Luke MINUTES OF WORK SESSION Mike Daly DESCHUTES COUNTY BOARD OF COMMISSIONERS MONDAY, FEBRUARY 11, 2002 Administration Building - 1130 NW Harriman St., Bend Present were Commissioners Tom De Wolf, Dennis R. Luke and Michael M. Daly. Also present were Mike Maier, County Administrator; Tom Blust, Gary Judd and George Kolb, Road Department; Kelley Jacobs and Bob Lacombe, Juvenile Justice; Dave Duncan, Mental Health Department; and George Read, Catherine Morrow, Ed Pecoraro and Doreen Blome ; Community Development. Also attending were Timm Schimke, Solid Waste Department; Walt Schloer, U. S. Forest Service; Media Representatives Barney Lerten of bendnet. com and Mike Cronin of the Bulletin; and one citizen. Chair Tom De Wolf opened the meeting at 10: 02. 1. Before the Board was Citizen Input. None was offered. 2. Before the Board was a Discussion of the Reading of a Proclamation, Declaring March 1, 2002 "Read to Kids Day" in Deschutes County. This proclamation will be read at Wednesday's Board meeting. 3. Before the Board. was Consideration of Approval of a Deed of Dedication (Document No. 2002-051), Dedicating a Strip of County -owned Land off Spruce Avenue to the City of Redmond. Minutes of Work Session Page 1 of 7 Pages Monday, February 11, 2002 Quality Services Performed with Pride Kip Burdick of the City of Redmond Public Works gave a brief overview of the property, which is needed for a right-of-way. It is a small, separate piece of land that might have resulted due to an old surveying error. Tom Blust indicated the Road Department has no problem with this dedication. LUKE: Move approval. Before the Board was Discussion and Consideration of the First Reading of an Ordinance (Scheduled for Wednesday, February 13) Regarding a Text Amendment to Title 9 of the Deschutes County Code, Reflecting the Addition of Federal Land to the Deschutes River Corridor Restricted Area ("No Shoot Zone"). Doreen Blome' and Walt Schloer explained that this is the culmination of a public meeting on the General Patch Bridge area, which is to be a no -shoot zone for the public safety and welfare, per the U. S. Forest Service. When the maps were last updated, it was noted that these map areas need to be corrected to reflect the changes the Forest Service made in the corridor. 5. Before the Board was Discussion and Consideration of Approval of One New Track -type Tractor for Use in Landfill Operations (Budgeted). Timm Schimke gave a brief overview of this purchase, which is being handled under a buy-back with guaranteed repairs. He said the required funds are available in the budget and through the contingency fund. 6. Before the Board was Discussion and Consideration of Signature of Order No. 2002-028, Setting a Speed Zone Designation of 35 MPH on Bozeman Trail; 7. Discussion and Consideration of Signature of Order No. 2002-029, Setting a Speed Zone Designation of 35 MPH on Butterfield Trail; Minutes of Work Session Page 2 of 7 Pages Monday, February 11, 2002 8. Discussion and Consideration of Signature of Order No. 2002-030, Setting a Speed Zone Designation of 35 MPH on Chisholm Trail; 9. Discussion and Consideration of Signature of Order No. 2002-031, Setting a Speed Zone Designation of 35 MPH on Pine Vista Drive; 10. Discussion and Consideration of Signature of Order No. 2002-032, Setting a Speed Zone Designation of 35 MPH on Tall Pine Avenue; and 11. Discussion and Consideration of Signature of Order No. 2002-035, Setting a Speed Zone Designation of 30 MPH on Lazy River Drive. Regarding Agenda Items #6 through #11, Gary Judd explained that these speed zones were initiated by residents, and fit the criteria for the County to form and enforce the zones. He further said that residents on Woodside Drive also wanted the County to form a speed zone, but since there is a traffic count of over 500 cars per day, this request must go to the state. 12. Before the Board was Discussion and Consideration of Chair Signature of Amendment #18 of the 2001-2003 County Financial Assistance Agreement between the State of Oregon and Deschutes County, Authorizing Additional Funding for Mental Health Services (Document No. 2002-052); 13. Discussion and Consideration of Signature of a CDO Sub -Contract with Bestcare Treatment Services for Mental Health Services (Document No. 2002-053); 14. Discussion and Consideration of Signature of a CDO Sub -Contract with Central Oregon Extended Unit for Recovery, Inc. (Rimrock Trails Adolescent Treatment Services) for Mental Health Services (Document No. 2002-054); 15. Discussion and Consideration of Signature of a CDO Sub -Contract with Pfeifer & Associates, Inc. for Mental Health Services (Document No. 2002- 055); 16. Discussion and Consideration of Chair Signature of an Intergovernmental Agreement (Document No. 2001-187) between Deschutes County and Central Oregon Regional Housing Authority, to Encourage the Development of Safe, Decent and Affording Housing; and Minutes of Work Session Page 3 of 7 Pages Monday, February 11, 2002 17. Discussion and Consideration of Chair Signature of an Intergovernmental Agreement with Oregon Department of Human Services (Document No. 2002-057), Amending Various Provisions relating to Family Treatment Services. Regarding Agenda Items # 12 through # 17, the Board asked Dave Duncan to provide a more complete and clear explanation of the items prior to Wednesday's Board meeting. 18. Before the Board was Discussion and Consideration of Chair Signature of Oregon Health Division Grant Revision No. 6 (Document No. 2002-056), Providing Additional Funds for HIV Prevention and Intervention Efforts. The Board asked for a more complete explanation of this item prior to Wednesday's Board meeting. 19. Before the Board was Discussion and Consideration of Approval of the CYIP (Community Youth Investment Program) Improvement Plan. Chair DeWolf explained that Judges Tiktin and Forte, Ernie Mazorol, Scott Johnson, Kelley Jacobs and Bob LaCombe had worked through this plan tot he satisfaction of the courts; timelines are still to come. Kelley Jacobs said they will meet in the next couple of weeks, and will incorporate this information in the manual. A general discussion then took place regarding budget implications and how staffing will be handled. LUKE: Move approval of the CYIP Improvement Plan, effective February 6. DALY: Second. Before the Board was Discussion of a Public Hearing and First Reading (Scheduled for Wednesday, February 13) of Ordinance No. 2002-011, Amending Title 15.04 of the Deschutes County Code, Building and Construction Codes and Regulations (regarding Water Districts). Catherine Morrow stated that there are two sections, the Terrebonne Water District and Central Oregon Irrigation District. In essence, the ordinance would require that new construction must be hooked up to domestic water service unless the district cannot provide this service; and they must provide this explanation in writing. A discussion then occurred regarding the use of an alternate system, such as an existing private well; and whether a hookup would be required for an addition to an existing residence or for the construction of an outbuilding. Ms. Morrow further explained that the Terrebonne district eventually wants to provide all domestic water service, and that there is a section in the Code, Chapter 13, regarding water quality and the use of cisterns. The County would deny new building permits, and would notify the districts accordingly. The districts are concerned that they can't support their infrastructure without the revenue generated by new hookups. George Read indicated that the County has never regulated water haulers. Basically, the Federal government wants the states to be responsible for safe domestic water through the Federal Safe Drinking Water Act. The State has the authority to comply, but the state has handed this off to the districts. The districts would like the County to act as the enforcement agency. There are likely 500 or more people in Deschutes County still drinking ditch water. He recommended the County do simply what is required by law. 21. Before the Board was Discussion and Consideration of Signature of Order No. 2002-036, Approving the Notice of District Measure Election and Explanatory Statement for the Spring River Special Road District for the May 21, 2002 Primarily Election Ballot, and Ordering Publication Notice. Before the Board was Discussion of the Final Public Hearing on the Formation of the Sunriver Service District. Laurie Craghead explained that she is waiting for further information from Sunriver. This hearing is scheduled for Wednesday's Board meeting in Sunriver. 23. Before the Board was Discussion and Consideration of Signature of Deschutes County Policy No. P-2002-093, Regarding County -Issued Credit Cards (Sheriffs Office). Mike Maier said that this procedure is currently being utilized by the Sheriff s Office, but was never put into policy form. 24. Before the Board was Discussion and Consideration of Signature of Resolution No. 2002-007, Appropriating New State Grant Funds for Mental Health - Community Corrections Programs. Chair DeWolf asked for more information on this item prior to Wednesday's Board meeting. 25. Before the Board was Discussion and Consideration of Signature of Resolution No. 2002-009, Appropriating New Federal Grant Funds for the Commission on Children & Family's Drug-free Communities Programs. Chair DeWolf also asked for more information on this item prior to Wednesday's Board meeting. 26. Before the Board was Discussion and Consideration of Signature of Order No. 2002-034, Transferring Cash among Various Funds as Budgeted in the Fiscal Year 2001-2002 Deschutes County Budget, and Directing Entries. This was placed on the Consent Agenda. 27. Before the Board were Additions to the Agenda. None were offered.
