ORDER NO. 2000 - 088
WHEREAS, the Board of County Commissioners, of Deschutes County, Oregon, initiated the
vacation of a portion of Main Street in LaPine, Oregon by Resolution Number 2000-042 dated August
9, 2000; and
WHEREAS, the Board of County Commissioners requested the County Road Official to
prepare a report relating to the vacation; and
WHEREAS, the Board of County Commissioners accepted and approved the County Road
Official's report and as required by ORS 368.346 set a public hearing on September 20, 2000 at
10:00 a.m. by Order Number 2000-087 dated August 9, 2000; and
WHEREAS, notice of hearing was given in accordance with ORS 368.346(3) and 368.401 to
368.426; and
WHEREAS, the Board of County Commissioners held said hearing open until October 25,
2000 to consider matters presented under ORS 368.346; and
WHEREAS, the Board of County Commissioners finds that it is in the public interest to vacate
the public property; now, therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON,
ORDERS as follows:
Section 1. That the property, described in Exhibit "A", attached hereto and by this reference
incorporated herein, is hereby vacated.
Section 2. That the property, vacated in Section 1, shall vest in the owner of the land
abutting the vacated property pursuant to ORS 368.366 (1)(d).

Section 3. That the property, vacated in Section 1, shall be SUBJECT TO the reservation of
a utilities easement in and upon all of the property; for the purposes of continuing, constructing,
installing, maintaining, repairing, reconstructing, replacing, enlarging and altering; wires, poles,
pipes, lines, structures, casings supports, equipment, facilities and appurtenances; at the present
and in the future; necessary or convenient; to Deschutes County, a political subdivision of the State
of Oregon, its agents, licensees and permittees; forever.
Section 4. That the Deschutes County Surveyor is directed to mark a copy of the plat, if any,
as provided in ORS 271.230.
Section 5. That this Order shall be recorded with the Deschutes County Clerk, and copies
shall be filed with the Deschutes County Surveyor and County Assessor.

Street Vacation
In Lapine, Oregon
Vacating a portion of Main Street, located in Government Lot 2 in the Northwest
Quarter of the Northwest Quarter of Section 14, Township 22 South, Range 10
East of the Willamette Meridian, Deschutes County, Oregon and more particularly
described as follows:
Beginning at the Northwest corner of saidLot2, said corner is located on the
West line of Main Street; thence South 00 21' 46" West along the West line of
said Lot 2 a distance of 291.44 feet to the North line of 3rd Street as it presently
exists; thence South 89P44'04" East along said North line a distance of 24.97 feet
to the Westerly line of Huntington Road as it presently exists; thence North 140
03' 53" East along said Westerly line a distance of 147.86 feet to the point of
intersection with the East line of Main Street and the Westerly line of Huntington
Road, said point of intersection is monumented with a 5/8 inch diameter rebar
with yellow plastic cap marked "DEJARNATT LS 2208" as shown per Partition Plat
No. 1990-66 as filed in the Deschutes County Clerk's Office; thence North 0021'
46" East along the East line of said Main Street a distance of 148.37 feet to the
North line of the above-mentioned Government Lot 2; thence South 8945' 41"
West along said North line a distance 60.00 feet to the Point of Beginning.
Containing 0.34 acres more or less.
The "Basis of Bearings" for the above-described land is the North line of
Government Lot 2 as shown per the Partition Plat No. 1990-66 as filed in the
Deschutes County Clerk's Office.
