November 7, 2000 Relating to the Incorporation of *
The City of La Pine and the Election of an Initial
City Council.
ORDER NO. 2000-123
WHEREAS, an election in Deschutes County, Oregon, was held on November 7, 2000 on the
measure set forth in Exhibit 1; and
WHEREAS, the Abstract of Votes at the election, set forth in Exhibit 2, shows that a majority of
the votes cast were not in favor of the measure; now, therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON,
ORDERS as follows:

electors voted YES and 2250 electors voted NO on the measure captioned, "Incorporation of City of La
Pine," set forth in Exhibit 1, attached hereto and by this reference incorporated herein, as evidenced by the
Abstract of Votes, marked Exhibit 2, attached hereto and by this reference incorporated herein; and that
the measure is declared to have been defeated.
Section 2. At the election on the question of incorporation there was an election on the initial City
Council for the City of La Pine as described as in the abstract of votes set forth in Exhibit 3, attached
hereto and by this reference incorporated herein. As a result of defeat of the measure relating to the
incorporation of the City of La Pine, the election of the La Pine City Council is declared moot.

EXPLANATORY STATEMENT
Approval of this measure would incorporate the City of
La Pine and establish a permanent property tax rate of
$1.50 per $1,000 of assessed property valuation as
determined by the Deschutes County Assessor. The city
would contain 14,767 acres and have a population
(uncertified) of approximately 7,000 people.
Under Oregon law, the permanent tax rate cannot be
changed. While the effective date of incorporation would
be the date of the election, the permanent tax rate can-
not be levied and collected until July 1, 2001. The city
would be required to adopt a budget under Oregon Bud-
get Law to collect and expend property tax revenues.
In a separate action, voters would also elect five city
councilors to serve as elected representatives, effec-
tive only if the incorporation is approved. The council
may hire staff as necessary to conduct city business.
As provided by state law, incorporation would dissolve
five special districts wholly contained within city bound-
aries: La Pine Special Sewer District, La Pine Water
District, Special Road District #8, Ponderosa Pines East
Road District and Forest View Road District. The City of
La Pine would then be required to assume all assets
and liabilities of these districts on the effective date of
incorporation. Property taxes certified by these districts
to the Deschutes County Assessor for the 2000-2001
fiscal year would be unaffected. Collected property tax
revenues would be transferred to the City of La Pine to
be budgeted and expended according to state law. Be-
ginning July 1, 2001 district property taxes will be re-
placed with the city's property tax. The incorporation has
no such effect on other special districts.
The City of La Pine would have all the authority and
responsibilities accorded to cities by the Oregon Con -

stitution and state laws. The Economic Feasibility State-
ment submitted by petitioners includes the following pro-
posed services: maintenance of public roads; planning,
zoning and building services; cemetery maintenance;
community recreation and events (including city parks);
economic development, including ownership and admin-
istration of the La Pine industrial Park; sanitary sewer
service and municipal water. The city council would have
the authority to determine which services the city would
provide.
Sanitary sewer and water services, totally user fee -sup-
ported, would continue to be provided to the same prop-
erties and accounts that are currently served. Expansion
of these services would be limited by state administrative
rules to the current urban area as designated on the
Deschutes County Comprehensive Plan or areas that
have been or in the future are approved as an exception
to the rules.
In addition to property taxes, revenue may be derived
from the following sources: state gasoline, cigarette and
liquor taxes, transient room tax; privilege taxes upon utili-
ties; state revenue sharing; and grants.
The city would be required to prepare a comprehensive
plan, including an urban growth boundary, and land use
regulations within four years from the effective date of
incorporation. In the interim, Deschutes County's plan and
regulations would govern land use decisions in the city.
