ME , C missioner PAGE 1 OF 1- RESOLUTION NO. 2003-010 (01/22/03) EXHIBIT A Deschutes County Weed Advisory Board Charter Mission Statement: Work cooperatively to promote and implement noxious weed control in Deschutes County; to contain existing weed populations and eradicate new invaders: to raise the value of the land economically and biologically: to improve the health of the community, promote stewardship, preserve natural resources and provide examples and leadership for other counties and states in effective vegetation management. Article I — Name The name of this organization is the Deschutes County Weed Advisory Board, hereafter referred to as the "Board". Article II - Purpose 1. Support and advise the Deschutes County Commission regarding the management of noxious weeds. 2. Provide oversight and guidance for the County WeedNegetation Manager. 3. Identify and prioritize those issues to be managed by a county weed control program. 4. Assist in the development of an annual budget for the weed control District. 5. Initiate an outreach and education program to be managed by the county weed supervisor. Article III - Membership Number and Selection Membership shall consist of at least seven people, approved by the Board of County Commissioners, with a demonstrated interest and willingness to serve. The membership shall represent as many stakeholder groups as possible, i.e. recreation and tourism, agriculture producers, federal land managers, conservation groups, development and real estate, municipalities, transportation, homeowners, private business and private timber managers. Ex -officio members shall include, but are not limited to a representative of the County Commission, Oregon Department of Agriculture, Upper Deschutes Watershed Council, the Deschutes Soil and Water Conservation District, the County WeedNegetation Manager. Ex -officio members will have no voting rights. Terms of Office In order to maintain continuity in the program and diversity in the membership, terms of office shall be one year, two years'or threes years in length. There shall be equal numbers of positions for each type of term. Members do not receive monetary compensation; however, the County Commissioners may at times reimburse Weed Board Members for travel expenses under certain circumstances. Members shall be eligible for reappointment. Responsibilities Board members are to regularly attend meetings of the Board and meetings of the committees to which they have been appointed and to fulfill other Board duties as appointed by the Chairperson. Termination of Membership By a majority vote of members constituting a quorum, during a regular meeting, the Board may recommend to the County Commission that a Board member's position be declared vacant when the member has been absent from three consecutive Board meetings or any four Board meetings during a calendar year. Notice of absence with a reasonable explanation shall be considered in mitigation of the effect of the Board member's absence from such meetings. Vacancies After consideration of the Weed Board's recommendations, the Deschutes County Commission shall make appointments to fill vacancies as they occur. Such appointments shall be for the duration of the unexpired term of that vacancy. Article IV - Officers Definition The Weed Board shall have a Chairperson and Vice -Chairperson. Other officers may be selected as deemed necessary, by a majority vote of the Board. The Chairperson and Vice -Chairperson shall be elected by majority vote of the Board. Term of Office The term of office shall as Chairperson and Vice -Chairperson be for one year and shall run from the election in January to the next January election. Any vacancy in office occurring during the year shall be filled by election. If a Chairperson or Vice -chairperson is elected to fill a vacancy in office occurring during the year, the term shall end at the next following January election. Chairperson The Chairperson shall call meetings, set the agenda, and preside at all meetings of the Board; shall make appointments to committees and assignments of other tasks as are necessary to carry out the business of the Board. Vice -Chairperson The Vice -Chairperson shall preside at Board meetings in the absence of the Chairperson, and shall assist the Chairperson in the execution of tasks necessary to carry out the business of the Board. Secretary Secretary shall be provided by the County Road Department. The secretary shall record proceedings at meetings and provide minutes to the Board of Commissioners, Weed Board members and interested citizens. Update yearly action items from the Action Plan and provide information to Weed Board members, Board of Commissioners, the general public and the media. Article V - Committees The Board shall have the power to create committees with specific directives to assist with control of weeds or other purposes as defined by law and in this charter. The Chairperson shall appoint and charge each committee with its responsibilities, naming an individual as the committee or the Chairperson of the committee in the event the committee consists of more than one person. The Committee Chairperson shall be responsible for scheduling meetings, assigning specific tasks within the mandate of the committee, chairing meetings of the committee and reporting to the Weed Board concerning the work of the committee. There shall be an executive committee consisting of the Chairperson, Vice -Chairperson and the chair of each officially designated committee. Article VI - Advisors The Board may call on citizens to the extent deemed appropriate by the Executive Committee for technical assistance and public outreach. Article VII - Meetings Regular meetings will be held monthly on the second Thursday. Notice shall be given in such a manner and with such prior written notice as to time, date, location and purpose as to allow members and public to reasonably prepare for attendance and participation. The Chairman calls the meeting to order where participants in turn introduce themselves and provide a brief statement of current interest or concern for the attendees. Everyone has an opportunity to speak and at minimum offer one specific comment or question. Agenda items are discussed in order and decisions are made. Recommendations for the Board of Commissioners must be agreed upon by a majority of the Weed Board The Chairperson, Vice -Chairperson, or the County Commission may call special meetings. Notice shall be given in such a manner and with such prior written notice as to time, date, location and purpose as to allow members and public to reasonably prepare for attendance and participation. A quorum shall consist of a simple majority of the Board members officially designated by the Deschutes County Commission. There shall be no voting by proxy. A tie vote on a proposal means the proposal has been defeated. All members shall have one vote and member's right to vote may not be abridged. A quorum of duly appointed members shall be necessary to take any action. Conflict of Interest Weed Board members must declare their professional or personal affiliation with any of the agencies, individuals or vendors requesting funds. Any Board member who is employed by an organization in any capacity shall have a conflict of interest if any vote to be taken by the Board has a direct affect on that organization. Board members who have declared their affiliation and whom the Chairperson has determined to have a conflict of interest shall be noted in the minutes. Members having a conflict of interest shall abstain from voting on issues related to that conflict unless the members vote is necessary to break a tie vote. Article VIII - Public Meeting Law The Board is a public body for purposes of ORS 192 and thereby subject to the statutory procedures relating to public meetings. ORS Chapter 192.610 to 192.690, the Oregon Public Meetings Law, is attached hereto and by reference incorporated herein. It is the policy of the Board to maintain a maximum of public contact and receive a maximum of public input. In accordance with this policy, all meeting notices routinely shall be distributed to the office of the County Commission for further distribution to local media in Deschutes County. Distribution of meeting notices, including agendas, shall be in a manner that maximize the potential for the public to be aware of the proceedings of the board and to participate in its deliberations. Article IX — Parliamentary Authority Robert's Rules of Order (newly revised) shall be the parliamentary authority in all cases not covered by this charter and any special rules of order the Board shall adopt. EXHIBIT A DESCHUTES COUNTY WEED LIST Deschutes County Weed Policy and Classification System "NOXIOUS WEED" means any weed designated by the Deschutes County Board of Commissioners that is injurious to public health, agriculture, range, recreation, wildlife, or any public or private property; any weed that impacts and displaces desirable vegetation, such as Threatened and Endangered Plant Species, wildlife habitat, and livestock. It is acknowledged that certain noxious weeds have become so thoroughly established and are spreading so rapidly on state, county, and federally owned lands, as well as on private land, that they may have been declared by Oregon Revised Statue 570.505 to be a menace to public welfare. Steps leading to eradication where possible, are necessary. It is further recognized that the responsibility for such eradication and/or intensive control rests not only on the private landowner and operator, but also the county, state and federal government. Noxious Weed Control Rating System Noxious Weeds, for the purpose of this system, shall be designated "A", `B" or "C" 1. An "A" designated weed is: a priority noxious weed designated by the Deschutes Weed Board as a target weed species on which the Weed Control District will comply with a state wide management plan and/or implement a county wide plan for intensive control and monitoring. An "A" rated weed may also be a weed of known economic or ecological importance which occurs in small enough infestations to make eradication/containment possible; or one that is not known to occur here, but its presence in neighboring counties make future occurrence here seem imminent. Recommended Action: Infestations are subject to intensive control when and where found. 2. A `B" designated weed is: a weed of economic importance, which is both locally abundant and abundant in neighboring counties. Recommended Action: Moderate control and or monitoring at the county level. 3. A "C" designated weed is: a weed that has the potential to cause harm to agriculture production and transportation systems. Recommended Action: Control and monitoring at the county level.
