BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON
An Order Amending Order No. 2002-156 to correct
the Scrivener's error in the Exhibit 'W', Page 3 of 4,
Legal Description surrendering a portion of Maple ORDER NO. 2003-052
Avenue to the City of Redmond, Oregon, Nunc Pro
Tunc as of December 18, 2002. "
WHEREAS, a Scrivener's error was detected on the Legal Description marked Exhibit "A", Page 3 of 4,
to Order No. 2002-156, and
WHEREAS, Exhibit "A", Page 3 of 4, describing a Portion of Maple Avenue of Order No. 2002-156 is
amended as described in Section 1, now, therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, HEREBY
ORDERS as follows:
Section 1. That Exhibit "A", Page 3 of 4, of Order 2002-156 is amended to read as follows:
A parcel of land located in the Southeast one-quarter of the Southeast one-quarter (SE SE '/a) of
Section 5, Township 15 South, Range 13 East of the Willamette Meridian in Deschutes County, Oregon being
more particularly described as follows:
Beginning at the Southeast corner of Parcel 2 of partition plat 1998-39, according to the official plat
thereof as recorded in the office of County Clerk for Deschutes County, Oregon, said point of beginning also
being located on the northerly right-of-way line for NW Maple Avenue; thence S89° 58' 25" W - 165.43 feet
along the southerly boundary of said Parcel 2 and also said northerly right-of-way line to the Southwest corner
of said Parcel 2, thence SO0° 01' 35" E - 65.00 feet to the South line of Maple Avenue; thence along the South
line of Maple Avenue N 89° 58' 25" E - 165.43 feet along a line parallel with the southerly boundary of said
Parcel 2; thence leaving the South line of Maple Avenue N 00° 01' 35" West - 65.00 feet to the point of
beginning.
Parcel contains 12407 square feet subject to all easements, restrictions, or right-of-way of record
pertaining to the above described lands.

THE CI'T'Y OF REDMOND

Before the Board for signature is Order No. 2003-052 which corrects a scriveners error in the legal
description for the portion of Maple Avenue transferred to the City of Redmond in Order No. 2002-
156.
Discussion:
The original Order No. 2002-156 transferring a portion of Maple Avenue to the City of Redmond
had an error in the legal description contained in Exhibit "A", Page 3 of 4. Two portions of the
original exhibit needed to be corrected:
♦ Thence S 00 01 35 E - 75 feet, should have read - Thence S 00 01 35 E - 65 feet.
♦ Thence N 00 01 35 W - 75feet, should have read -Thence N 00 01 35 W-65 feet.
I have attached a copy of the original description. This Order corrects the original legal description
to reflect the above changes.
Recommendation
The Road Department recommends signature of Order No. 2003-052

Hi Bonnie:
I talked with Nancy Blankenship at the County Clerks office regarding the incorrect legal description we
had on our recent road transfer resolution that effects the County (your order #2002-156).
I believe what needs to happen is that I need to send you a corrected legal description that you will, most
likely, have to re-record with the Clerk's office. I'm not sure if the Commissioners will need to re-approve
the transfer of the road again with the correct legal description. I think that is something that will need to
be handled from your end.
I'll be sending the corrected legal description, along with a letter, to you soon. The change is a small one,
indicating 65 feet rather than 75 feet. I'll let you determine from your end how you wish to proceed getting
your order re-recorded.
