Resolution No. 2003-020, Declaring the County's Intent to Issue Obligation►s
to Reimbul•se the County for Certain h:xl►enditures for the Collhar Drive
location Improvement District; and Resolution No. 2003-021, Directing
Procedures for the Improvements to be Made to Collar Drive 1,11).
Gary Judd explained the purpose of the public. kcal -Ing. 1 le stated that if ob.icc•.ti011S
o1• more than 40% of the property ciwners arc received by the board, the process
I61, creating the Collar I )rive Local Improvement I)istrict shall be abandoned. I Ic
added that the Road I )epartnlent has not received ally written of)jections, and the
vote of the properly owners was 60% in livor and 40/0 opposed.
Corimlissloner Luke asked if everyone who was sent a ballot voted. Mr. Judd
replied yes; that in the. mail Doll vote, 60% voted yes. The owners of all fifteen
leas voted., with nine in favor and six against.

and 1 bought lot 111 on the Corner of Collar Drive and Masted Road. Our
driveway is Iocated about 125 Icct south oI'tile edge oI'MastelI Road, and it's
only 35 acct ftom the edge ol'our property line to the end of our driveway.
We Icel that in fairness, we are not treated fairly. The expenditulr 161
this project 161. each individual property owner is roulz,hly estimated at $10,700,
and we're only using 125 feet of pavement 1`61 -that much money. 1 and soli=
employed and (mike all h011est living, and We're wISe with our Illoncy. It's not
in slur best interest to spend that much money f w 125 feet of pavement.
Comillissioner Luke asked for Mr. Judd to comment on these assessments. Mr.
Judd said that eaell lot pays the same amount.

1 have a couple ofcluestions. 1 don't know if the other property owners who are
here today have gotten straight answers either. The first question is what
happens if this goes throuj,,h and a person can't make a payment on the `};10,000

Mr. Judd replied that it was estimated at 7%, at 1.5% over tile. bor►d sale rate..
The final number won't be known until the bond sale. The last one was at

Commissioner Luke asked if this is added to the property tax bill. Mr. Judd
explained that it is separate, and is paid semi-annually over a ten year period.
What would be the tacked on amount, or the negative amount fi-onl the County

property owners certainly didn't voice any objection.
Ie added that a lot of what they do is an educated guess. 'They try not to laid
too low, as they don't want to cotyle back to you requesting a higher amount.

the bond. bond interest rates are fairly low r►ow.
Mr. J udd added that it won't exceed $10,702.30.
Commissioner Luke said that the owners arc billed after the }project is dolle and
approved, and the final numbers are in. This normally takes at ]cast six months.
If someone doesn't have the $500 when it is due, as far as property taxes go
they have three years before the lien process starts.
Mr. Judd stated that the County's procedure is to work with individual property
owners; sometimes they just Have to pay the interest 161, a while. This has
always worked out fairly well. The Department has done hundreds of lots, and
all of the property owners seem satisfied with the. process.
Commissioner Daly asked what happens if they can't slake the payments. Mr.
Judd replied that if it goes over three years, the County can fioreclosure. /Almost
always something can be worked out with the people, however.
My next question is about the finance interest rate of 7°/,.

Comnlissioner I,tike answered that the final rate won't be known until the
bonds arc sold, but the current market is allotit that or a bit lower. Mr. Judd
added that the last one was at 6.75(%,.

Tile next question is, and I don't know ii many people know this, hilt property
taxes will go tip due to the improved roads.
Conlnlissioner Luke explained that they cannot increase by more than 3%, reel
Measure 50. There's also a true market value and assessed value. It wit) p,o

le said he'd like to point out that some of the lots in Whispering fines
subdivision, where a lot of local improvement districts have bee►l put into place
at the property owners' request, not long ago sold Im $5,000 to $?5,000. Now
some of them are selling Im tip to $125,000.

Will it go up more because we're oil a corner? 1 spoke with my stepmother
who is a illillion-dollar Selling Realtor; she's under the impression our property
values will not increase More than a couple of thousand dollars.
Commissioner hike observed that the County will Maintain the roads, and
generally areas with paved roads increase in value.

Commissioner hike said that there. was ► vote, and it was 60/40 in flavor. The
date's requirement is a major-it_y Of just over 50%, but the County has it at a
higher standard of G0%. When citizens want to vote to tax themselves, what
should it he -- 70°/o? 80%? FIveryone had a say. It is a democracy. According
to this, everyone voted. The County didn't fro out and ask to do this; the
property owners approached the County about it.

\N111a1 about Klamath County's responsibility? I was inlorined that the
beginning of the (levelopment, off the end of Collar I )rive where Deschutes
County and Klamath County meet, there are ninety lots in that back area in
K lan]ath County. I heard there was some kind of clause that Iorces them to be
responsible fir the maintenance of Collar Drive, which is their only access out.
Mr. Judd said that 1]e doesn't know what Klamath County requires. There are
about Ilfteen hollies there Ilow, and It's their Owl] practical access.

property in Klamath County, or visa versa.

They would only be using Collar Drive.

Ml. Judd replied that there's an intersection just inside Klamath County where
they can just push the snow.

Commissioner Luke answered that the road is in I)eschutes County, and the
County was approached by the citizens living, in the area. Although Klamath
County citizens will get some benefit from it, there are all kinds of roads that go
through subdivisions that bel]efit people other than the property owners there.

Why is the estimated cost $160,000 for approximately 1,200 feet of pavelllent?
And what about the side streets?
Cary Judd replied that it is based on last year's bid prices. And the side streets
don't access ally properties. County roads go Im about $50 per lineal foot.
Commissioner Luke observed that the base of the road has to be brought up to
standard, as without all adeCluate base it won't be in good shape for the asphalt.
Mr. Judd indicated that it would be put out to competitive bid. Commissioner

Commissioner Daly observed that if he were a homeowner there, he wouldn't
be happy about eating, the dust from the traffic in the area.

Mr. Judd replied that this was discussed at the two meetings held at the.
subdivision. 'There was talk about moving them to Collar Drive. It's ill) to the

could end up in front of Mr. Week's property.

Commissioner Luke asked hoxv far back from the street Mr. Weeks' honie is
located.
About 300 feet, about the same as everyone else. It's not real thick through
there and there are no fences. We moved out there so we could get away.
Commissioner Daly explained that he doesn't think they have the option to
change anyone's share of what they have to pay. Mr. Judd said that in past
years the Board has modified the cost of local improvement districts and
assessments, but there has to be a good reason to do so.
Commissioner Luke asked ifthe location ofthe mailboxes has been finalized.
MI'. Judd reliliCd that it would be located on the far side of Masten Road. Mr.
].like suggested that the mailboxes be left where they are and the road widened
there. Nil-. Judd replied that some parent wait in that location for their kids'
school bus to arrive. Commissioner Luke observed that no one wants to
jeopardize the children, and there needs to be adequate room 1or the school bus
to stop and let children on and off in a safe location. ) le added that it appears
that these details are still being worked out.
Mike Maier asked if the assessment could be adjusted if there is a wider spot off
Mr. Weeks' property for the mailbox. Mr. Judd said that any adjustment must
be done by Board action, but there is a sixty -foot right -of' -way casement, which
I.,; much wider than the road would be, so there is plenty of space without
ir►fHnging on Mr. Weeks' own property.
Commissioner Daly asked if there is any way to mitigate the problem with
people, turning around in Mr. Weeks' driveway; perhaps a bigger turnaround.

Or you could pave Illy driveway the maximum distance from Collar Drive,
which would keel) cars from backing off from my driveway and burning out,
messing up the dirt, snow and ice. 1 don't' want them getting stuck in Illy
driveway, either.
Mr. Judd indicated that he can work with Mr. Weeks and conte up with some
kind of solution.

charge by the foot, but each lot benefits by the improved road. Some people have
narrow lots on the Street Side, but if all of the. lots are about the Same Sire, they all
bcncfit equally. 1 le Said he has a real problem with going by Jootage on this.
1 le added that Mr. Weeks' lot, no matter llow much Space oil the street it has,

Commissioner Daly observed that Mr. Weeks will benefit by the paving, itself;
with less dust and the Road Department handling, the plowing, ofthe road past

That's why I have a tractor and 4 -wheel drive vehicle. 'That's why people have
lived there for thirty years with 4 -wheel drive vehicles. I have a year old
daughter, and Self-employed, and wart to do what is in the best interest of my
fcurlily.
Colllmissioner Daly Stated that it is a democratic society, and that's the way the
vote turned out. I le hopes Mr. Weeks can live with it.

I will, with no hard feelings. I lowever, I would hope to make a motion to call for
a vote, Since under Oregon law if we have a vote if 50% of property holders, that
we call Stop this, or allow this household to have a lower rate or a lower cost.

Gary Judd said that lie was contacted by the person who lives across the street
ftom Mr. Weeks. That property owner is on his honeymoon and couldn't be at
the meeting, bill said that if Mr. Weeks got a lesser assessment, we would also
like to apply for that sane, assessment.

Mr. Judd replied that if 50% of the property owners object at this hearing, the
HD would be abandoned.
Commissioner Luke said that there are times that not everybody votes. But
once you get 60% and they all voted, it's pretty well locked up.

Commissioner Luke said that he appreciates the concerns that Mr. Weeks
brought up. 1 lowever, he is not willing to go back to frontage being a
determination of 1.11) costs, unless a lot can be split. IF all lots are about the
none sire, he feels that all are equally benCIIted. This happens to be a road that
ends in another county; however, a lot of local improvement districts connect
rip with other paved roads, and that allows for escape from fire, emergerrcy
vehicle access and so on. l believe they benefit equally.
Commissioner Daly stated that he tends to agree with Commissioner hike.

Anytime you pave a rand ill front of someone's house, it doesn't change the tax
structure that much. I ]owever, when that person gets ready to sell the property,
he will benefit the same as the others.

Commissioner Luke added that ifthe. resolution is appWVCd today, the Road
Department can begin the hid process. When the bids come in, the owners will
be notified of the contractor and the project costs. As the project finishes up,
the financing costs will be known. That part is a really small portion of the
project over a ten-year period.

Commissioner Luke noted that there were few people in the audience, and said
that since Damian Syrnyk did such a 1ine,lob of explaining the ordinances at the
Monday Nvork session, they would go right into the public hearing portion to
take testimony and/or answer questions, if any. 1 le then formally opened the
public hearing.
Damian Syrnyk explained the purposes of the ordinances, and reicrred to an
oversized map showing the various quadrants, all of which are aflected by what
happens with quadrant one. It is located north of the new 131 -Mart store and the
proposed senior center. 'There is some urgency clue to these two projects, which
IS the reason why an emergency clause. is re(Iuested.

Commissioner l ,Like observed that if these ordinances are approved right away,
it haves the way for the senior center to proceed, and helps with working with
the Baldwin -1 ICI'nd011 'frust as well. l Ie reiterated that there was a full staff
presciltation on Monday, but he just wants to make sure any (questions are
answered.
Chuck Johnson, who is the new building chairman for the senior center pr().ject,
Said he had orle question. That was, "whell call we Start do►Il€', oul. thing oil it?"
George Read explained that right now that land is not owned by the County.
The survey process is underway, and should be completed by the end of the.
month. "There will be an agreement with the Baldwin -I Icrndon "frust to translcr
the land. This will probably lake another month or two.
Commissioner hike asked if passing the ordinances helps with the exchange.
Mr. Read replied that it would help with laying out the roads.
Mr. Johnson asked il'they would receive something in black and white that says
they own the land. ] le stated that he understands the property will he under
County control for five years, but they don't want to start construction until it is
their land.
Mr. Read advised that the County's goal is to acquire the land and then
11cgotiale regarding the match 461. the grant. They play have to have some kind
of transfer agreement.
Mike Maier stated that there will be a reversionary clause.
Commissioner l ,tike observed that Commissioner I kwolf has spent more time
than he and Commissioner Daly on this project, but the Board's intention is to
have the senior center built on it as soon as possible.
Mr. Johnson asked about the roads and streets beyond the senior center. Mr.
Read replied that this depends on the timing of Bi -Mart's construction. At this
time Bi -Mart doesn't have to build the road, but ifthey develop the rest ofthcir
property to the north, they may be on the hook for the road construction. l le
added that Bi -Mart has filed a master plan, and would have to go through a new
planning process if they want to change that plan.

Commissioner Daly said that the big answer is, we're heading, ill that direction

Commissioner Luke said that the County is committed to getting the building,
in, and asked if the senio►'s have been successful in raising, their funds to build
it. Mr. Johnson said that they are working, on it. They already have a pending,
sale on the old senior center building. They will be able to stay there until the

Mr. Johnson then asked who gets the proceeds From the timber that's on the
land. Commissioner Luke said it can be negotiated, but that they arc not in (I
position to make that decision today.
