WHEREAS, the Board of County Commissioners has proceeded with Periodic Review Work
Program Modification (Order No. 001246);
WHEREAS, the revision of Chapter 18.80, Airport Height Combining Zone, of Title 18, the
Deschutes County Zoning Ordinance, was required as part of Periodic Review; and
WHEREAS, after notice and hearing as required by law, the Board of County Commissioners has
considered the recommendation of the County Planning Commission; now, therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON,
ORDAINS as follows:
Section 1. AMENDMENT. The Airport Height Combining Zone in Title 18, the Deschutes
County Zoning Map, is hereby amended and renamed the "Airport Safety Combining Zone Map," as shown
in Exhibit "A," attached hereto and incorporated herein by this reference.
Section 2. FINDINGS. The Board adopts the Community Development Department staff
report for the Airport Safety Combining Zone, attached hereto as Exhibit `B" and incorporated herein by
this reference, as its findings to support this Ordinance.

SUBJECT: WORKSESSION ON CHANGES TO THE AIRPORT HEIGHT COMBINING ZONE
INTRODUCTION:
In response to Periodic Review Order No. 001246, regarding Airport Zoning, County staff has
drafted a revised Chapter 18.80 Airport Height Combining Zone, and renamed it the Airport Safety
Combining Zone. This staff report includes the proposed new text and map, existing Chapter 18.80
and map, Periodic Review Order dated 12/18/92, and the most recent Periodic Review Work
Program Modification letter from the Department of Land Conservation and Development
Commission (DLCD).
ACTION:
Staff requests Board review and discussion of the draft Chapter 18.80 at this worksession and hold
a public hearing on November 8, 2000. Following the public hearing, staff requests that the Board
discuss the proposed ordinances and recommend approval or approval contingent on changes.
FINDINGS:
The attached revised Chapter 18.80 takes into account the latest changes to airport planning
requirements. In the time since the County received the Periodic Review Order regarding airport
zoning, several changes to state law have occurred. First, in 1995, SB 1113 was passed that
established the requirement for the state to establish administrative rules for airport planning. These
rules were adopted by DLCD as OAR 660-13 in 1996. Subsequently, HB 2605 was passed in 1997,
which called for the revision of the rules adopted as OAR 660-13, and the creation of a "list" of
airports that would be subject to the new rules. The revisions to OAR 660-13 were adopted by the
Land Conservation and Development Commission on January 29, 1999, and became effective
February 12, 1999. DLCD granted Deschutes County a time extension to make the required zoning
changes until January 31, 2001.
Significant changes include the specific "imaginary surface" dimensional standards called -out for
each airport, the recognition of proposed Redmond Airport expansion projects, and the inclusion
of noise impact and FAA notification area boundaries.
The original Airport Height Combining Zone identified individual "imaginary surfaces", but their
dimensions were all based on the Bend Airport runway. The new AS Zone has specific boundary
dimensions that relate to each individual airport based on requirements from the Oregon

Quality Services Performed with Pride
Department of Aviation. For planning purposes, the proposed extension to Redmond's Runway 4-
22, and the construction of a new parallel Runway 4L -22R were considered in establishing the
imaginary surfaces. This was done to better identify appropriate locations for incompatible uses that
may be placed around the Redmond Airport.
The Federal Aviation Administration (FAA) has certain notification requirements for new construction
in the vicinity of public -use airports. The maps identify the FAA boundary, while the Ordinance
specifies how and when the FAA is notified.
Measure 56 notices were mailed to approximately 1,500 property owners countywide that previously
had no airport -specific safety zoning applied to their property, but will now come under the new
Airport Safety Combining Zone.
Staff held a worksession with the County Planning Commission on October 12, 2000, and a public
hearing on October 26, 2000. Of the approximately 20 citizens who attended the hearing, three
spoke. None were in opposition to the draft ordinances, but were mainly interested in clarifications
and/or had some suggested changes. Comments by the Planning Commission at the October 12t�'
worksession were incorporated into the text of the draft Airport Safety Combining Zone. Staff also
received a comment letter on October 31 from Carolyn Novick, the Redmond Airport Manager. Staff
has incorporated the changes identified in Ms. Novick's letter into the draft zone text as well.

http://newberry.deschutes.or.q under the Transportation page of Community Development.

This office has conducted a review of the Deschutes County zoning ordinance, relative to
airports, and has the following comments:
1. The only public use airports directly referenced in the zoning ordinance were Bend and
Redmond. Sisters and Sunriver airports should also be included and zoning established
for aJI public use airports.
2. A copy of a letter dated August 24, 1987, which was sent to Chuck Stevens, Policy and
Planning. ODOT, has been enclosed. This letter should have been sent to your office and
the comments are still valid.
3. Section (4) Use Limitations. (A) while the 35 foot height restriction is excellent there should
be some mention in the zoning ordinance that the imaginary surfaces for the airport should
not be penetrated. ie: 35 foot height or applicable Part 77 surface elevation, whichever is
lower.
4. Section (8) Design and Use Criteria.. D. While this statement addresses noise in a general
way, specific language should be developed to more dearly define anticipated noise
impact areas and compatible land uses in these areas. The Model Airport Overlay Zones
sent to your office on July 6,1990 contains language covering this subject
S. Section 4.170 Airport Height Combining Zone. A -H. Permitted and conditionally permitted
uses in dose proximity to Vie airport should be approved in consideration of receipt of an
Overflight and Noise Hold Harmless Agreement from the proponent This agreement
should be filed in the County deed records and will provide disclosure of aircraft overflight
potential to future property owners.
6. Section 4.170 (6) (B) Height Limitations. The third paragraph of this letter is applicable to
this section also.
7. Section 4.170 (6) (B) (4) The height of 3602 feet should be deleted from this section as this
elevation will change from airport to airport or will have to be identified for each of the four
airports.
8. Section 4.170 (B) (7) Lighting and marking language should be inserted in this section to
conform to State requirements. Language is included in Model Zoning ordinances to
cover this subject

9. Your attention is also directed to the FAA Form 7460-1, Notice of Proposed Construction or
Alteration. You should include the slope requirements of this federal program in your
zoning documents to ensure that future builders have met these requirements.

SUBJECT: Responses for LCDC Periodic Review
Cottage Grove State Airport
Although the Cottage Grove State Airport is not within the city
limits, portions of the airports imaginary surfaces extend over
sections of the city of Cottage Grove. The city needs to amend
its zoning ordinance to include these imaginary surfaces and
depict them on the zoning map. A letter from the Oregon Aeronau-
tics Division dated August 21, 1981, was forwarded to Mr. Howard
Schusser, City Planning Director, with a map of airport conical
surfaces, a sample zoning ordinance and Airport Compatibility
Guidelines dated 1981 included.
Prineville Crook County
The airport's section of the Plan Policies, pages 97 and 98, needs
to be updated to reflect current conditions. Paragraph 7 of the
transportation element (Goal 12) refers to a Master Plan in the
process of being prepared. This paragraph should be updated. The
Update Item of Goal 12 should be changed to reflect current
status.
Planning documents did not identify a specific Airport Master Plan
or alternately refer to a current Airport Master Plan adopted by
the governing body. -
Deschutes County Airports
Comments on the Airports Section of the Deschutes County Transpor-
tation Element amended June 25, 1986 are as follows:
1. Deschutes County should. establish noise Zoning applicable
to" ail public -use airports. in the county to identify uses
appropriate in noise impacted areas.
2. Planning documents should be updated to reflect current
conditions; specifically item 29 of the Transportation
Element should either refer to the 'current' Airport

dated 1981. Section 4.160 Airport Development Zone, AO
(1) Purpose, on page 72, should be updated to reflect
current conditions as they relate to adoption of the Bend
Airport Master Plan or the Comprehensive Plan.
3. Section 4.170, on page 77, of the Zoning Ordinance should
not refer to a specific height of 3602 feet above mean sea
Tevel. The reference to a given elevation above sea level
should be deleted since this would not be the same for all
airports in the county. References to elevations should
be in terms of height above runways when referring to more
than one airport.
City of Sisters Comprehensive Plan:
A letter dated May 189 1987 (copy attached) was sent to Mr. Greg
Wolfe discussing the need to develop a plan to provide for ob-
struction -free approaches to the Eagle Air Airport and protect the
imaginary surfaces surrounding the airport. It is suggested that
Deschutes County may want to amend its zoning ordinance to include
these imaginary surfaces for the Eagle Air Airport and depict them
on County Zoning Maps.

PERIODIC REVIEW WORK PROGRAM MODIFICATION (ORDER No. 001246)
Dear Geralyn:
This letter is in response to your August 3, 2000 letter requesting that the county's periodic
review work program be modified to more accurately reflect application of the Land
Conservation and Commission's new rules addressing the supreme court's Cutty County
decision for rural residential lands (OAR 660-004-0040) and changes to the county's Regional
Problem Solving submittal. This letter is an order approving the county's request.
As a result of the Commission's recent adoption of amendments to OAR 660-004-0040,
work related to adopting Goal 14 findings for the RR -10 and MUA-10 Zones can now be
deleted. The county's existing RR -10 and WA- 10 zoned areas comply with these new rules,
and thus, the county no longer needs to justify its rural residential zoning in periodic review.
As a result of these modifications, amendments to other work tasks and submittal dates are made
to align the county's regional problem solving project with periodic review. These changes are
reflected in the attached Periodic Review Work Program Summary.

providing me additional time to comment on it. This is a huge undertaking and I would like to
take this opportunity to applaud you for your effort. This is a complex issue and you have done
an outstanding job.
I have provided you a recently published copy of the 2000 Oregon Aviation Plan published by
the Oregon Department of Aviation for future reference. The department also has a copy of the
Redmond Airport Master Plan adopted by the Redmond City Council in December 1997, and
approved by the FAA..
After review of the Draft of Ordinance NO. 2000-022 I suggest the following changes:
1. Some location in the document it should state that Redmond Airport is owned and operated
by the City of Redmond and that it is located within the city limits of Redmond. Just to alleviate
any confusion of how Bend Airport is operated (physically located in the county but operated by
the City of Bend).
2. Page 3 number 14. Conical Surface should be changed, its not the same for every airport in
the county. Redmond Airport has a precision ILS Approach to Runway 22, the horizontal
surface slope of that runway is 50:1 and for Runway 4 I believe its 40:1.
3. Page.33 number 23. I think the sentence should read: " NON -TOWERED AIRPORT. An
airport without an operating Air Traffic Control Tower." I have not seen or read anything that
makes any reference to a date.
4. Page 3 number 26. Precision Instrument Runway. In other portions of the glossary you
reference airports in the region and indicate types of runways or approaches, Redmond Airport
has a precision ILS Approach to Runway 22

5. Page 6 number 3 of 18.80.028 Height Limitations on allowed Uses in Underlying Zone.
I believe that it should state that the practice os issuing a height variance should be discouraged
and that the person/company filing the request is required to submit a 7460-1 to the Airport
Manager or if there is none a designee of the airport sponsor as required by FAA. The Airport
Manager or designee submits to the FAA Airports Division in Renton, WA for review. Any
building permit should be withheld until this has been returned to the sponsor and the individual.
The process takes approximately 60 days.
6. Page 6. 18.80.030 Redmond Municipal Airport_ To match the description by the State
Aviation Department the description of Redmond Airport should say "Redmond Airport is a
Commercial Service Airport. Its function is to accommodate scheduled major/national or
regional commuter commercial air carrier service."

attend the meeting with Commissioners due to a meeting conflict with the State Aviation Board.

Steve: I have just assembled the Model Airport zoning ordinances on the
computer for sending to Cities and Counties. I have sent these along for you
to compare with your proposed zoning for the county. These models were
developed under contract to our offices by Mark Greenfield, a land use
attorney who has been closely associated with their development over the
past 5 1/2 years. They have been reviewed by the State Attorney General's
office, our office and by LCDC for compliance with the statutes and OARs.
They are considered minimums; your zoning may be more restrictive (i.e.
protect airports more completely) than outlined in the models.
