tammy Credicott, Property Management. Also in attendance were Greg Brown, Sheriff and incumbent candidate for Sheriff and Les Stiles, candidate for Sheriff. Also present were Larry Kimmel, Mike Daly and Randy Gordon, candidates for Board of County Commissioners Position #2; candidate Curt Wagoner could not be present. Also attending were various school administrators and teachers; approximately 80 students of Bend High School; several representatives of the media; and other interested citizens. Acting Chair Dennis Luke called the meeting to order at 9:05 a.m. 1. Citizen Input. None was offered. 2. Before the Board was Consideration of Signature of a Contract with Paul Evers Design to Implement the Community Youth Investment Communications Grant Minutes of Board of Commissioners' Meeting Page 1 of 7 Pages Bend High School, Bend, Oregon Wednesday, October 4, 2000 Quality Services Performed with Pride Kelley Jacobs of Juvenile Community Justice explained the details of the contract. She stated that the contract does not require the signatures of the Board, but she wanted to explain it to them for informational purposes. 3. Before the Board was Consideration of Signature of Order No. 2000- 075, Authorizing the Sale of County -owned Property off Smith Rock Way to Adjacent Property Owners Jim Bonnarens of Property Management explained that the appraised value was $68,000, and the offer received is for $76,000. Before the Board was Consideration of Signature of Order No. 2000- 106, Authorizing the Sale of County -owned Property off Gerking Market Road to Adjacent Property Owners Jim Bonnarens explained that this involved a lot line adjustment; and the Order accepts the offer already made. Before the Board was Consideration of Signature of a the Acceptance of a Bargain and Sale Deed, Authorizing Central Oregon Irrigation District to Convey Property off Byram Road to Deschutes County Jim Bonnarens explained this involves the consolidation of property with other County -owned property, subject to a 1992 exchange agreement with Central Oregon Irrigation District. ADDITIONS TO THE AGENDA: a) Before the Board was Consideration of Approval of Oregon Liquor Control License Renewals for the Inn of the 7t" Mountain and Farmer John's Produce DEWOLF: I move approval. LUKE: Second. VOTE: DEWOLF: Yes. LUKE: Chair votes aye. b) Before the Board was a Discussion Regarding the Deschutes County Fairgrounds. Commissioner DeWolf made a statement regarding the current financial and operational situation of the Deschutes County Fairgrounds, as follows: "We've been requested by the Deschutes County Fair Board to cover payroll costs in the very short term in order to avoid canceling events. I have a motion to make in order to support the Fair Board and the people who expect to use the Fairgrounds. "I am doing this on behalf of the actual workers out there. They should not have to suffer while we finalize an agreement to deal with the big picture here. "I MOVE that Deschutes County authorize the signing of a grant agreement with the Deschutes County Fair Association, subject to the approval of the Deschutes County Fair Board, for up to $20,000 to cover the difference between income received by the Deschutes County Fair Association and payroll expenses incurred by, or on behalf of, the DCFA, for the period Sunday, October 1,2000 through Monday, October 9, 2000. "It is understood that the payment of this amount is subject to a satisfactory written grant agreement approved by all parties, and is in no way intended to place either the County or the Fair Board in the position of operating or interfering with the operations, decisions or actions of the DCFA. "The money is to come from the County's General Fund Contingency, with the goal that the General Fund will be repaid. The ultimate goal is to avoid having property taxpayers subsidize the operation of the Fairgrounds." DEWOLF: Yes. LUKE: Aye. c) Before the Board was Consideration of an Offer to Purchase County - owned Property off 4A and Greenwood, Bend (Health Department Building complex). Jim Bonnarens indicated that the party who previously had been interested in purchasing the property has submitted another offer. He explained that the prospective purchaser had offered $1,050,000 in his first offer, which was accepted by the Board, but which had included contingencies regarding inspections of the structure. He further explained that the prospective buyer found he would have to do extensive remodeling to make the property suitable for his needs. In light of that, the prospective purchaser is now offering $1,000,000. Mr. Bonnarens recommended that the Board submit a counter-offer in the amount of $1,020,000. He further explained that although the property was originally listed at $1,100,000, it is difficult to find buyers for this type of real estate. The proposed close of escrow date is December 4, 2000. Mike Maier, County Administrator, recommended approval of the counter-offer amount if Legal Counsel agrees. He and Rick Isham, Legal Counsel, further recommended a possession date of January 1, 2001, to give the occupants adequate time to move into their new facility. The close of escrow could remain December 4, 2000, with the occupants renting back the property until January 1, 2001. DEWOLF: I move approval of the counter-offer of $1,020,000, subject to legal review, and with the possession date to be January 1, 2001. LUKE: Second. VOTE: DEWOLF: Yes. LUKE: Chair votes aye. Jim Bonnarens presented another offer on County -owned property, which is 20 acres located off Dodds Road in the Alfalfa area. He stated that the appraisal came in at $300,000, and an offer has been received for $250,000. He recommends a counter-offer of $270,000, and explained that he has spoken with the appraiser, who indicated that would be a reasonable price for that type of land - dry land (no irrigation), with access. DEWOLF: I move approval of the counter-offer of $270,000 subject to legal review. LUKE: Second. VOTE: DEWOLF: Yes. LUKE: Chair votes aye. e) Before the Board was Consideration of Approval of an County Offer to Purchase Property for Emergency Access Purposes. Jim Bonnarens asked for approval of an offer from the County to purchase a vacant lot in Deschutes River Woods to be utilized in the development of a secondary emergency fire access route. The owners want $45,000, which Mr. Bonnarens explained is supported by recent comparable sales. DEWOLF: I move approval. LUKE: Second. VOTE: DEWOLF: Yes. LUKE: Chair votes aye. 14 The Candidates' Forum took place beginning at approximately 10:10 a. m., following the Board Meeting, and continued until approximately 11:30. The candidates introduced themselves and each explained his background, opinions on pressing issues, and how he would hope to serve the citizens of Deschutes County if he were elected. Students asked a variety of thoughtful questions, including some relating to public safety issues, the environment, taxation, the Bend airport, transportation and local problems relating to rapid population growth; and received a wide variety of answers from the candidates.
