RESOLUTION NO. 2003-032 WHEREAS, ORS 271.340 and 275.100 and Deschutes County Code (DCC) 11.08 provides that the Board of County Commissioners shall declare its intention to exchange real property by proper resolution; and WHEREAS, a hearing shall be held for the purpose of receiving objections to the proposed exchange of real property; and WHEREAS, Deschutes County intends to exchange real property for the Project declared in Resolution 98-122 and amended in Resolution 2003-009 in accordance with DCC Chapter 11.08; and WHEREAS, the Project was amended on January 22, 2003, by Order No. 2003-004; and WHEREAS, the Board of County Commissioners finds that the delayed exchange of the real property generally described herein to acquire the Project is in the best interest of Deschutes County; now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, AUTHORIZES AND ORDERS as follows: Section 1. That Resolution No. 98-122 be amended by the addition of the real property generally described in Exhibit "A" to this Resolution. Real property described by tax lot identification (Tax Lot ID) and serial number are described by Tax Lot ID and serial number as set forth in the records of the Deschutes County Assessor on March 20, 2003. The properties are more fully described in the records of Deschutes County. PAGE 1 OF 2 - ORDER NO. 2003-032 (4/03/2003) Section 2. The real property to be exchanged pursuant to DCC Chapter 11.08 by Deschutes County is generally described in Exhibit "A". Section 3. That the real property generally described in Exhibit "A," be available to be exchanged by Deschutes County for the Project described as the Health and Human Services Building in Bend, Oregon, the Becky Johnson Community Campus in Redmond, Oregon, the Rainbow House, the New Neighborhood Property in La Pine, Oregon, the Archive Building Property and the Deschutes County 2003 Capital Projects approved by Resolution 2003-009 (together referred to as the "Project"). Section 4. The Project shall be acquired as a delayed exchange. Each property described in this Resolution is eligible to be exchanged for cash to acquire the Project. Prior to deeding any property described in this Resolution, the Board shall enter an order in accordance with DCC 11.08.120. Section 5. A hearing for the purpose of receiving objections to the above described exchange will be held at 10:00 a.m. on Wednesday May 28, 2003, in the Board of County Commissioners' Hearing Room, Administration Building, 1130 NW Harriman Street, Bend, Oregon. Section 6. That the Clerk of the County Court shall give notice of the time and place for the hearing set in Section 5 of this Resolution by publication of the notice marked Exhibit "B," attached hereto and by this reference incorporated herein, in The Bulletin once each week for four consecutive weeks prior to the date of such hearing.
