Luke MINUTES OF MEETING Mike Daly DESCHUTES COUNTY BOARD OF COMMISSIONERS WEDNESDAY, JANUARY 30, 2002 Commissioners' Hearing Room - Administration Building Present were Commissioners Tom De Wolf and Michael M. Daly. (Commissioner Dennis R. Luke was unable to attend.) Also present were Mark Amberg and Laurie Craghead, Legal Counsel; Steve Miller, Community Development; Jenny Scanlon, Commissioners' Office; Media Representatives Dana Walters and Libby Bouvien of Z-21 TV, Mike Cronin of the Bulletin; and no citizens. Chair Tom De Wolf opened the meeting at 10:05 a.m. 1. Before the Board was Citizen Input. None was offered. 2. Before the Board was a Public Hearing and Consideration of Adoption of Ordinance No. 2002-015, a Text Amendment to Sections 18.61.030 of Title 18 of the Deschutes County Code (File No. TA -02-2) Relating to Height Restrictions in the La Pine Business & Industrial Park. Steve Miller requested that this be continued. Additional information has been received from Midstate Electric, and a meeting has been set up to discuss this information. He indicated he would take care of the notice requirements at the appropriate time. Laurie Craghead indicated this should make the process go a little smoother. 3. Before the Board was a Public Hearing and Consideration of Signature of Order No. 2002-006, Approving the Garland Annexation into the Deschutes County Rural Fire Protection District #2. Minutes of Board of Commissioners' Meeting Page 1 of 4 Pages Wednesday, January 30, 2002 Quality Services Performed with Pride Laurie Craghead indicated this was approved by the Board on Monday, but shouldn't have been due to the public hearing scheduled for today. She said she will submit into the record the testimony of Tom Fay given on Monday regarding there being no opposition, and that the district supports this annexation. A notice had also been posted in the district, and a copy of a letter from Community Development has been entered into the record, indicating they have no problem with this. As required, there is also a letter from the Department of Forestry indicating its support. Notices were published in the Bulletin newspaper and were posted in the three locations as required. Chair Tom De Wolf then opened the public hearing. Being no comments offered, Chair De Wolf then closed the public hearing. DALY: Move signature of Order No. 2002-006. DEWOLF: Second. VOTE: DALY: Yes. DEWOLF: Chair votes yes. CONVENED AS THE GOVERNING BODY OF THE 9-1-1 COUNTY SERVICE DISTRICT 4. Before the Board was Consideration of Approval of Weekly Accounts Payable Vouchers for the 9-1-1 County Service District in the Amount of $3,714.82. DALY: Move approval, subject to review. DEWOLF: Second. VOTE: DALY: Yes. DEWOLF: Chair votes yes. CONVENED AS THE GOVERNING BODY OF THE EXTENSION/4-H COUNTY SERVICE DISTRICT 5. Before the Board was Consideration of Approval of Weekly Accounts Payable Vouchers for the Extension/4-11 County Service District in the Amount of $8,543.45. RECONVENED AS THE DESCHUTES COUNTY BOARD OF COMMISSIONERS 6. Before the Board was Consideration of Approval of Weekly Accounts Payable Vouchers for Deschutes County in the Amount of $445,742.15. DALY: Move approval, subject to review. DEWOLF: Second. VOTE: DALY: Yes. DEWOLF: Chair votes yes. 7. ADDITION TO THE AGENDA Tom DeWolf indicated he has an addition resulting from a letter he received from Becky Jackson, Director of Parole and Probation; a press release will go out today on this issue. He said the Board has put Parole and Probation as a stand- alone department, with Becky Jackson as Director. He explained that one operational detail is the authority of Parole and Probation officers who have received the proper training to have the authority to carry firearms while engaged in their legal duties. As a result, he asked Legal Counsel to prepare the appropriate motion. DEWOLF: I move that, pursuant to the provisions of Oregon Revised Statute 166.263, Deschutes County Parole and Probation officers are authorized to carry firearms while engaged in official duties of their office so long as each officer authorized to carry firearms has met the requirements of ORS 166.263 as determined by the Director of the Deschutes County Parole and Probation Department. Minutes of Board of Commissioners' Meeting Page 3 of 4 Pages Wednesday, January 30, 2002 Commissioner Daly asked if this is needed because Parole and Probation officers will no longer be Deputy Sheriffs. Chair DeWolf replied that the Director of Community Justice has been the "employer". When Dennis Maloney moved to a half-time position with the Federal Government, the Sheriff became the authority. Mark Amberg added that the Parole and Probation officers were never Deputy Sheriffs. They were supervised by the Sheriff, and while they were under his supervision he authorized them to carry firearms. This motion is needed now as a housekeeping item. VOTE: DALY: Yes.
