(See the attached Sheriff's Office report and statements, attached as Exhibit A.) One of the dogs was released to the dog caretaker and the dog was placed in another home. The older dog (Roy) was moved to the High Desert Veterinarian Clinic per a previous Dog Board hearing (11/5/02) to be held there pending the decision of this hearing. Mark Amberg, County Legal Counsel, called the meeting to order at 5:15 p.m. Present were Mark Amberg, Dog Board members Judith Parker, Laurel Pierson, Lam Sykes, and Robert Morrissey. Also present were Senior Secretary Connie Thomas, the livestock owners Richard and Nita Sadler, the dog's owner Ron Gallagher and the dog's caretaker at the time of the incident, Jennifer Avrill. Mark Amberg gave a brief overview of the Dog Board process for those in attendance and advised that the procedure would be kept informal. The livestock owners and the dog owner and caretaker gave brief introductions also. Mark Amberg described to the livestock owner and dog owner what happens in these hearings. The purpose of the Dog Board is to determine what action will be taken. The Board can impose a fine or in lieu of a fine can request community service and can impose reasonable measures be taken to make sure of no re - occurrences. If necessary the dog can be moved, chip put into lip, lip tattoo or be put down. Mr. Sadler was to be questioned by the Board first. Mr. Morrissey to Mr. Sadler: Have you had a chance to read the report? Per Mr. Sadler, Mrs. Sadler read it. The Officer who took the report was to bring pictures. Officer Mestdagh was not present. Per Mr. Sadler in June or July he noticed two dogs trying to get into the pheasant pen. They were very nice dogs and they let him catch them. He called animal control and they came out and took the dogs to the animal shelter. They were the same dogs as from this incident. On October 24th Mr. Sadler was gone. When he came home the big dog came out of the pen the pheasants were in. Mr. Sadler checked the birds and all were found dead. The big dog had gotten into the pen. Both dogs were caught and were very friendly. All of Mr. Sadler's stock was killed and one was half eaten. The door to the pen was also broke down. Mr. Sadler could see where they had been in the pen. Mr. Amberg asked Mr. Sadler information for the record: Address: 18245 Plainview Road. Livestock in question: ring neck pheasants How many: 2 roosters, 4 hens that were in two different pens Estimated Value: $200.00 for all 6, although he was told it is hard to find the birds this time of year. Me may have to either wait until spring or go to WA. Used for: Used like chickens, pets, collected eggs from them. Describe Dogs: one was large, black and white. Per the Sheriff's Officer the dogs had come a long way. Two Officers came out the next day to take a report. Ms. Pierson asked Mr. Sadler what was his residence location related to Plainview? Per Mr. Sadler it is east of Fryrear and the 2nd road to the right. Laurel asked Mr. Gallagher his residence location. Mr. Gallagher lives on Brandywine. Mr. Morrissey asked Mr. Sadler if he had worked out damages with Mr. Gallagher. Mr. Sadler advised he had not yet. Mr. Gallagher stated he would like to work out damages. Mr. Sadler stated he had an earlier incident with another dog and dog owner and he was reimbursed for that one. Mr. Morrissey stated there are lots of options and many times this can be worked out. The blonde dog has already been placed elsewhere and the older dog (Roy) at the veterinarian clinic seems friendly. Per Ms. Avrill she gave the Sheriff's Officers her number to give to the Sadler's so they could work out a settlement. Per the Sadler's they were not given a number. Mr. Gallagher stated he knows of someone off of King road that raises birds. Mr. Sadler said the stock he checked on is brood stock and he can't get any now but come spring it will be possible to get some. Ms. Pierson asked Mr. Gallagher what future arrangements have been made regarding the 12 -year-old dog (Roy) to insure this does not happen again. Per Mr. Gallagher they have kennels and a shop that he can be put in. The dog is neutered but not licensed. He was not aware that the dog needed to be licensed way out at his location. When the dogs were picked up the first time no one advised Mr. Gallagher that the dogs needed to be licensed. The Corgi has gone to another home. The old dog, Roy, is Mr. Gallagher's companion and when not with him would be in either the kennel or shop. Per Mr. Morrissey there is the option of a lip tattoo. If the dog ever got out again and another incidence occurred he would be put down, no question. Per Mr. Gallagher he got the Corgi earlier in the year and Nancy at the dog trainers was going to place him in another home. Mr. Morrissey asked Mr. and Mrs. Sadler if it would be acceptable to them, as the victims, if Mr. Gallagher was able to help them replace pheasants? They stated they would be willing to work something out. Mr. Sadler stated that the dogs were very friendly. The cow dog was worn out. He had torn down boards and wire. Mr. Sadler stated he used dog kennel heavy pipe on his pens. The dog did not dig in the fence, which is wrought iron. The door is a tool shed type door and it was busted out. The 2nd pen is dog kennel type and the wire was pushed over the pipe. The dog got under and pulled the birds out. There were dog footprints inside the pen. Ms. Sykes asked Mr. Gallagher what he would be doing differently if the dog comes home. Mr. Gallagher made a kennel in the barn. The dog would normally be with him. Mr. Morrissey asked where we are? Would Mr. Gallagher like to make a settlement? Per Mr. Gallagher the Corgi would go to another home. Mr. Gallagher will compensate Mr. Sadler for his damages and would like to keep Roy with him. He would be willing to place a chip in the dog or relocate him to a home in California if necessary. Mr. Amberg and the Dog Board dismissed themselves to convene to another room to discuss the case. The Dog Board reconvened at 6:06p.m. Mr. Amberg summarized the Boards decision. Since both parties seem willing to come to an agreement the Dog Board recommendation is that Mr. Gallagher keep his dog Roy. The dog is to be licensed, update his shots, and have a lip tattoo done by the veterinarian before the dog could be released. Mr. Gallagher would be responsible for the costs. Mr. Gallagher would be responsible for helping Mr. Sadler replace his birds. He could assist Mr. Sadler in finding birds for replacement or give him a dollar amount to be agreed upon and pay for damages to Mr. Sadler's property. The Dog Board can impose an additional fine or apply it to the costs of the dog owner. The Board has decided that Mr. Gallagher will not have to pay an additional fine. In lieu of a fine Mr. Gallagher would be responsible for all veterinarian costs, replacement of the birds, and repair to the property. Mr. Gallagher has already paid the animal shelter for fees for the Corgi and Roy. Per an earlier decision made by the Dog Board on 11/5/02, Roy is in custody at the veterinarians. Conditions are satisfactory to Mr. Sadler. Conditions are satisfactory to Mr. Gallagher. Mr. Amberg will draft up an order for the Dog Board to sign. He will prepare a letter to the veterinarian that he can release the dog when the items agreed upon have been met. Either Mr. Gallagher is to replace the birds or work out a dollar amount with Mr. Sadler. Mr. Sadler said he was willing to wait until spring to replace his birds, as it is hard to get them this time of year. Mr. Amberg asked Mr. Sadler how the birds were identified. Mr. Sadler stated that they were ring neck pheasants. MESTDAGH,/(`YYA On 10-28-02 at about 1300 hours, I contacted Richard Sadler to pick up a statement form and a livestock owners right form, which are attached to this report. Sadler told me that he wanted the dogs that killed his domesticated pheasants on 10-24-02 put to sleep. Sadler filled out the livestock owner form requesting this to occur. The right's form and a copy of this report will go to the animal review board for review. See attached forms for more information. On 10-29-02 at about 1500 hours, I contacted the Humane Society about the dogs past history. One of the employee's, Troy, told me one of the dogs, an Australian Shepard, was returned to the owner after receiving a call from someone at the Sheriff's Office. When asked who had called to have the dog released the name was unknown. The name of the officer was not written down anywhere on the release form. The other dog, a Welch Corgi, was still in the humane society. I told them not to release that dog until after the animal review hearing regarding the livestock that was killed. Troy told me that the dogs both have been lodged at the Humane Society before for running at large. There was no history of the dogs chasing livestock before to the Humane Society's knowledge. I will attempt to contact the dog owners on 10-30-02 so they can fill out the dog owners rights form in regards to the animal review hearing. End of report. (1) A person commits the crime of initiating a false report if he/she knowingly initiates a false alarm or report which is transmitted to a fire department, law enforcement agency or other organization that deals with emergencies involving danger to life or property. (2) Initiating a false report is a Class C Misdemeanor. The Animal Control Officer/Deputy is directed by law to impound the dog(s). The Animal Control Officer/Deputy may enter upon private property to take into custody the suspect dog(s). Dog(s) observed chasing, injuring, or killing livestock shall be destroyed by either permission of the owner or order of the Board of County Commissioners. The dog(s) not directly observed chasing, injuring, or killing livestock is presumed to have been so engaged if the dog(s) is found: (a) in the area of injured livestock, and/or (b) feeding on a warm carcass. and/or (c) has eaten a portion of the livestock, and/or (d) has portions of the livestock in the dog(s) teeth. It is unlawful for any person to keep or harbor the dog(s) with the knowledge it has killed or injured livestock. If the dog(s) owner does not consent to allowing the dog(s) to be humanely destroyed if it is found to have chased, injured, or killed livestock. The only question to be considered at such hearing is whether the allegation that the dog(s) chased, injured, or killed livestock is true. No other issues are relevant and other issues shall not be considered. A dog(s) owner requesting a hearing must make arrangements for kenneling cost of the dog(s) with the Humane Society at 61170 SE 27th St., Bend, Oregon, while the dog(s) are in custody.
