DESCHUTES COUNTY BOARD OF COMMISSIONERS
MONDAY, MARCH 5, 2001
Acting Chair Mike Daly opened the meeting at 10:10 a. m.
Present were Commissioners Dennis Luke and Mike Daly; Commissioner Tom
De Wolf was excused. Also present were George Read, Geralyn Haas, and Kathy
Tilton of Community Development; Jim Bonnarens, Property Management; Rick
Isham and Laurie Craghead , Legal Counsel; Mike Maier, County Administrator;
and Ted Schassberger and Jenny Scanlon, Commissioners' Office.

4. Before the Board was a Discussion and Consideration of Approval of Issuing
a Temporary Use Application for the Oregon Department of Transportation
for Crushing of Stockpiled Materials from a Non-contiguous Parcel for Use
on the Bend Parkway.
George Read and Kathy Tilton explained that the location to be used by ODOT is
off Scalehouse Road, southeast of Bend, and it has been used for years by ODOT
to screen and crush cinders that are used mainly for spreading on icy roads. They
would now like to use this site to screen and crush rock for use on the parkway
and elsewhere. A conditional use permit is needed to crush rock instead of
cinders, and it takes six to ten weeks for an application to go through the process.

They further explained that the criteria for a temporary use permit typically
would require notice, but since this project is not going out for bid, the Board of
Commissioners authorize the issuance of this permit. Several conditions are to
be met, including that the application needs to be approved in the form permitted;
and there must be a demonstrated need and good cause.
Commissioner Luke stated that he is a member of the Central Oregon
Transportation Advisory Committee, which has already voted to approve this
project. He asked Legal Counsel if that presents a conflict of interest. Rick
Isham advised that he sees no problem with this situation, and it would only be a
problem if Commissioner Luke had financial or personal gain resulting from this
action.
Kathy Tilton explained that one of the criteria for issuing the permit is that notice
is normally required for residences that are located less than'/2 mile from the site.
One of the three homes was built before the ordinance was passed that requires
notice. However, the property owner of two of the homes has his own rock -
crushing site on his property already.
(A general discussion occurred between the Board, Community Development and
representatives of ODOT regarding noise standards, the surrounding terrain and
trees, etc.)
George Read stated that no complaints have been received regarding previous
work performed at the site. He also said that the only options available if this site
is not approved is for the crushing to be done in other locations that would
necessitate heavy truck traffic going through Bend. He asked that the Board
approve the temporary use of this site due to a tight timeframe involved, as it is a
reasonable request.
LUKE: I move approval of the temporary use permit, with the conditions
outlined by staff.

5. Before the Board was a Discussion and Consideration of the Sale of Unused
Computer Equipment to Umatilla County.
Mike Maier explained that this equipment needs to be declared as surplus and
its sale authorized.
LUKE: I move approval that this computer equipment be declared surplus and
be sold accordingly.

Being no further action taken, Acting Chair Mike Daly adjourned the meeting at
10:45 a.m.
