BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON
An Order Establishing a Designated Speed of 35
m.p.h. on that portion of Pine Forest Drive from
Burgess Road to Davis Avenue.
ORDER NO. 2002-139
WHEREAS, pursuant to ORS 810.180 paragraph (8), Section(a), the Board of County Commissioners
as a road authority have been delegated authority by the Oregon Department of Transportation to designate
reasonable and safe speeds on low volume or not hard surfaced County roads. In the Board's judgment, to
protect the safety of the public; and
WHEREAS, this action is based upon an engineering and traffic investigation; and
WHEREAS, Pine Forest Drive lies outside the corporate limits of any city; and
WHEREAS, it appears that a safety necessity exists on Pine Forest Drive from Burgess Road to Davis
Avenue; now therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, HEREBY
ORDERS as follows:
Section 1. The designated speed of 35 m.p.h. be assigned to the following section of Pine Forest Drive
from Burgess Road to Davis Avenue.
Section 2. That the County Road official erect appropriate signing according to MUTCD (Manual of
Uniform Traffic Control Devices) requirements giving notice of the restriction.
Section 3. That any previous order with respect to the designated speed for the above road which is in
conflict with the provisions of this order is hereby rescinded.

Burgess Rd 45mph roads and there are far fewer residents on those roads as there are on Pine Forest. Please I

Commissioner Daly forwarded your request for information concerning speed zones on County Roads to me.
My name is Gary Judd and I'm the Traffic Engineer for Deschutes County. I'm also a member of the La Pine
Transportation Area which looks into traffic safety problems in south Deschutes County. I'll do my best to
answer your January 7th e-mail questions.
On roads in Oregon that do not have a posted speed the speed of traffic is governed by the Basic Rule. The
Rule states that a motorist must drive at a speed that is reasonable and prudent. State law also designates
speeds to be used on roads in good driving conditions, they are: 25 mph in a residential district; 20 mph in a
business district; and 55 mph on other roads. A residential district is an area adjacent to a road that has
residential driveways every 150 feet.
Some roads have special conditions that make it necessary to have posted speed zones (35 mph, 45 mph, etc.)
on them. Those speed zones are set by the Oregon Department of Transportation (ODOT). The procedure for
obtaining speed zones on County roads is to make a request to me (as a representative of Deschutes County),
which I review then forward to ODOT. ODOT then does an engineering study for the request, which includes
looking at crash history, measuring the speed of traffic on the road, and looking at roadside culture. From this
data they determine if a posted speed zone is appropriate on the road. If you are interested there is more
information concerning the setting of speed zones on ODOT's internet site,
www odot state.or.us/tstrafmgtpublic/speed.htm.
When I review a request for a speed zone I look to see if the speed is consistent with other roads in the area, if
the Sheriffs Department is willing to enforce the zone, and if the majority of residents are in favor of the speed
zone. An unrealistically low speed zone can frustrate many drivers causing them to disregard this speed zone
and others that they may encounter.
