Luke Mike Daly Board of Commissioners' Work Session Monday, January 22, 2001 Chair Tom De Wolf opened the meeting at 10: 00 a. m. Present were Commissioners Tom De Wolf, Dennis Luke and Mike Daly. Also present were Mike Gerdau, District Attorney's Office; Denny Malone, Jim Smith and Kelley Jacobs, Juvenile Community Justice; Tom Blust and George Kolb, Road Department; Jim Bonnarens, Property Management; Timm Schimke, Solid Waste Department; Ted Schassberger and Susan Mayea, Commissioners' Office. Also in attendance were Steve Jorgensen, George Read and Kevin Harrison, Community Development; Mike Maier, County Administrator; approximately a dozen staff from the Juvenile Justice Department; Jim Court, La Pine RFPD; and Gary Marshall, Bend Fire Department. In addition, there were several citizens and members of the media in attendance. 1. Before the Board was Citizen Input. Sallie Cronen of Bend spoke. She said she is not happy about her property being included in the Historical District, and is not satisfied with the response she has gotten from Michael Houser. Commissioner De Wolf recommended that she talk with a supervisor in Community Development to get a better explanation of the situation. Kevin Harrison of Community Development explained that it is still "denomination designation" time, and she should talk with Geralyn Haas. Commissioner Luke said he doesn't like the system; the law was changed at the state level, making it harder for citizens to exclude their property. He further said the state has not been timely in informing the cities and counties about the process. Excerpt of Minutes of Board Meeting Page 1 of 8 Pages Monday, January 22, 2001 Quality Services Performed with Pride J Ms. Cronen said she has talked with Ms. Haas, but doesn't know how to proceed from here. She said she has not gotten feedback or a response from the State and wants to take action during the denomination designation time. At this time George Read, Director of Community Development, met with Ms. Cronen and her husband in another room. Upon his return to the meeting, Mr. Read explained that the National Historic District within City of Bend is a contentious issue. It is a federal issue, but state law allows people to opt out of state requirements; however, the federal process does not allow this. This started due to request to become a national district; a grant was obtained for this. The perception is that people can opt out, but this is true locally only, not nationally. He encouraged the property owners to get their vote in as soon as possible; they must vote "no" to keep their property out; this is federal law. He further explained that the other part of this issue is what the local rules will be to implement the district. Ultimately the City of Bend's City Council will be setting these rules up according to state guidelines. There was no other citizen input offered. 3. RECOGNITION of the Oregon Juvenile Division Director's Association 2000 Worker of the Year. At this time the Commissioners awarded Dennis Maloney of Juvenile Community Justice a plaque and letter acknowledging his fifteen years of service to the County. Mr. Maloney and the Board of Commissioners then presented an award to Jim Smith of the Juvenile Community Justice department. Mr. Smith was recently named the Oregon Juvenile Division Directors' Association 2000 Worker of the Year in recognition of the many programs and projects in which he has been involved, assisting juveniles and other citizens in Central Oregon. Excerpt of Minutes of Board Meeting Page 2 of 8 Pages Monday, January 22, 2001 4. Before the Board was a Discussion of Southern Deschutes County Fire District Issues. Jim Court stated that he is seeking as much grant assistance as possible for the La Pine Rural Fire Protection District. He recently did a study of equipment, manpower, and budgeting; and there are more needs than dollars to operate. He explained that his District had a record number of responses - from 1,400 to 1,600 in one year; approximately 60% of which is medical emergencies necessitating trips to the hospital in Bend, which means at least a two-hour turn- around time. He said the District needs to replace their ambulances every three years, and two of the existing ambulances should have already been replaced. He explained they have three fire stations, but only enough manpower for two. With five employees on the line at any given time, if more calls are received others need to be called in on an overtime basis. He stated that since the community voted down incorporation, he has been getting negative feedback from groups that might have helped out in the past. Commissioner DeWolf said there is a need to educate those citizens and groups that have a negative attitude. He explained there is some reality to this, as some grants over the past few years were directed specifically toward incorporation issues. Mr. Court replied that the incorporated area would have been much smaller than the District's service area; that people forget that fact, and it is unfair to those people in the outlying area. Commissioner Luke said that the Board is trying to figure out what kind of representation could be put together from the southern Deschutes County area. He explained there needs to be down to a quasi -governmental body to bring all of these issues to the County's attention. Perhaps people who are already in involved with some kind of local entity — sewer district, industrial park, fire station, etc. - could act as a voice for the local citizens. Before the Board was a Presentation of an Overview of the Annual Fire Free Program Scheduled for April 28 & 29 and May 5 & 6, as Sponsored by SAFECO, the Bend Fire Department and Deschutes County Rural Fire Protection District #2; and CONSIDERATION OF APPROVAL of a Request for Deschutes County to Partner by Allowing County Residents to Dispose of Yard Debris Free of Charge at Knott Landfill on Those Dates. Mr. Marshall gave an overview of the Fire Free Program, which originated with Safeco Co.; there are now other parties involved, including Project Impact. He stated that the State Fire Marshal awarded Safeco its "Sparky" award, which is the greatest state award for this. Washington, D.C. will be awarding them the "Smokey" award as well. Mr. Marshall explained that Deschutes County has teamed up with other local entities for three years by keeping Knott Landfill open for the deposit of yard debris at no cost to the citizens. He said this reduces the fire load, and it is now mulched instead of burned; this amounted to 10,000 cubic yards in just two weekends last year. He stated they are now bringing in all Deschutes County fire departments into the program - Redmond, Sisters, Cloverdale, La Pine; and he would also like to see those local landfills open on the same weekends for citizens to deposit, at no cost, their brush and yard debris. He asked the County to approve this partnership as in the past, and matching dollars as well to gain the federal dollars back into the county. He also brought up the possibility of expanding this into a third weekend. Timm Schimke spoke about the cost estimates for Fire Free 2001. He said during the past year there was a 13% increase in vehicle traffic at the landfill and a 20% increase in landfill deposits. He said the only location to be advertised in the past was Knott Landfill, although deposits were accepted at no cost at the other locations. He now would like the advertising to include the other landfill sites. Commissioner DeWolf asked if the amount was already budgeted. Timm answered, "for the most part". Commissioner Luke asked what the cost of a fire would be. Mr. Marshall answered that it could run into the millions; and that this prevention method can save many homes. Excerpt of Minutes of Board Meeting Page 4 of 8 Pages Monday, January 22, 2001 He reminded the audience of the two recent bad wildfires in the area that ended up costing millions of dollars to fight and the loss of many homes. He further said that this area has been lucky in that there haven't been more such fires; and there is an immeasurable impact on tourism as well. Timm Schimke explained that the cost last year was about $17,800; $12,000 of that was for grinding. Adding the transfer sites would add about $20,800. Jim Court of the La Pine Rural Fire Protection District asked if some of the piles get burned. Mr. Schimke said that with the timing of this project, most would be mulched to get away from burning, due to air quality issues and fire issues. Mr. Court explained that southern Deschutes County strongly supports this project, and that more people would use it if they didn't have to drive to all the way up to Knott Landfill. He said that there's a lot of vacant land in south County and the owners are strongly encouraged to removed deadfall and other hazardous trees. Mr. Schimke said that this is for two weekends only, and that perhaps Knott Landfill could be used for two weekends and the transfer sites could be opened up on the third weekend. This would allow better utilization of manpower. Mr. Court voiced concern about the advertising issue. Mr. Schimke explained they would not turn people away if they show up on the other two weekends. He further said that Project Impact might have funds available to reimburse some of these expenses. Mike Maier suggested Mr. Schimke talk with Tom Blust of the Road Department regarding safety net project funding for next time. Before the Board was Consideration of Signature of Acceptance of a Bureau of Land Management Land Patent for South County Property Acquisition (for the La Pine "New Neighborhood" off Burgess Road) Ron Wardman of the Bureau of Land Management and Jim Bonnarens, Property Management, said that the Bureau of Land Management is delivering a patent to Deschutes County regarding the regional problem -solving project. Mr. Wardman gave an overview of the patent, for 518 acres, giving this property for public use and to protect the public right and interest. At this point he read the patent to the audience.
