2001-883-Order No. 2001-121 Recorded 12/7/2001COUNTY OFFICIAL D MARYHSUE SPENHOLLOW, COUNTYRCLERKS y� 1Q41 -d63 COMMISSIONERS' JOURNAL ,V, -, 12/07/200101:37:52 PM �fXL COUNSEL BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON An Order Establishing Rural And Distant Rural Franchised Solid Waste Collection Areas And Setting Collection Rates ORDER NO. 2001-121 WHEREAS, Companies holding County franchises to collect solid waste within unincorporated areas of Deschutes County, Oregon have requested a rate increase in accordance with County policy; and WHEREAS, State law has set a 45% diversion rate goal for Deschutes County; and WHEREAS, Establishing Rural and Distant Rural Collection Areas in unincorporated areas of Deschutes County will facilitate future implementation of recycling services in order to increase diversion; and WHEREAS, Establishing uniform collection rates in collection areas is consistent with County policy; and WHEREAS, The Administrator has reviewed the rate request and made recommendations regarding rates and collection areas to the Board of County Commissioners; and WHEREAS, The Board of County Commissioners has reviewed the proposed adjustments and the Administrators recommendation; now, therefore, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, as follows: Section 1. The Rural Collection Area and Distant Rural Collection Area set forth in Exhibit A, attached hereto and by this reference incorporated herein, are hereby approved. Section 2. The maximum rates for the collection of solid waste within the unincorporated area of the Rural Collection Area set forth in Exhibit B, attached hereto and by this reference incorporated herein, are hereby approved. Section 3. The maximum rates for the collection of solid waste within the unincorporated area of the Distant Rural Collection Area set forth in Exhibit C, attached hereto and by this reference incorporated herein, are hereby approved. The service fees shall be the same as those charged for uncompacted containers. Exhibit D Franchise Collection Reporting and Rate Setting Policies 1. County will set a maximum collection rate for the Rural Service Area and the Distant Rural Service Area. Maximum rates in each service area will be uniform for all county franchise holders. 2. Franchises will submit to the Administrator separate annual revenue and expense reports for the Rural Service Area and Distant Rural Service Area when the company's franchise area contains both service areas. Franchises will submit to the Administrator a copy of the company rate schedule in effect during the reporting year for each service area their company services. The rate schedule shall be submitted at the time of the annual report submittal. 4. Franchises may not adjust rates within the maximum allowed rate prior to County approval. Requests for rate adjustment will be made at the time of annual report submittal, and should include sufficient historical data and/or projections to justify a rate adjustment.
