Luke EXCERPT OF MINUTES Tom DeWoff DESCHUTES COUNTY BOARD OF COMMISSIONERS WORK SESSION MONDAY, OCTOBER 9, 2000 Present were Commissioners Tom DeWolf and Linda Swearingen; Commissioner Dennis Luke was excused. Also present were Jim Bonnarens, Property Management; Kevin Harrison and Paul Blikstad, Community Development; Ted Schassberger and Susan Mayea, Commissioners' Office; Mike Maier, County Administrator; Rick Isham and Mark Amberg, Legal Counsel; Dan Peddycord, Health Department; Roger Kryzanek, Mental Health Department; and several citizens. Chair Linda Swearingen opened the meeting at 10:00 a.m. CITIZEN INPUT Jim Bonnarens discussed a situation regarding a land -locked, County -owned parcel located in the Smith Rock area. An offer to purchase the property was presented to the adjacent owners, two of which - the Clements and John Peters -indicated they had an interest in purchasing the property. . Mr. Bonnarens explained that the property was offered through the bid process, at which time Mr. Peters did not bid, even though he indicated that was going to do so. This drove the Clements to a higher bid than what the County had initially requested. The minimum bid was placed at $68,000, and the Clements submitted an offer of $76,001. They have since indicated they would like to purchase for the initial offering price, since the price had been artificially driven up by Mr. Peters. DEWOLF: Doesn't this follow our normal process? BONNARENS: This was not opened to the general public. We called them both in and asked if they had an interest. DEWOLF: At that point we're still going out to bid for two people. SWEARINGEN: This is a land -locked property. DEWOLF: I don't want us to set precedence in changing our bidding procedures. BONNARENS: This has never happened before. Both parties have always submitted a bid in the past after they had indicated they would. I would like to see our policy changed in this regard, if there is a minimum bid and one party fails to submit a bid after saying they would. SWEARINGEN: I feel that since this is landlocked, and only one bid was received, I'd like to honor this request. I think it's unfair to insist on this higher price. ISHAM: You have an offer to purchase that has been accepted (at a previous Board meeting at Bend High). You can cancel your acceptance if they want to withdraw their bid. However, if it goes out to bid again, there's the chance the other neighbor may bid this time. You can go back to the start and cancel this bid. This is subsequent negotiation of a bid, which typically we would not do. The most straightforward way to handle this is to start over. DEWOLF: How many neighbors are adjacent to the property? BONNARENS: There are five neighbors, and the two who expressed interest. DEWOLF: I'd be willing to withdraw our acceptance, but only this one time. Excerpt of Work Session Minutes Monday, October 9, 2000 Board of County Commissioners Page 2 of 4 Pages BONNARENS: The policy in the bid process with adjacent owners will be changed; and we will add that there's no guarantee that the other party who said they'd bid will actually do so. DEWOLF: I hope you understand that we need to protect all of the taxpayers of Deschutes County; we want to maximize the amount made off the sale of our properties. ISHAM: This happens quite often when properties are offered to the public. But it never has happened when it was a land -locked property and there were only neighbors involved. DEWOLF: I move to withdraw the Board's acceptance of this offer, conditioned on seeing the policy cleared up before this can happen again; so that if someone bids more and no one else bids, the offeror has to accept their action anyway. SWEARINGEN: I second. VOTE: DEWOLF: Yes. SWEARINGEN: Chair votes aye. ADDITION TO THE AGENDA DEWOLF: I move that we recommend Hickman Williams and Associates of Bend to be hired to do the civil engineering and planning for the construction of the Fairgrounds parking lot project.
