BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON
Order Accepting Petition and Setting Date
For Public Hearing for Petition filed for the * ORDER NO. 2003-027
Roan Park, Russell and Yoke Road,
Annexations into the La Pine Rural Fire
Protection District.
WHEREAS, petitions requesting annexation of territory into La Pine Rural Fire Protection District
were submitted with the Board of County Commissioners of Deschutes County on March 3, 2003; a copy
of which are attached hereto as Exhibit "A-1, A-2 and A-3" and by this reference incorporated herein;
and,
WHEREAS, although the petitions are not in statutory format, the La Pine Rural Fire Protection
District however, will submit the proper forms by the end of the day on March 5, 2003; and
WHEREAS, ORS 198.857(3) requires the county board to set a date for a public hearing on the
petition no sooner than 20 days and no later than 50 days from the date of filing with notice to the
petitioners and to the board of the affected district; and,
WHEREAS, it is in the public interest to set the hearing date in order that the residents may receive
adequate fire protection as soon as possible; and
WHEREAS, the Board believes the documents can be easily corrected; and
WHEREAS, the next available hearing date within that time frame is March 26, 2003; and,
WHEREAS, the Board chooses to also require publication notice for special district annexations; now
therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON,
HEREBY ORDAINS as follows:
Section 1. That the three petitions for annexation to the La Pine Rural Fire Protection District,
copies of which are attached hereto as Exhibit "A-1, A-2 and A-3," are hereby accepted for filing, subject
to legal review.
Section 2. That a hearing regarding each of the annexations to the district shall be held on
Wednesday, March 26, 2003 at 10:00 a.m. at 1130 NW Harriman, Board Hearing Room, Bend, Deschutes
County, Oregon.
Section 3. Notice of Hearings shall be given in substantially the form set forth in Exhibit "B-l,
B-2 and B-3," attached hereto and by this reference incorporated herein except that the legal description
for B-3 shall be corrected prior to publication. The recording secretary shall cause the notice to be
published in The Bulletin on March 11, 2003 and March 21, 2003, and posted on March 11, 2003, in

three public locations within the county as follows: One notice shall be posted on or near the doors of the
meeting room of the Board of County Commissioners; one notice upon any official bulletin board
customarily used for the purpose of posting public notices within the county; and one notice shall be
posted upon any official public bulletin board customarily used for the purpose of posting public notices
within the proposed district. Notices posted shall be for not less than five (5) consecutive days.
Section 4. The Director of the Deschutes County Community Development Department shall
cause to be filed with this Board prior to March 26, 2003 (hearing date), a land use compatibility
statement regarding these proposed special district annexations as contemplated in ORS 197.175 and
199.462, and any other applicable statutory authority.

Endorsement of Annexation
WHEREAS, the Board of Directors of La Pine Rural Fire Protection District has received
a request for annexation from landowners/residents of the area described in Exhibit A
(metes and bounds legal description); and
WHEREAS, the principle act defining the powers of the District is Chapter 478, Oregon
Revised Statutes (ORS), and the District has made preliminary determination that the
proposed annexation is in accordance with current Board Policy; and
WHEREAS, described properties are split by the La Pine Rural Fire Protection Districts
current boundary; and .
WHEREAS, the Oregon Department of Forestry has reviewed and approved this
annexation in accordance with ORS 478.150; therefore
BE IT RESOLVED, the Board of Directors of La Pine Rural Fire Protection District
endorses the annexation of properties as described in Exhibit A and forwards this
resolution to the Deschutes County Board of Commissioners requesting approval of said
annexation.

SOUTHEAST OF GAS TRANSMISSION PIPELINE
Situate in the County of Deschutes, State of Oregon and described as
follows:
All those portions of lots 16, 20, 30, 31, 32 and 33, Block 1,
lying Southeast of the Northwest right of way line of the 100 foot Pacific
Gas Transmission Line, all as shown on the map of ROAN PARK,

WHEREAS, the principle act defining the powers of the District is Chapter 478, Oregon

WHEREAS, described property is within 4.7 miles of the main La Pine RFPD fire
station, and
WHEREAS, this annexation meets the needs of both the property owner and the La Pine
Rural Fire Protection District, and
WHEREAS, the Oregon Department of Forestry has reviewed and approved this
annexation in accordance with ORS 478.150; therefore

I am writing this letter to request that my property be annexed by Lapine Rural Fire
Protection District. This letter is in response to your letter of December 19 advising me
of this opportunity. As I am not aware of all the information that you will need to
complete this action, I will be glad to supply any needed information at your request.
I have had casual conversation with some of my neighbors regarding this topic and have
been met with a variety of responses. Many feel that since they pay Walker Range Fire
Protection taxes that they are covered for their structures also. Being contacted by an
official from your department could better explain the situation and potential benefits of
annexation to them.

right of way, now discontinued, being 50.0 feet wide on each side of said Railroad
Company's Main Track centerline as originally located and constructed upon,

Twenty-Four (24), Township Twenty-Two (22) South, Range Ten (10) East, the
North Half (N1/2) of Section Nineteen (19), the Southwest Quarter Northwest

NOTICE OF PUBLIC HEARING
BY THE BOARD OF COUNTY COMMISSIONERS
OF DESCHUTES COUNTY, OREGON
A public hearing regarding a proposed annexation, the Yoke Road Annexation, to
La Pine Rural Fire Protection District will be held on March 26, 2003, at 10 a.m.
in the Board of County Commissioners' Hearing Room, 1130 NW Harriman
Street, Bend, Oregon.
The boundaries of the proposed annexation are as specified in Exhibit "A,"
attached hereto and by this reference incorporated herein.
The purpose of the proposed annexation is to provide fire protection services for
the inhabitants of the proposed area to be annexed. All interested persons may
appear and be heard.
The meeting location is wheelchair accessible. For the deaf or hard of hearing, an
interpreter or assistive listening system will be provided with 48 hours notice.
Materials in alternate formats may be made available with 48 hours notice. To
