BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON
A Resolution Declaring the Intention to Transfer
Real Property to Humane Society of Central
Oregon/SPCA, an Oregon Non -Profit
Corporation, to be Used Exclusively for Social
Services, Setting a Hearing for the Purpose of
Hearing Objections to the Transfer and Providing
Notice.
* RESOLUTION NO. 2002-088
WHEREAS, ORS 271.330 provides that Deschutes County may transfer surplus real property to a non-
profit corporation for the purpose of providing social services; and
WHEREAS, the Humane Society of Central Oregon/SPCA has requested that the County transfer to it
the County's interest in certain surplus real property without consideration; and
WHEREAS, ORS 271.330 provides that said transfer shall only be made upon notice and after hearing;
now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES
COUNTY, OREGON, as follows:
Section 1. That Deschutes County intends to transfer real property described as:
A parcel of land lying in the NW '/4 NW '/4 of Section 14, Township 18 South, Range 12, East of the
Willamette Meridian, Deschutes County, Oregon, and being more particularly described as follows:
Commencing at the northwest corner of said Section 14, thence along the north line of said
Section 14 S89°36'19"E a distance of 127.13 feet; thence leaving said north line S00°23'41"W 20.00
feet to a point on the south right-of-way line of the 1908 John Ferguson Road, the Point of Beginning;
thence along said south right-of-way line S 89°36'19" E a distance of 1178.71 feet to the west right-of-
way line of the 1910 W. J. McGillvray Road (said west line being 20.00 feet west of the east line of said
NW '/4 NW '/4); thence leaving said south line and along said west line S00°18'39" W a distance of
21.41 feet; thence leaving said west line S81°11'07" W a distance of 624.39 feet; thence S08°50'59"E a
distance of 90.50 feet; thence S81°20'06"W a distance of 149.19 feet; thence S08°40'43"E a distance of
39.42 feet; thence S83°06'09"W a distance of 26.73 feet; thence 105.44 feet along the arc of a curve to
the left with a radius of 117.30 feet and a long chord which bears S57°21'09"W a distance of 101.92
feet; thence S31°36'08"W a distance of 18.59 feet; thence 38.46 feet along the arc of a curve to the left
with a radius of 120.81 feet and a long chord which bears S22°28'54"W a distance of 38.30 feet; thence
S13°21'40"W a distance of 82.78 feet; thence 38.20 feet along the are of a curve to the right with a
radius of 53.24 feet and a long chord which bears S33°54'58"W a distance of 37.39 feet; thence

northeasterly of the centerline of S.E. 27"' Street as shown on the "Plat of Survey" filed in the Deschutes
County Surveyor's Office on May 22, 1991 as CS03949; thence along a line 40.00 feet northeasterly of
and parallel with said 27TH street centerline N25°33'00"W a distance of 441.73 feet to a #5 rebar with a
2" aluminum cap stamped "Deschutes County Public Works LS 1031"; thence 119.37 feet along the arc
of a curve to the right with a radius of 1392.39 feet and a long chord which bears N23°05'38"W a
distance of 119.34 feet to the Point of Beginning. Containing 203,787 square feet (4.678 acres) more or
less.
Section 2. That a hearing for the purpose of receiving objections to the above transfer will be held on
Wednesday, October 9, 2002, in the Board of County Commissioners Hearing Room of the Deschutes County
Administration Building, 1130 NW Harriman, Bend, Oregon.
Section 3. That the Clerk of the County Court shall give notice of the time and place for the hearing set
in Section 2 of this resolution by publication of the notice marked Exhibit "A" attached hereto and by this
reference incorporated herein, in "The Bulletin" once each week for two consecutive weeks prior to the date of

On Wednesday, October 9, 2002, at 10:00 a.m. in the Board of County Commissioners Hearing
Room of the Deschutes County Administration Building, 1130 NW Harriman, Bend, Oregon, the Board of
County Commissioners of Deschutes County, Oregon, will hold a hearing on a land transfer between
Deschutes County and Humane Society of Central Oregon/SPCA, a non-profit corporation providing social
services in the State of Oregon. The land to be transferred by Deschutes County to Humane Society of
Central Oregon/SPCA is described as follows:
