WHEREAS, a petition requesting annexation of territories into the La Pine Water District was duly filed with the Board of County Commissioners of Deschutes County, Oregon ("Board") on November 28, 2001 (New Neighborhood); and, WHEREAS, the Deschutes County Assessor's Office has verified that the annexation petition were signed by 100 percent of the real property owners within the areas to be annexed; and WHEREAS, a public hearing was duly noticed and held on January 3, 2002, to hear the petition and any objections thereto, and to determine whether, in accordance with the Comprehensive Plan, applicable Land Conservation and Development Goals and the criteria prescribed by ORS 199.462 and 198.805, the affected area would be benefited by annexations of said territory into the La Pine Water District; and WHEREAS, after consideration of economic, demographic and sociological trends and projections pertinent to the proposal, past and prospective physical developments of the land that would directly or indirectly be affected by the proposals, and all other matters considered to be relevant to the petitions, the Board is of the opinion that the area would be benefited by annexation of the said territories to the said district; now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, HEREBY ORDAINS as follows: Section 1. That the New Neighborhood petition for annexation into the La Pine Water District is approved. Section 2. That the boundaries of the territories annexed to the said district are as set forth in Exhibit A and depicted on the map marked Exhibit B, attached hereto and by this reference incorporated herein, and shall be known as the "New Neighborhood Annexation." Section 3. That the applicable land use criteria pertinent to the proposed Annexation, the facts found by the Board and the reasons why the Board believes those facts to bring the proposals within the requirements of the applicable land use criteria are described in Exhibit C, attached to hereto and by this reference incorporated herein. Section 4. That the territories included in the New Neighborhood Annexation are declared to be annexed into the La Pine Water District as of the date of this Order. That after signature, a copy of this Order shall be forwarded to the Oregon Department of Revenue, Deschutes County Assessor's Office, Deschutes County 911 County Service District and La Pine Water District. Section 6. The purpose of this District is to provide fire protection services within the District. Under the Public Facilities and Services section of the County Comprehensive Plan, on page 159-160, General Policies, is the following policy: 5. Deschutes County shall encourage the formation of special service districts to serve rural needs rather than becoming involved with serving those needs. The County will foster coordination and mutual planning between the County, special districts, utility companies and service corporations. This shall include common trenching where appropriate. Additionally, the La Pine Urban Unincorporated Community Plan Policies lists the following policy on page 91 of the Plan: 3. The County shall support the development, redevelopment and expansion of a single domestic water system maintained and operated by the La Pine Water District so that cumulative development will not result in public health hazards or adverse environmental impacts that violate state or federal water quality regulations. The La Pine Water District should annex all land within the UUC boundary. It is clear that a reliable and up to standards water system is an important aspect of rural development, as evidenced by the above policies and the overall comprehensive plan. Staff finds that the proposed annexation to the La Pine Water District is consistent with the County Comprehensive Plan and Statewide Planning Goals. EXHIBIT C Quality Services Performed with Pride
