BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY,

An Order Declaring the Result of the May 21,
2002 Election on the Formation of the Spring ORDER NO. 2002-086
River Special Road District and Forming the
District.
WHEREAS, an election was held in Deschutes County, Oregon on May 21, 2002, on the
measure set forth in Exhibit A concerning the proposed Spring River Special Road District
("District"); and,
WHEREAS, an Abstract of Votes, copy of which is attached as Exhibit B, shows that a
majority of the registered electors of the District cast their ballots at the election and a majority
of those persons voting voted to approve the measure; and,
WHEREAS, ORS 198.820 (1) requires the Board to canvass the votes and declare the
district formed if the Board determines that the majority of the votes cast were in favor of formation
of the District; now, therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON,
ORDERS as follows:
Section 1. At the election held in Deschutes County, Oregon on May 21, 2002, as
evidenced by the Abstract of Votes, a copy of which is attached as Exhibit B and incorporated
by reference herein, fifty-six (56) electors constituting sixty-six percent (66%) of the registered
electors in the District cast ballots on the issue of formation of the District and, of those electors,
thirty-four (34) electors voted "yes" and three (3) voted "no" on the measure captioned "TO
FORM ROAD DISTRICT and ESTABLISH TAX RATE LIMIT," as set forth in the attached
Exhibit B, incorporated by reference herein.
Section 2. Because the number of electors who voted represents more than fifty percent
(50%) of the electors registered in the proposed district and a majority of the electors voting
approved the formation of the proposed district, the measure is declared to have passed and
the District to be formed.
Section 3. The name of the District shall be the Spring River Special Road District and
the boundaries shall be as legally described in Exhibit C and depicted on the map Exhibit D both
exhibits being attached hereto and by this reference incorporated herein.
Section 4. The purpose of the District is to provide for the maintenance and improvement
of the roads with the boundaries of the District.
Section 5. The permanent rate limit for operating taxes of $0.94 per $1,000 assessed
value for the District for ad valorem taxes pursuant to Section 11, Article 11, Oregon
Constitution, is hereby established.

Section 6. The Board Clerk shall cause certified copies of this order be filed with the

EXPLANATORY STATEMENT
The proposed road district will include the area within the Spring
River neighborhood located north of Spring River Road and
West of the Sunriver Resort. The purpose of the proposed spe-
cial road district is to maintain and improve public roads within
the district. Funds for operating the district are provided by levy-
ing taxes on all real property within the district. The Deschutes
County Board of County Commissioners will appoint a three-
member board of commissioners for the district from electors
residing within the district. The appointed board is the govern-
ing body of the special road district.
The full amount of the permanent tax rate need not be levied
in any given year. The district board will determine the amount
to levy each year based upon the annual budget approved each
year by district board. Upon approval of the district formation
by the electors of the district and appointment of the district
board, the district will establish the final budget for the tax year
2002-2003 fiscal year. The initial tax levy will be based on the
final approved budget. Meetings of the district board are open
to the public. The current estimated tax levy for the first year is
$13,270. The funds generated by the property taxes are pro-
jected to be used to pay for a licensed snow plow contractor,
routine road maintenance and improvements and administra-
tive costs.
