Luke MINUTES OF MEETING Mike Daly DESCHUTES COUNTY BOARD OF COMMISSIONERS WEDNESDAY, MAY 89 2002 Commissioners' Hearing Room - Administration Building 1130 NW Harriman St., Bend Present were Commissioners Tom De Wolf, Dennis R. Luke and Michael M. Daly. Also present were George Kolb, Road Department; George Read, Catherine Morrow and Christy Morgan, Community Development; Les Stiles, Sheriff; Laurie Craghead, Legal Counsel; Dan Peddycord and Rachel Woods, Health Department; Media Representatives Jeff Mullen of KBND Radio and Mike Barney Lerten of bendnet.com; and 24 other citizens. Chair Tom DeWolf opened the meeting at 10:00 a.m. 1. Before the Board was Citizen Input. A. Jackie Faulkner of Bend said that several months ago she spoke with Commissioner Daly regarding public safety ordinances for the Bend Airport. She further stated that Commissioner Daly appeared not to believe her, but she showed him copies of them, even though they had been rescinded by the City some years ago. She expressed displeasure at the fact that the Palms to Pines Race has been held in Bend before, and appeared again last year without the permission of the City of Bend. She said the planes fly very low over the airport, and she feels this is a hazard. She further said that she was under the impression that Commissioner Daly has been appointed to a group to help set policies for aviation. She stated that she feels policies need to change, that these pilots disregard all aspects of safety and get away with it. Ms. Faulkner said that on August 17 air racers are coming to town again, with 80 or more planes. She is trying to keep them out and will be picketing the event. Commissioner Daly stated that they have every right to be there as long as they follow the rules. Ms. Faulkner responded that the FAA says that the pilots can do this at any altitude they want. She has been encouraging the City to get a safety ordinance against the, but the City says there are legal problems with this. Chair DeWolf stated that it is a City airport, and the County has no authority over it. She once again asked the Commissioners to show up at the August 17 function. B. Steve Dougherty then asked if the County had turned down Duke Energy. Commissioner Luke said yes, that it was in all the papers, but that all it entailed was an offer from Duke Energy on a piece of County -owned property. C. Chair DeWolf announced to the audience that the National Association of County Information Officers, part of the National Association of Counties organization, gave annual awards recently, and Deschutes County won several awards: a superior (the highest) award in the category of a Series of Photographs for the Commission on Children & Families' "Through the Eyes of a Child" calendar project; a superior award in the category of Public Participation Projects for the Deschutes County Community Plan; and an excellent (the next highest) award for a Public Safety Announcement regarding the SMART Reading Program. 2. Before the Board was the Reading of a Proclamation Declaring May 12 through 18 Peace Officers Memorial Week in Deschutes County. Sheriff Les Stiles stated this Proclamation is modeled after an Act of Congress. He then read the Proclamation to the audience. LUKE: Move signature of this Proclamation. DALY: Second. Before the Board was the Reading of a Proclamation Declaring May 20 through 26 "Make an Impact Week" in Deschutes County. Pete Ribble was not available to read this Proclamation, so it has been delayed. 4. Before the Board was the Reading of a Proclamation Declaring May 6 through 12 "Compost Awareness Week" in Deschutes County. Pete Ribble was not available to read this Proclamation, so it has been delayed. 5. Before the Board was Consideration of Approval of the By -Laws of the Proposed Deschutes County Public Health Community Advisory Board. Chair DeWolf indicated that in concept, this document looks good. He asked that the committee be selected, and that they then review and make changes and suggestions to the document, after which they could bring the draft document before the Board. Commissioner Luke emphasized that he would not be supportive of an outright ban of Deschutes County employees and their families from participating on the new committee. He said that there are many employees and their families who are involved in a variety of organizations, and they should not be precluded from being involved in this one unless they work for one of the County's health agencies. He further suggested that two seats be made available to persons from the unincorporated areas of the County. Rachel Woods said they hope to have this together by September. Mike Maier stated the next formal action would be the appointment of the members. 6. Before the Board was a Public Hearing on the Proposed Vacation of a Portion of 19th Street in Terrebonne; and Consideration of Signature of Order No. 202-043, Vacating said Portion of 19th Street. Minutes of Board of Commissioners' Meeting Wednesday, May 8, 2002 Page 3 of 11 Pages George Kolb stated that there is no road there, and no utilities, and the utility companies don't care about the easement; notifications were sent out, and no letters were received from the public. Chair De Wolf opened the public hearing. Janice Day spoke. She said she and her husband own a property immediately south of A Avenue. She expressed concerns about vacating A Avenue in the future because property would then be landlocked. She stated that if 19th St. were vacated, she and her husband would not be able to access the back portion of their property. (Mr. Kolb, Ms. Day and the Commissioners then referred to maps of the area in question) A brief discussion occurred. George Kolb stated that if a driveway is placed on an easement, is has to be done to County standards; in this case, since it is next to Terrebonne's boundary, that would mean paving it, which would be cost prohibitive. Commissioner Luke said that if a parcel were landlocked, the owner would not be able to get a building permit for putting in a structure. George Read stated that he wanted to clarify this issue; he said that the County can't withhold a building permit even if a property is landlocked. Access is a separate issue, not within the land use realm. He said they don't even ask if there is legal access; they accept what is placed on the application. A lengthy discussion then took place, resulting in both parties agreeing in principle that vacating A Avenue is a good idea and perhaps they can make arrangements for both properties to utilize it as an easement. George Kolb said he would meet with the parties go try to come up with a reasonable way to work out this issue to the satisfaction of both. Chair De Wolf then closed the public hearing. Before the Board was Consideration of Signature an Intergovernmental Agreement (D.C. Document No. 2002-111) between Deschutes County and the La Pine Water District regarding the Use of Development Fee Waivers in Exchange for County Water Connections in the La Pine Neighborhood. Before the Board was a Public Hearing (Continued from April 24) and Consideration of the Adoption, by Emergency, of Ordinance No. 2002- 001 and Ordinance No. 2002-002, Revisions to the Comprehensive Plan and Zoning Ordinance for the Rural Service Centers of Alfalfa, Brothers, Hampton and Millican (to Comply with State Rule regarding Unincorporated Communities). Catherine Morrow said that copies of the staff report have been provided to the Board and to the public. (Copies of the staff report and Legal Counsel's opinion are attached as Exhibits A and B) She further stated that the issue regarding public notice is one that needs to be taken up separately from this issue. A brief discussion occurred regarding notification areas. Catherine Morrow referred to a May 1, 2002 letter sent to the Commissioners by citizens of Alfalfa. (A copy is attached as Exhibit C.) She explained that to notify fifty property owners in Alfalfa would entail going out about 2,000 feet, but they would have to go out much further in the other areas of Millican, Brothers and Hampton. Commissioner Luke asked that this issue be reviewed by the Planning Commission; Chair DeWolf emphasized that all areas need to be treated equally. Catherine Morrow said another concern of the Alfalfa residents was the recommended lot size of the commercially zoned area; there seems to be no objection to a one -acre minimum lot size for this commercial mixed-use property. She said Planning's recommendation is based on a planning perspective, and that in that commercial mixed zone most uses should be allowed, but a few might be eliminated. A brief discussion took place regarding the possibility of multi -family dwellings or a care home on the property. Laurie Craghead said that there are state regulations regarding care facilities that supersede other land use regulations; and even if the County restricted this use, the County could be required to allow it. She further said that churches are allowed everywhere. Commissioner Luke added that a welding shop, if used primarily in relation to farming, could even be placed on EFU ground. Chair DeWolf stated that any modifications to the ordinance should be made based on the belief of what can be legally justified if challenged. He said unless there is something that can be pointed out to him as being in error, it is his intention to adopt this proposal. He explained that what happens in Alfalfa in this regard can also affect other parts of the County. Chair De Wolf then opened the public hearing. Steve Doherty of Alfalfa said that he does support the staff recommendation. He expressed concern that this issue has become divisive to the community, but everyone basically wants to maintain the rural character of the area. He said he hopes everyone will remember they are still neighbors even if they have a difference of opinion. He stated he hopes everyone agrees with this basic idea. Glen Green, who owns the store, spoke. He said he thought it was a done deal, as it had been worked on for a long time. He said he has always agreed with the staff recommendation. He explained the only thing he would like to see changed is to have the school property included in the multi -use commercial zone. He then presented a stack of letters of testimony from over 100 people who shop in the area. (A copy is attached as Exhibit D) He stated that there are a number of services these people would like to have available in the area so they don't always have to drive to town. He also indicated that he conducted a survey of his customers last fall to learn what services they would like to see available locally. (A copy of this survey is attached as Exhibit E.) He said everyone seems to support the County's recommendations, but that he would like to see the other two acres set aside for future development. Minutes of Board of Commissioners' Meeting Wednesday, May 8, 2002 Page 6 of 11 Pages Chair DeWolf stated that personally he would not vote for additional changes at this time, but no one is precluded from proposing it in the future. Nan Lewis, who lives on Willard Road, then spoke. She said she and her husband, Henry, own the Alfalfa school property, and have been on the water users board for twenty years. She explained that the water users board felt the best protection for this property was to put it into mixed use at one -acre minimums. This would help protect from certain types of development in the future, as it is stricter than a five -acre zoning. As the owners of the school property, they would like to see it zoned in one - acre parcels; she further staid that she wished the owners of property could have some rights in these decisions. She stated that they have no plans to do anything different with the property at this time, but in the future it should be included in the mixed-use commercial zone, as a future owner might want to use it differently. Marilyn Doherty stated that no one wants to restrict any property owners' rights. She said she is worried about what happens if 20 acres becomes commercial; someone could buy it all and put in a Bakersfield strip mall. She wants it to remain rural country. Chair DeWolf asked if she supports what is before the Board at this time; she said she does. Helen Tate testified that she supports the recommendation. She further said that she is concerned if they allow more commercial property, there won't be adequate law enforcement to support it. She, too, likes the rural environment. Commissioner Luke asked if there are any legal concerns regarding the existing uses; if the government takes some uses away, would this be affected by Measure 7. Laurie Craghead replied that it falls exactly under Measure 7, if it can be shown that the property's value has been lowered. Chair DeWolf then closed the public hearing, and asked that staff prepare the documents for the first reading, to take place at the next regular Board meeting on May 22. Laurie Craghead reminded the Board that since this is a legislative matter, ex parte contacts do not apply and the Board can receive letters and phone calls from citizens until the ordinance is adopted. The letter was a result of a community meeting held in Alfalfa. Staff understands that an original letter with signatures will be submitted to the Board for the continued hearing on May 8. The letter discusses the notice issue, minimum lot size and lists a number of uses the people who participated in the meeting do not want to see in Alfalfa in the proposed two acre Commercial/Mixed Use District. At the May 6, 2002 Board work session, the Commissioners requested that staff prepare a staff report with recommendations regarding the issues praised in the letter. In addition, Assistant Legal Counsel has submitted a memorandum into the record regarding some of the issues raised in the letter. NOTICE The requirements for public notice are located Title 22, Land Use Procedures, of the Deschutes County Code. They are minimum standards. The county has the option of noticing a greater area. There is a policy in the Rural Development Chapter of the Comprehensive Plan that states: Due to the more dispersed pattern of dwellings in rural areas the notice requirement area for public hearings on quasi-judicial land use actions shall be larger than in urban areas. Staff Recommendation: If the Board wants to amend Title 22 to establish a specific notice requirement for the four rural service centers, staff recommends that it be considered as a separate work task. George Read has suggested that we consider a notice area for rural service centers that extends far enough to notify 50 property owners. This would be a variable notice distance for each of the four rural service centers, but would provide notice to an equal number of area residents for each community. MINIMUM LOT SIZE The letter states that they do not object to a one -acre minimum lot size for the 2 -acre Commercial/Mixed Use District in Alfalfa. LAND USES The signers of the letter do not want to see the following uses in the 2 -acre Commercial/Mixed Use District. Uses Permitted Subject to Site Plan Review: 1. Community building * 2. Auto junkyard * Uses currently permitted in the RSC zone The County established rural service centers in 1979 with the adoption of the comprehensive plan and zoning ordinance. At that time, there were 13 rural service centers ranging in size and intensity of uses from a single store to a large community like La Pine. The rural service centers were identified because they had developed with commercial, industrial, and public uses to serve the surrounding rural areas. In 1994 the State adopted administrative rules to clarify what uses could be allowed in unincorporated communities. The State rule "recognizes the importance of communities in rural Oregon". The rule identified four types of communities and sets limits on scale of uses by building size to assure that the communities maintain rural character and serve the rural area, not nearby urban areas. The smallest, least intense type of community is a rural service center. Alfalfa qualifies as a rural service center under the state rule. The intent of the administrative rule and the original county designation is to encourage development is specific centers, outside of cities, where limited commercial, industrial and public uses are permitted to serve the rural population and travelers. This is good planning policy because it allows certain small scale needs to be met locally. This can reduce vehicle trips 2 to cities, provide convenience for nearby residents and travelers and promote economic activity in rural areas. The intent of the proposed Rural Service Center Commercial/Mixed Use District is to provide for a wide range of commercial uses and public uses that can meet future needs and changing market conditions, with restrictions to limit their size and impact. The rule limits size of commercial buildings to 4,000 square feet to minimize impacts to the rural communities and to prohibit large-scale uses that would attract customers from urban areas or that should be located within urban growth boundaries. This is state policy to allow designated rural service centers to adapt over time but remain rural in character. The letter from some Alfalfa community residents proposes to eliminate 10 uses (identified with an asterisk on the list above) that are currently permitted in the Rural Service Center Zone in Alfalfa. The request does not state why these uses shoukHmialimimloA The letter does not explain what the impacts are for these uses that are different from the uses that would be permitted. Each of these uses would be subject to conditional use and/or site plan criteria, onsite septic siting requirements and parking standards, which would address impacts to surrounding properties and streets and might prohibit development of some of these uses in Alfalfa. Without specific findings on the impacts of the uses that would be prohibited, staff finds it difficult to exclude some commercial uses and permit others when the impacts would her similar_ Commercial and office uses carried on within a building not exceeding 4,000 square feet should be permitted to serve the needs of the rural area over time. Alfalfa is sufficiently far from Bend that the market will limit the types of uses that the surrounding rural community and travelers will support. Laurie Craghead, Assistant Legal Counsel, also commented on some of these uses in her memo. Some of the uses proposed for elimination in the letter are discussed below. ❑ Rock Pit. This use would not be permitted because it is not listed and is permitted only in a Surface Mining zone. ❑ Auto junk yard. This use is not a commercial or office use that would be located within a 4,000 square foot building. So it would not be permitted in Alfalfa. ❑ Auto repair or auto body shop. This use is appropriate for a rural service center to provide the service to surrounding rural residents and travelers. It would have to be located within a building. ❑ On going flea market. This is a commercial retail use. However, if the use was established without site plan approval it is a code violation. Under the proposed code this use would not be permitted unless it was within in a building not exceeding 4000 square feet. ❑ Establishment serving alcohol. See the comments from Assistant Legal Counsel. ❑ Agricultural or any other fabricating /welding shop. This use would be included under the more general - Retail store, business office or commercial establishment in a building not exceeding 4, 000 square feet. Staff believes a commercial welding or fabricating shop is an appropriate use in Alfalfa to serve the local farming and ranching community. Having such a use in a rural service center will allow employees that would not be allowed if the use was conducted as a home occupation. ❑ Public showers. This is not a use listed anywhere in our zoning code. It is unknown if septic approval could be obtained for such a use in Alfalfa. Considering existing 3 :'. development and the one -acre minimum lot size, it is unknown if an RV park with public showers could be established and meet septic system and water requirements. ❑ Communications radio station. See comment from Assistant Legal Counsel. ❑ Public or semi- public building or use. This could be a library, fire hall, irrigation district office or facility, or sheriff department. Staff thinks any of these uses could be appropriate in the Alfalfa Commercial/Mixed Use District. ❑ Church, school, community hall. See comments from Laurie Craighead regarding churches. Schools, churches and community halls are all facilities that can serve a rural area and provide convenience for the community. Alfalfa has historically had a school and currently has a community hall that also serves as a church. The potential impacts of a new church, school or community hall would be regulated by conditional use permit and site plan criteria. Alfalfa is located on a county rural arterial road that could serve the traffic generated by such uses. The size of the use in a two acre zone would be limited by existing development and parking requirements. ❑ Recreational Vehicle Park. This would be a conditional use with specific standards to assure compatibility. This use is only allowed under the county code in unincorporated communities. It is not permitted in the MUA 10, RR 10, EFU or Forest zones. Staff believes that a rural service center is an appropriate place for an RV park to serve recreationists. If new RV parks are not located in unincorporated communities, they will only be allowed in urban growth boundaries. ❑ Manufactured Home Park. New manufactured home parks are not permitted in the RR -10, MUA-10, EFU or Forest Zones. The county code requires that a manufactured home park must be a minimum of 1 acre. With the existing development pattern in Alfalfa and septic and water requirements, it is unlikely that an acre of the Commercial/Mixed Use District would be developed as a manufactured home park. However, the Boa could ddewtbkuse izr"alfa_ ❑ Highway Maintenance Facility. This use.could be eliminated from the Alf4lfa Commercial/ Mixed Use District because it is not located on a state highway. ❑ Multiple family dwelling. The Board could choose to delete this use in Alfalfa. This use may be more appropriate where there are likely to be more services in a Resort Community, Urban Unincorporated Community or Rural Community. At the work session I expressed some concerns regarding the list. Although there may be planning and political problems with treating similar types of communities differently, my first concern regarding spot zoning is no longer a concern after reviewing some case law on the subject. My main concerns now relate to the necessity of findings to justify why particular commercial uses would not be allowed in this zone when they are allowed for the same zone in other similar areas of the County. Those findings, on the other hand, may not be difficult because of the impact the use may have on the surrounding neighborhood. My responses regarding some of the specific uses are as follows: 2. Church. Places of worship cannot be barred outright in any zone because of the "Religious Land Use and Institutionalized Persons Act of 2000." That act provides that, No government shall impose or implement a land use regulation in a manner that imposes a substantial burden on the religious exercise of a person, including a religious assembly or institution, unless the government demonstrates that imposition of the burden on that person, assembly, or institution — (A) is in furtherance of a compelling governmental interest; and (B) is the least restrictive means of furthering that compelling governmental interest. 5. Manufactured Home Park. Commissioner Luke raised concerns regarding a local government's lack of ability to prohibit manufactured homes. The restrictions on prohibitions of manufactured home parks are in ORS 197.475 — 197.490 and apply only within urban growth boundaries ("UGB"), Thus, they may be restricted outside a UGB. A rock pit would not be an allowed use under the proposed revisions unless an applicant could prove that it fit within one of the categories such as a commercial use that is conducted within a 4,000 square foot building. 12, A perpetual, on-going flea market/yard sale. Finding justifications for why this use is less acceptable than another type of retail store will be difficult. Many retail stores may have objectionable sales procedures. There will also be definitions problems. For example, would it include a store like the Crafters' Mall on the comer of Minnesota and Bond in Bend? 13. An establishment that services beer, wine or alcohol. This one will be a tricky one, constitutionally, just like trying to zone out adult bookstores or nightclubs with nude dancing. Commercial speech is considered to be part of free speech. There would need to be findings such as studies showing that such establishments have a greater adverse impact on the neighborhood such as increased accidents, crime, and so forth. With establishments like the Deschutes Brewery or fine dining which serve alcoholic beverages without incident, I doubt any studies exist that say all establishments that serve alcoholic beverages are a problem. 14. Auto junkyard. This use is one for which it might not be too difficult to draft findings because of the unsightliness and possible environmental contamination. More than likely, an applicant will have to obtain a DEQ solid waste permit as well. 15. A Communication/Radio Station. — These type of stations do not fall under the same section of the Federal Telecommunications Act of 1996 as wireless telecommunication towers which prohibits a local government from prohibiting the uses. I will have to do further research to see if there are other federal, semi - super -siting provisions. If such a station can be contained within a 4,000 sq. ft. building, however, the Board would be hard pressed to make a finding as to why the use should be specifically exempted especially in light of the height restriction ordinance. Rather than making further legal arguments regarding each proposed prohibition, my advice is that most of the uses listed, will be eliminated by the other requirements in the new code provisions such as the setbacks and restrictions on square footage as well as the drainage and septic problems. Thus, not much need exists to specifically prohibit the uses. Catherine Morrow will provide you with a list of the uses unacceptable to the residents that are already excluded and with explanations from a planning standpoint regarding a policy of prohibiting or not prohibiting some of these uses. We would like to have included, RV sites, Laundry Facilities, Public Showers, Mini Storage, Agricultural Related Fabrication and/or Repair Shop, Welding Shop, and Auto Repair and Small Engine Repair Shop.
