RESOLUTION NO. 2003-050 WHEREAS, the owners of land abutting the proposed right-of-way to be vacated, petitioned for vacation of a public road known as a portion of Peterman Lane, located in NW '/4 SE'/4 of Section 18, Township 17 South, Range 13 East, Willamette Meridian, Deschutes County, Oregon; and WHEREAS, the Board of County Commissioners has determined it to be in the public interest to consider such vacation; now, therefore, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, as follows: Section 1. That it is the intent of the Board of County Commissioners of Deschutes County, Oregon, to vacate a portion of Peterman Lane described in Exhibit "A", attached hereto and by this reference incorporated herein, because it appears the road is no longer needed for public use, and will not be needed in the future. Section 2. That the County Road Official shall file a Report with the Board of Commissioners, describing the ownership and uses of property to be vacated, and whether the vacation would be in the public interest, within fourteen (14) days of the date of this Resolution. DAL , COMMISSIONER EXHIBIT "A" Vacation of a 60 Foot Wide Road Easement Created in Major Partition 79-5 A 60 foot wide road easement in the NW Y4 SE % of Section 1.8, Township 17 South, Range 13 East, Willamette Meridian, Deschutes County, Oregon, being all of the 60 foot wide road easement lying north of the northerly right-of-way line of the cul-de-sac bulb of Peterman Lane as shown on Major Partition 79-5 as filed in Major Partitions Book 1 Page 82 of the Deschutes County Clerk's Office and being more particularly described as: Commencing at the brass cap monumenting the Center % comer of said Section 18; thence along the north line of said NW % SE % S89'47'43"E 601.23 feet to a 5/8" rebar monumenting the west line of said easement, the Point of Beginning; thence leaving said north line and along said west line S00°00'00"E 515.92 feet to a 5/8" rebar on the cul-de-sac bulb right-of-way of Peterman Lane; thence leaving said west line and along said cul-de-sac bulb right-of-way line 64.35 feet along the arc of a non - tangent curve to the right with a central angle of 73044'21", a radius of 50.00 feet and a chord distance of 60.00 feet (this curve is designated as curve 6 on said Major Partition 79-5) to a 5/8" rebar monumenting the east line of said easement; thence leaving said cul-de-sac bulb right-of-way line and along said east line N00°00'00"E 515.71 feet to a 5/8" rebar monumenting the intersection of said east line with the north line of said NW % SE %; thence leaving said east line and along said north line N89047'43"W 60.00 feet to the Point of Beginning. Bearings for this description are based on the north line of said NW Y4 SE % as shown on said Major Partition 79-5.
