Luke and Michael M. Daly. Also present were Mike Maier, County Administrator; Sue Brewster, Sheriff's Office; Rick Isham, Mark Amberg and Laurie Craghead, Legal Counsel; Tom Blust and George Kolb, Road Department; George Read, Community Development Department; Anna Johnson and Ted Schassberger, Commissioners' Office; Media Representatives Barney Lerten of Bend.com and Mike Cronin of the Bulletin; and no other citizens. Chair Tom DeWolf opened the meeting at 10:02 a.m. 1. Before the Board was Citizen Input. None was offered. 2. Before the Board was a Public Hearing, and Consideration of Signature of Order No. 2002-105, Regarding the Vacation of a Portion of Cook Avenue, between 8th and 91h Streets, in the Laidlaw Subdivision (Tumalo). George Kolb gave an overview of this vacation, which is a result of the realignment of O.B. Riley Road. The original submittal not acceptable to ODOT; since then he has worked on this issue with them, and it has been decided that a vacation of 30 feet avoids having a driveway off Cook Avenue that would be too near Highway 20. Being no testimony offered, Chair De Wolf then closed the public hearing. LUKE: Move approval. DALY: Second. VOTE: LUKE: Yes. DALY: Yes. DEWOLF: Chair votes yes. 3. Before the Board was a Discussion and Consideration of Signature of an Agreement between the Deschutes County Sheriffs Office and the Deschutes National Forest, Modifying the Financial Plan regarding Forest Work Crews. Sue Brewster explained that this is a renewal, called modification #4. The Forest Service gives money towards work crews; this basically covers the cost. This item was placed on Wednesday's Consent Agenda. 4. Before the Board was a Discussion and Consideration of Signature of Order No. 2002-141, Assigning the Name of Rocking Horse Court to an Unnamed Access Road off Rocking Horse Road, Bend. This item was placed on Wednesday's Consent Agenda. 5. Before the Board was a Discussion and Consideration of Signature of Order No. 2002-142, Assigning the Name of Chasing Cattle Lane to an Unnamed Access Road off Deschutes Market Road, Bend. This item was placed on Wednesday's Consent Agenda. 6. Before the Board was a Discussion of a Public Hearing, and Consideration of Signature of an Intergovernmental Agreement between Deschutes County, the State of Oregon and the City of Bend, Allocating the Distribution of Real Property from the State of Oregon (the Welcome Center). Minutes of Board of Commissioners' Work Session Monday, November 4, 2002 Page 2 of 5 Pages Laurie Craghead said this is a three-way intergovernmental agreement, with a hearing to be held on Wednesday. It allocates who gets what, who pays for what, and a clarification of a point in the IGA regarding insurance reimbursement to the County until 2008. Should close this within two weeks from the public hearing. This item will be addressed on Wednesday, November 6. 7. Before the Board was a Discussion of a Public Hearing to Take Testimony on the Submission of a Community Development Block Grant Application for the La Pine Senior Center Construction Project and Other Projects. This item will be addressed on Wednesday, November 6. 8. Before the Board was a Discussion and Consideration of Signature of an Intergovernmental Agreement between Deschutes County and the Central Oregon Intergovernmental Council (COIL) for Medical Ride Brokerage Development. Commissioner Luke said the goal of this document is to develop a plan; the next step would be the actual service delivery. It is all grant funded through the State Department of Public Services at this point. This item will be addressed on Wednesday, November 6. 9. Before the Board was a Discussion and Consideration of Signature of Order No. 2002-104, Advancing FY 2002-03 Tax Levies to Taxing Districts. This item was placed on Wednesday's Consent Agenda. 10. Before the Board was a Discussion and Consideration of Signature of Letters Appointing the Following Individuals to the Newly Formed Deschutes County Audit Committee. County Personnel: Dennis Luke, Commissioner; Les Stiles, Sheriff; and George Read, Community Development Department; Citizen Representatives: Lauri Miller, Eagle Crest Resort; and Barry Jordan, Bank of the Cascades. Minutes of Board of Commissioners' Work Session Monday, November 4, 2002 Page 3 of 5 Pages David Givans, Marty Wynne and Mike Maier are the established members; the other members are to be appointed to the Committee, and have established terms. This item will be addressed on Wednesday, November 6. 11. Before the Board was a Discussion and Consideration of Additions to the Agenda. George Kolb presented documents related to the Johnson Market Road Bridge easement. He said that in order to get access on each side of the bridge, the County must purchase a right of way. He has spoken with the property owners; the total cost for the three needed parcels will be $2,500 to $3,000. He is working with ]Legal Counsel on these documents and on negotiations with the property owners. Mark Amberg added that he just needs the legal descriptions and exact amount of money. George Kolb said that the County may have to replace some trees and a fence, and negotiations may take a little while. Action on this item was delayed until Wednesday, November 13. Chair DeWolf advised the audience that there would be a celebration at the County Clerk's office on Tuesday at 8:00 p.m., honoring the birthday of the current County Clerk, Susie Penhollow, and celebrating the conclusion of Election Day.
