2002-788-Resolution No. 2002-029 Recorded 4/12/2002RE LE SEL COUNTY OFFICIAL MARYHSUE SPENHOLLOW, COUNTYRCLERKS CJ 2002-788 COMMISSIONERS' JOURNAL 04/12/2002 01;10;44 PM For Recording Stamp Only BEFORE THE BOARD OF COMMISSIONERS OF DESCHUTES COUNTY, OREGON A Resolution by Deschutes County and the City of Redmond to Sponsor an Application for Electronic Commerce Status for the Enterprise Zone * RESOLUTION NO. 2002-029 * WHEREAS, In 1998, the City of Redmond and Deschutes County successfully applied for an enterprise zone, which was designated as the Redmond Enterprise Zone by the Director of the Oregon Economic and Community Development Department, effective on June 30, 1998, which has a total area of 10.53 square miles; WHEREAS, This Enterprise Zone and the three to five-year exemption on property ad valorem taxation that it offers for new investments in plant and equipment by eligible business firms are critical elements of local efforts to increase employment opportunities, to raise local incomes, to attract investments by new and existing businesses and to secure and diversify the local economic base; WHEREAS, Under chapter 957, Oregon Laws 2001 (SB 229), the sponsor of an enterprise zone may request to be designated for electronic commerce, which will expand investments eligible for the exemption, as well as offer a special State income/excise tax credit to further induce such investments. WHEREAS, Under ORS 285B.672, this request takes the form of a resolution and application from the sponsor to the Oregon Economic and Community Development Department which is authorized to approve not more than four such electronic commerce designations. WHEREAS, Officials of the City of Redmond and Deschutes County are agreed in requesting the electronic commerce status for the Redmond Enterprise Zone; WHEREAS, Redmond is one of the fastest growing communities in the State of Oregon, with annual growth currently exceeding 11 percent. The majority of that growth can be attributed to increases in the housing sector. Employment growth on the other hand has been substantially slower, with rates around 5 percent. The City of Redmond, together with its public and private partners has developed an aggressive program to address this disparity. The current Enterprise Zone is an important part of this program, addition Electronic Commerce status would further enhance the Enterprise Zone; and WHEREAS, the Enterprise Zone helps the City of Redmond but Electronic Commerce status would give us additional economic development tools to provide a j obs/housing balance for the community. This would also help to relieve traffic commuting problems in the region. Redmond needs any economic development advantage in order to accomplish this goal. WHEREAS, Neither designation of an enterprise zone nor electronic commerce status grants or implies permission to develop land within the Zone without complying with all prevailing zoning, regulatory and permitting processes and restrictions of any and all local jurisdictions, nor is any public intent to modify those processes or restrictions indicated by any such State designation or the local application therefor, unless otherwise in conformance with applicable comprehensive land use plans. THEREFORE, BE IT RESOLVED THAT: Section 1: The City of Redmond and Deschutes County requests as a sponsor of the Redmond Enterprise Zone that the Director of the Oregon Economic and Community Development Department designate this Zone for electronic commerce in accordance with ORS 285B.672; For purposes of electronic commerce status if granted, the sponsor of the Redmond Enterprise Zone hereby commits to act as the effective zone sponsor and take responsibility for all duties of a zone sponsor as they apply to any business firm seeking to utilize areas of the city for special Electronic Commerce benefits. Section 2: The Deschutes County Board of Commissioners finds that it is in the best interest of the County to enact this resolution immediately upon passage of this resolution; and therefore, this resolution shall be effective upon the date of passage. �j DATED this / day of 2002.
