BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON
An Order Establishing a Designated Speed of 35 mph on
all of Butterfield Trail located in the Second Addition to
Conestoga Hills, Deschutes County, Oregon
ORDER NO. 2002-029
WHEREAS, pursuant to ORS 810.180 paragraph (8), Section(a), the Board of County
Commissioners as a road authority have been delegated authority by the Oregon Department of
Transportation designate reasonable and safe speeds on low volume or not hard surfaced County roads;
and
WHEREAS, the County exercises its authority according to criteria adopted by the Oregon
Department of Transportation; and
WHEREAS, that portion of Butterfield Trail lies outside the corporate limits of any city; and
WHEREAS, it appears that a safety necessity exists on all of Butterfield Trail; now therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON ORDERS
as follows:
Section 1. The designated speed of 35 mph be assigned to all of Butterfield Trail.
Section 2. That the County Road official erect appropriate signing according to ORS
810.200 requirements giving notice of the established speed.
Section 3. That any previous order with respect to the designated speed for the above road
which is in conflict with the provisions of this order is hereby rescinded.

My name is Dave Fiore, and I am the chairman of the Conestoga Hills
Homeowners Association. Recently, I surveyed all 74 homeowners who
currently reside in our subdivision. Nearly 54 surveys were returned to me. Of
those, ninety percent of the homeowners were concerned about the speed of
vehicles in the subdivision. On behalf of the people I represent, I am requesting
that the Deschutes County Road Department conduct appropriate studies to
establish a speed limit on the streets within Conestoga Hills subdivision.
As an association we are concerned that under current conditions that the
vehicles traveling through the subdivision at speeds reaching 50-60 MPH
threaten and endanger residents, wildlife, and other motorists alike. The roads in
our development are narrow, have no shoulders, or shoulders that are sloped
and irregular, no sidewalks, and for the most part have no designated lane
markings, and no designated crosswalks. The intersections in many cases have
limited visibility based upon the terrain and the road design. Our community is
made up of single family residences with any number of children and pets
occupying the streets at any given time. Additionally, we are directly in a deer
migration zone and one of our residents recently struck an elk.
We realize that engineering studies involving traffic and speed counts may be
required and can take time. We are doing what we can to slow residents down.
Perhaps even "Children at Play" or "Slow" signs could help improve this
dangerous situation. Itis my understanding that ORS 811.100 states: "a person
commits the offense if the vehicle is being driven at a speed greater than is
reasonable and prudent." Using this Basic Speed Rule as our guide, we believe
that a speed limit of 30-35 MPH is more appropriate on the roadways of our
neighborhood.
We respectfully request that the County undertake the necessary engineering
reviews so that a measure of safety can be returned to our neighborhood
roadways. Thank you for your anticipated cooperation. If you have additional
