REVIEWED LEGAL COUNSEL REVIEWED �Sy CODE REVIEW COMMITTEE DESCHUTES COUNTY CLERK Yd �QY�'Y�� NANCY COMMISSIONERS' JOURNAL 05/0611003 03;31;14 PM 1111111111111111111111111111111111 2003-000822 For Recording Stamp Only BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESC1 UTES COUNTY, OREGON An Ordinance Amending Title 23, the Deschutes County Comprehensive Plan, To Adopt an Exception to Goal 4 and To Amend the Comprehensive Map to Change the Plan Designation for Certain Property From Forest to Urban Residential Reserve, and Declaring an Emergency. * ORDINANCE NO. 2003-017 WHEREAS, Sisters Organization for Activities and Recreation (SOAR) and Sisters School District No. 6 applied for a quasi-judicial plan amendment to include certain property within the City of Sisters Urban Growth Boundary (UGB), change the County Comprehensive Plan Designation from Forest to Urban Residential Reserve, and change the zoning of the property from Forest Use 1 (FI) to Urban Area Reserve (UAR-10). The request proposed the County adopt an exception to Goal 4 (Forest Lands); and WHEREAS, the justification for said plan amendment requires that the plan designation of the subject property be changed to Urban Residential Reserve; and WHEREAS, such an application requires the County to adopt an Exception to Statewide Planning Goal 4, Forest Lands; and WHEREAS, the Exception to Statewide Planning Goal 4 requires the adoption of an exception statement and findings into the Comprehensive Plan; and WHEREAS, a public hearing was held on October 2, 2001, after notice was given in accordance with applicable law, before the County Hearings Officer; and WHEREAS, the Hearings officer recommended approval of the proposed plan amendment; and WHEREAS, a de novo public hearing was held on December 17, 2001, after notice was given in accordance with applicable law, before the Board of County Commissioners; and WHEREAS, the Board of County Commissioners approved the change in plan designation from Forest to Urban Residential Reserve, and amended the City of Sisters Urban Growth Boundary to include the property, through issuance of their decision dated January 23, 2002; now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ORDAINS as follows: PAGE 1 OF 3 - ORDINANCE NO. 2003-017 (5/7/03) Section 1. AMENDMENT. The Deschutes County Comprehensive Plan Map is hereby amended to change the plan designation for certain property, as described in Exhibit "A" and depicted on Exhibit `B" attached to Ordinance Number 2003-016, and by this reference incorporated herein, from Forest to Urban Residential Reserve. Section 2. AMENDMENT. DCC Chapter 23.120, Goal Exception Statement, is amended to read as shown in Exhibit "A" attached hereto and by this reference incorporated herein, to adopt an exception statement for certain property as described in Exhibit "A" attached to Ordinance Number 2003-016, and by this reference incorporated herein. Section 3. FINDINGS. In support of this ordinance, the Board adopts its decision for file PA -01-4, dated January 23, 2002, attached to Ordinance Number 2003-016 as Exhibit "C" and by this reference incorporated herein. This Ordinance being necessary for the immediate preservation of the public peace, healthand safety, an emergency is declared to exist, and this Ordinance takes effect on its passage. Sisters Organization of Activities and Recreation and Sisters School District #6. In conjunction with approval of PA-01-4/ZC-01-4, a "reasons" exception to Statewide Planning Goal 4, Forest Lands, was taken to include certain property within the City of Sisters Urban Growth Boundary (UGB). Reasons jusfi yingwhy the state policy embodied in Goal 4 should not apply in this situation are set forth in Exhibit "C" to Ordinance 2003-016, which findings are incorporated herein by reference.
